The FSIN called on the courts less often to use the "guard", and this is an occasion to rethink relations between the state and civil society

On Saturday, April 18, it became known that the director of the Federal Penitentiary Service Alexander Kalashnikov sent a letter to the chairman of the Supreme Court Vyacheslav Lebedev, in which he called on judges during the epidemic to reduce the application of a preventive measure in the form of detention on crimes of small and medium severity. This is motivated by the fact that on April 1 the so-called filling limit is exceeded in 22 pre-trial detention centers, the worst of all things are in the pre-trial detention center of Moscow, the Moscow Region, St. Petersburg and Crimea.

“The total number of persons received in a pre -trial detention center in a pre -trial detention center on charges of crimes of small and moderate gravity is 8018 people or 43.7% of the total flow,” Kalashnikov reports in a letter and to justify his proposal refers to the difficulty of the work of the FSIN institutions in the conditions of the epidemic.

At the same time, even in a closed letter there is no data on the total number of coronavirus infected in places of imprisonment, although there are numerous signals about this from the sidella and their relatives, and it is already impossible to imagine that they were not there - a question on a scale.

It is possible that the number of cases was given in some applications-such data, of course, are, although approximate, but “lesion” was allowed only to the letter to the Supreme Court. It was not society that won, but the mind, which in the FSIN system, unlike the Investigative Committee, is still present.

But the main carrier of the “communicative mind” (according to Jurgen Habermas) is just society, it is developed in the process of communication between official structures and NGOs (non -governmental organizations, this term is preferable to “NPO”). And they were almost all purposefully destroyed in recent years. The Public Chamber, being a pure simulacrum itself, turned for the most part into the simulacrum and public observation commissions (PMCs), screening out of their composition of human rights defenders, and instead of appointing convenient people, including from the retired FSIN itself.

And where are they now, at a really critical moment? “They do not climb,” and the human rights activists who remained in the PMC under the pretext of an epidemic are not allowed into the places of imprisonment.

The greatest damage to civil society, starting in 2012,, of course, inflicted the “Law on Foreign Agents”: thousands of conscientious NGOs that provided assistance to one or another people who were in difficult situations were closed due to lack of money or simply because of the unwillingness to wear a shameful stigma. Oh, how these structures, experience and the desire of people who worked there would help to help others come in handy! How in emergency conditions the remains of local self -government were useful, which are the amendments to the Constitution is just going to finish! As the exterminated independent media would be needed, without which the “communicative mind” does not function.

But this, unfortunately, is already a “past war” - who lost in it as a result, it is clear - and who “won”?

Come on so. Civil society mainly with understanding takes reasonable measures of power, in particular, emergency in connection with quarantine, although the legitimacy of most of them is doubtful - but more on this, when it becomes calmer. So why does the state are so suspicious of the structures and initiatives of civil society? There is some hope that the pandemic of coronavirus as a bonus will weaken at least this paranoia of power.
