Klishas promised to vote against the “contrary to common sense” draft of the new Code of Administrative Offenses

Chairman of the Federation Council Committee on Constitutional Legislation and State Building Andrei Klishas, ​​in a conversation with Kommersant, promised to vote against the new edition of the Code of Administrative Offenses, which was prepared by the Ministry of Justice.

Klishas criticized the amendment proposing to impose fines of up to two thousand rubles for violating silence from 23:00 to 7:00. At the same time, according to Deputy Head of the Ministry of Justice Denis Novak, this article will cover not only those who make noise, but also those people who did nothing to ensure silence. We are talking about those people who, for example, left a loudly barking dog in the apartment or did not turn off the alarm in the car.

“Of course, the peace and tranquility of citizens at night should be legally protected. At the same time, under this good intention we see attempts to make changes to administrative legislation that contradict not only the spirit of the law, but also common sense. If these proposals are sent to the Federation Council, we will oppose them,” Klishas said.

He added that punishment for violating silence was not discussed at the meetings of the interdepartmental working group to prepare the new code.

“The uncertainty of the proposed norm is a sign of corruption. In most cases, citizens will not even know that they are doing something punishable, for example, if a person left for work and his car alarm went off. An example is also given of the barking of a dog left for a long time. They will be fined for crying a child at night, for the sounds made by animals, etc. They will be punished for something that does not bother most people,” the senator believes.
