
In fact, we are talking about a new configuration of the third chapter of the current Russian Constitution. Talking about this has been going on for a long time, but so far they have not led to anything specific. So far, only the Kremlin’s proposals are included in the agenda. There is no intelligible alternative to them.
A pause that no one planned allows you to look at this agenda a little detached, at a wider angle. It would be stupid to neglect this opportunity, so I'm sorry, the reader, but this is a text about another coronavirus - political.
It seems to me that the main danger to society is not to become a wrapping in Putin’s presidential terms (in the end, we still do not know who will replace him - maybe Putin will not seem the worst), but that Russia thus misses a chance to “reset” the autocratic tradition of the Russian authorities in the nearest historical perspective, which nullifies the efforts of the last few generations of Russian reformers. We actually reset a huge era, the beginning of which was not even supposed to Gorbachev, but the XX Congress, which debunked almost 65 years ago the cult of the most cruel Russian tyrant.
I see the problem that if you think not about replacing faces, but about replacing a system of power, then Putin’s departure, which is concentrated today excessively a lot of attention, in itself decides almost nothing.
Russia after Putin is highly likely, having experienced a lesser or greater trouble,
either fall apart, or return to the previous autocratic track,
fastened with the iron hand of a new leader, turning from revolutionary Paul into reactionary Saul.
Maybe one of the main lessons of our contradictory and dramatic century is that Russian autocracy is not a consequence of random historical circumstances, but rests on a solid cultural and institutional foundation. Accordingly, in order to jump out of the autocratic track, little political will and determination. At a minimum, extraordinary and effective institutional solutions are needed, the search for which is the most important theoretical and practical task of our time.
Constitutional reform is acute today, but completely different. Russia is sick with an autocratic virus. And - despite the prescription of the disease - medicines for it have not yet been found. The purpose of constitutional reform, in contrast to the Kremlin practiced by the counter-reform-spilers, is just not in the legitimization of the autocracy, but in the one
To instill in, finally, Russian statehood sustainable immunity to this slope.
Autocracy for Russia is not an accident, this is its civilizational choice. Russia is a European state. But Russia differs in almost everything from Europe, everything is arranged in it differently. This is “another Europe” - the once side branch of a common European culture, which developed in a full -fledged “parallel civilization”, similar to Europe, approximately as the “country of Wonders” by Alice looks like Victorian England.
This is the topic of extremely interesting, but, unfortunately, an endless conversation. Only a small fragment is important to us - about one significant difference between Russia and Europe, which subsequently predetermined the so -called “special Russian path”, forming the Russian autocracy as an analogues in Europe as a type of power and a unique “end -to -end” (that is, passing through all historical epochs) political practice.
Russian statehood stems from the same Judo-Christian cultural root as Western European statehood. But her evolution went the other way. Of course, both there and there, initially the ideological foundation of power was an idea of its sacred nature (divine origin). But the development of statehood in Western Europe was carried out through the gradual "erosion" and the crowding out of this ideologem. The released space was gradually filled with purely secular and rational (constitutional) ideas. As a result, the only bearer of sovereignty was declared an abstract and depersonalized entity - a nation.
A nation is a political fiction, one of the masks (pseudonyms) of society. Its use helped society develop a political algorithm that allows you to control the bureaucracy of the modern type, without which the development of capitalism was impossible. This algorithm, known as the system of separation of powers, is a complex system of checks and counterweights integrated into the political process.
In the Western European version, this is a division into the so -called executive, legislative and judicial authorities, to which elements of federalism sometimes also join.
If a modern bureaucracy is a dragon, ready at any moment to break out of the control of society, then the system of separation of powers is a tough leash that makes it serve society.
Russia went in a completely different way. In the XVI - XVIII centuries, she encountered the same historical challenges as the countries of Western Europe. Russia approached the threshold of its new time and needed the development of the modern industry, first of all, in order to solve purely military problems. This was impossible without creating a modern developed bureaucracy. So, there was a need for adequate control tools over it, similar to the one that at the same time created the best minds of European education. However, the Western European path of solving the problem was unacceptable for Russia, since for him there were neither cultural nor historical prerequisites.
Russia did not follow the path of erosion of the sacred nature of the authorities, that is, the transition from the predominantly sensual-emotional to its rational-sustained perception. Yes, this was almost impossible to do in the framework of the Byzantine religious tradition inherited by Moscow. Orthodoxy and desecalization of power are incompatible, because deification of power is one of the foundations of Orthodoxy. Instead, Russia has chosen the path of crystallization of the sacred nature of power and its rigid personalization.
This is a very subtle moment of Russian political philosophy, which, from my point of view, despite the fact that thousands of thousands of pages have been written about the Russian autocracy, is not fully understood.
As a result of a series of cruel transformations, begun by Ivan the Terrible and, in the first approximation of completed by Peter the Great, the foundations of the Russian autocracy as a political system were laid. An interesting feature of this system was the fact that the desecalization of power in general happened in it, but in a very strange way. It turned out to be partial (that is, only touched the bureaucratic machine) and was balanced by the mystical hypersocalization of the personality of the supreme ruler (king, emperor, Secretary General, President, maybe the chairman of the State Council in the future).

That is, the “state machine” itself with the whole bouncer forming it formed the officials to the philistine level (which made it possible, by the way, to exterminate from time to time a completely impunity of the most part of the Russian bureaucracy). But the top of this bureaucratic pyramid acquired the meaning of the sacred mountain.
The abnormal sacredness of the Russian ruler in all his hypostases, from Ivan the Terrible to Putin inclusive, the perception of his main mass of the population is not rational as an individual, but metaphysical as a mystical symbol of Russia,
It is not comparable with any European absolutism and can only be likened to antique samples.
This did not happen from scratch, of course, was prepared by the whole course of Russian history.
As Yuri Pivovarov shown brilliantly back in the early 90s, the formation of the “Russian system” goes far deeply in the centuries, to the times of Andrei Bogolyubsky. Within the limits necessary for solving the tasks today, it is enough for us to note that by the end of the 16th century this system has completely developed as a political alternative to Western European.
The autocracy, contrary to the common opinion about him, the phenomenon is not so much archaic (belching of Russian antiquity), as the attributes of Russian New Age. This is the Russian version of the Western European separation of powers - so to speak, the “our answer to Chamberlain” of the model of the 16th - 18th centuries.
Russia was generally faced with the same tasks in the political field as the leading countries of Western Europe: to create and learn to control the bureaucracy of the modern type, with which it is possible to maintain the development of industrial society. But Russia did not have resources to solve this problem as, for example, in England or France, and it had to go its own way. Instead of creating an abstract symbol - a nation - here they limited themselves to the endowment of the figure of the supreme ruler with symbolic properties. In Russia, the Supreme Ruler - this is the surrogate of the Western European nation, its sublimated embodiment in a really existing person.
"Russian System" is tricide. Instead of the attitude of “society - power” here, the attitude of “society - autocratic ruler - power” is the worker here. With all its known shortcomings, dismantled with particular care for many centuries, this system has one significant advantage - it is an extremely stable political form. The autocratic ruler is a dual -purpose political technology. On the one hand, it is a core of the bureaucratic system. This is his essential sign - there is no vertical of power, there is no autocracy. On the other hand, it is contrasted with bureaucracy, being a direct representative of Russian society, always preserving with it a transcendental, religious-mystical (or ideologically-mystical) connection, which is not based on reason, but instinct and feeling.
The supreme ruler in the eyes of Russian society is both the embodiment of the formidable power of the state, and a reliable protection against this formidable force.
He is a political ombudsman representing the interests of society in relations with the bureaucracy.
In practical terms, this means that the Russian power, from the time of Ivan the Terrible to this day, is divided, as well as power in the democratic states of Western Europe. At least - virtually - on external and internal, on the power of the bureaucracy and on the power of the autocrat. The latter, being part of the bureaucratic system and its generation, at the same time is an otherworldly in relation to the bureaucracy, in a special way associated with society. Russian society thus controls its bureaucracy, but not directly, as in Western European countries, but through a metaphysical intermediary.
The greedy, archaic and ignorant to the main mass of the Russian bureaucracy would have longed for Russian society, it remained with it alone. The Russian ruler, therefore, has such unprecedented freedom in relation to the Russian bureaucracy that he is entrusted with the mission to kick her, to drive her “for moisture”, forcing it to solve historical problems facing Russian society. That is why Pushkin called the Russian king the first European in Russia. But for this "Europeanity" in relations with the bureaucracy, one has to pay "Asian" in relations with the people.
The supreme ruler of Russia can control the bureaucracy only because he himself always remains nobody and in nothing uncontrolled. And this means that any supreme power in Russia a priori should remain permanent and tyrannical (the latter with amendment to the personal characteristics of the personality of the ruler varies in a wide range from Ivan the Terrible to Gorbachev). In a long historical perspective, despite its unprecedented stability, the Russian method of separation of powers is ineffective, since it makes the inevitable periodic revolutionary abilities of Russian history, bloody and meaningless, dumping the country far back, so that later it is a new breakthrough forward at the cost of even greater victims.
You do not have to be a great specialist in building social models to understand that autocracy is a historical impasse. In a sense, Russia's development is carried out on the principle of the pyramid - at each new stage, success is not achieved by increasing resources, but by borrowing them from future generations.
Ivan the Terrible internally united the country, forever breaking the ridge to the Russian elites. Peter the Great threw her in modern times, taking an overwhelming burden on the shoulders of the whole people. Lenin and Stalin made Russia an industrial superpower at the destruction of the Russian peasantry and the final enslavement of all other classes of society. The Soviet Union was already the last station along this path, there was nothing more to borrow and no one, the pyramid has exhausted itself and went bankrupt.
Putin runs Russia as the chairman of the liquidation commission: his goal is to save and attach better liquid assets to better. He imitates the movement forward, burning in the furnace of the decorative locomotive of the story the Soviet heritage that he got, which is still enough to let the dust in the eyes.
Each next version of the Russian autocracy is doomed to be a parody of the Putin regime,
Only even more miserable and grotesque, because the volume of resources that can be spent on imitation of movement will become smaller and less.
In the end, at some point it will not be enough funds for imitation, and at that moment the centrifugal forces will prevail over centroting, and the post-communist pseudo-imperial will break into parts, each of which will become the mild prey of more successful neighboring civilizations. You can prevent this scenario only by getting a locomotive of Russian history from an autocratic impasse.
The fact that autocracy is a dead end was already clear to the Decembrists at the beginning of the 19th century, not to mention all their political heirs. However, all attempts to take Russia out of this impasse invariably ended in collapse.
The Bolsheviks demolished the royal empire “to the ground” only then to build in its place an even more ugly and even more autocratic Soviet empire. 30 years after the collapse of the Soviet Empire, the post -communist autocrat in flaps collected its remnants to create a postmodern copy of the USSR.
When it comes to these failures, their usual explanation comes down to an anecdotal formula that, they say, “the earth is damned”, and the only conclusion is to try to break this wall with the head again and again, until sooner or later it collapses. But maybe the method itself was not entirely correct? Is it worth trying to go from the other side and try to solve the problem somehow differently than the way that it has been solved for the past 200 years since the Decembrist uprising?
Indeed, all this time, the question of autocracy in Russia tried to resolve quite monotonously, namely, using Western European political experience and ideological (either liberal or Marxist). But only he in Russia is slipping.
The ideas of political pluralism, the separation of powers, the rule of law and the like they work well in the cultural environment prepared for this. But in Russia there is no such environment; On the contrary, in many cases, Russian mentality rejects institutions that have grown up in the bosom of Western European culture, such as private property or equality before the law. Especially unsuccessful should be recognized attempts to introduce in Russia a Western European model of separation of powers.
It’s not that it was wrong, but it just doesn’t work in Russia, no matter what is written in the Russian constitution, it’s just that she has nothing to cling to in order to take root.
Russia in a cultural and political sense is not a naked board on which you can write any beautiful text, and it will become law. Many letters have already been written on this board, and everything new will have to be entered between the existing lines. Including there is also a habit of seeing a centuries -old tradition in the supreme ruler of the priest, a symbol of statehood and the only source of legitimacy of power. All words about the nation as a carrier of sovereignty bounce off Russian realities, like peas from the wall. In Russia, there is a special type of nation - a nation of one person.

Я не являюсь очень большим поклонником творчества Солженицына, как в политическом, так и в литературном отношениях, но высказанное им в середине 90-х скептическое мнение о политических реформах в России, мол, нельзя свою болезнь лечить чужим здоровьем, считаю очень точным и прозорливым. Система разделения властей в ее классическом виде, как разделение на исполнительную, законодательную и судебную власти, была реализована в Западной Европе тогда, когда процесс десакрализации власти и формирование современной бюрократии уже шли полным ходом. Таким образом, мало что мешало холодному рассудку препарировать власть в политическом анатомическом театре. Это и предопределило успех западноевропейского конституционализма.
Напротив, в России сакральность восприятия верховной власти обществом была и остается предустановленным софтом, а современную бюрократию по-прежнему России еще только предстоит создать. Поэтому все западные политические технологии контроля бюрократии — в том числе и в первую очередь такая, как разделение властей, — встречают в России мощнейший иммунный ответ и через непродолжительное время превращаются в бесполезные и безобидные для самодержавия декорации. Чтобы преодолеть барьер, надо обмануть политический иммунитет русской власти. Как это ни парадоксально, то, что нам больше всего мешает (сакральность российской власти), может нам в этом помочь.

Надо идти не от абстрактных представлений об устройстве власти, а от русской конкретики. Если стержнем «русской системы» является фигура верховного правителя, имеющая в глазах населения сакрально-символический характер, то расщеплять надо не власть вообще, а именно этот ее твердый кристалл. Только это в России может иметь практическое значение, все остальное — мимо кассы. При этом речь идет не об уничтожении «священного кристалла», а именно об аккуратном расщеплении, при котором некоторое время продолжат параллельно сосуществовать два или более имеющих сакральное значение в глазах общества центра власти. Если самодержавный центр просто уничтожить, то в условиях России, где все иные институты власти крайне слабы, это с большой вероятностью приведет к смуте и последующему насильственному захвату власти. При этом основные культурные парадигмы русского общества останутся прежними — оно будет искать мистический символ своего единства в лице нового верховного правителя. Он не заставит себя ждать и явится на волне послереволюционного насилия, потому что, имея такую фору, как сакральное отношение общества к власти, новый вождь самой логикой исторического и политического процесса будет приведен к необходимости сосредоточить всю возможную власть в своих руках. Система стабилизируется в привычных ей параметрах. И все начнется сначала, но в худших условиях.
Необходимо найти промежуточное, технологическое конституционное решение проблемы русского самодержавия. Возможно, оно будет совсем не идеальным и даже ограниченным по времени, но при этом позволит расшить ситуацию и вырваться из тисков «русской системы». С этой целью, прежде чем окончательно раз и навсегда убрать самодержавие с политической карты России, необходимо провести конституционную вакцинацию общества — привить ему «сакральную мультицентричность».
Для начала надо добиться того, чтобы сакральных центров власти в России стало как минимум два. В практическом плане в сегодняшних условиях это означает, что нам необходимо политически развести президента и премьер-министра как два равноценных и уравновешивающих друг друга центра силы. Сделать это можно, весьма своеобразно совместив принципы парламентской модели и президентской.
Одним из вариантов (но далеко не единственным) реализации этой идеи может быть, например «атипичная президентско-парламентская республика». Всенародно избираемый и соответственно обладающий высшей легитимностью президент должен быть лишен любой возможности непосредственно руководить исполнительной властью (бюрократическим аппаратом) и прежде всего, конечно, силовым блоком (армия, полиция, ФСБ и тому подобное) и финансовыми потоками. Эти полномочия в полном объеме должны быть сосредоточены в руках премьер-министра, назначаемого, однако, нижней палатой парламента и полностью подотчетного ему (естественно, что в этом случае премьер-министр является представителем контролирующей парламент партии или избирательного блока).
В этом случае мы получаем обладающего высшей электоральной легитимностью президента, не контролирующего аппарат исполнительной власти непосредственно, и не обладающего такой легитимностью премьер-министра, в руках которого будет сосредоточена вся реальная власть, в том числе над силовиками и над финансовыми потоками.
Чтобы у премьер-министра было меньше соблазнов узурпировать власть, устранив всенародно избранного президента с политической сцены, последнего надо наделить определенным объемом контрольных полномочий в отношении премьер-министра, в том числе правом давать согласие на назначение, а, возможно, и на снятие ключевых министров, в первую очередь — из силового блока и финансового, генерального прокурора, глав дипломатических миссий и так Next.
Так как обычно подобного рода полномочия имеет верхняя палата парламента, которая в политической системе современной России играет роль пятого колеса в телеге, то было бы логично сделать президента по должности главой верхней палаты, за которой сохранить также право утверждать принятые нижней палатой законы, а также исполнять ряд судебных полномочий — например, назначать судей на должности и решать вопросы помилования, а также разрешать споры между субъектами федерации. Естественно, я это обозначаю сейчас очень приблизительно, пунктиром. Эту палату можно назвать и Госсоветом — почему нет? Она может формироваться по смешанному принципу: отчасти президентом, отчасти субъектами федерации.
Что мы можем получить в итоге? Два ассиметричных центра политической силы — президента и премьер-министра. Один из которых обладает всей полнотой реальной власти, а второй прямой доступ к рычагам управления не имеет, но владеет самым широким политическим инструментарием, позволяющим опосредствованно влиять на политический процесс. Будучи отрезанным от рычагов управления силовиками и финансами, президент не сможет без каких-либо сверхусилий перетянуть одеяло власти на себя. При этом его контрольные функции искусственно будут усилены его максимально возможной электоральной легитимностью, вследствие чего он может эксплуатировать традиционные представления населения о сакральной природе его полномочий. Это дает ему серьезную дополнительную защиту и не позволит премьер-министру его быстро политически «съесть». То есть то, что в течение столетий работало против эволюции политической системы России, теперь может помочь ее развитию.
Можно продолжать идти проторенной дорогой и стучаться в закрытую дверь, пытаясь закрепить в Конституции России тот или иной вариант западноевропейского разделения властей, зная наверняка, что в итоге из нее все равно вырастет русское самодержавие. А можно пойти другим путем и закрепить в Конституции ни на что не похожую конструкцию, имеющую только одно преимущество — она привязана к российским культурным и историческим реалиям.
Таким образом, мы получим странную, но довольно устойчивую гибридную политическую систему, где исполнительная власть, словно пародируя российский герб, имеет две смотрящие в разные стороны головы. Их взаимодействие и взаимоотталкивание будет задавать параметры политического процесса в России, не давая ему скатиться в привычную колею. Among other things,
сам факт такого раздвоения будет способствовать медленной десакрализации отношения общества к власти, создавая предпосылку для дальнейшей эволюции политической системы.
В некотором роде такой конституционный проект восполнил бы выпавшее звено эволюции российской государственности — этап конституционной монархии. Но он может быть успешным, только если «транзит власти», неизбежный в России после окончания любого самодержавного цикла, пойдет относительно мирным путем.
Если режим будет сметен насильственной революцией, которая естественным образом выдвинет в русские вожди своего лидера, кто бы им ни был, о конституционных экспериментах придется забыть еще на один цикл. Что приобретено штыком, на штыке и будет сидеть.
По мере того как путинский режим стареет, в обществе растет нетерпение, и воображение рисует картины русского Майдана — бессмысленного и беспощадного. Это был бы, наверное, эффектный финал этой истории и, может быть, даже заслуженный. Но с точки зрения другой Истории, с большой буквы, более предпочтительным является сценарий «перестройки», то есть плавной трансформации режима через серию последовательных конституционных реформ при сохранении национального консенсуса. Только такой путь дает шанс избавиться от самодержавия не на пару лет, а навсегда.
