People who have been ill with coronavirus and, according to them, did not violate quarantine, complain of incorrect fines. Everyone has more than one fine that came one after another - in a total of 8 and 12 thousand rubles. We talked with two nurses and one employee of the theater museum about quarantine, fines and the same, with what the state appendix “Social Monitoring”.

Julia Yakovlevna* works as a nurse in the State Clinical Hospital. Botkin. It is on isolation, and then on quarantine from April 14 - although the first positive test for Koronavirus was on April 11.

“We were all tested, because we have contacts with the sick,” explains Julia Yakovlevna. - I continued to work first, then on April 14 my temperature rose, I went to isolation, but thank God, this was all over. They gave me an agreement and a decision, I gave voluntary consent to tracking, I was photographed. After that, I took four tests, and all this time I was waiting for the results. Yesterday they called me and said that everything was negative. ”

According to the nurse, from April 14, she left the house once - on CT, April 28, as prescribed by a doctor. But on May 6 she received a notification of fines, two in a row, for 4 thousand rubles each.

“Shortly before that, two policemen came to me with a difference of a couple of days, and they didn’t say anything about the fines,” says Julia Yakovlevna. - They came, I opened them, they did not come close. The second generally got under the windows, I have a second floor. The first policeman photographed me, said, pick up a passport, and then left. The second policeman came and says: I have to call you an ambulance. I tell him why, I am waiting for the results of the test, I feel good why to disturb the doctors. He began to call the authorities, did not know what to do. I told him: you know, the same as you came to you, he photographed me and left. He suggested taking a selfie, throwing him on the phone, gave me his number. "

According to Yulia Yakovlevna, not a word was said about fines. “I think, okay, they probably check that I am at home, they take pictures for this. And two days later, fines for 8 thousand came, ”says the nurse.

The case of a nurse is engaged in lawyer "Human Rights Cards" Anastasia Burakova. She believes that this story is not unique.

“With the“ Social Monitoring ”application, if you remember, there was a big scandal with Roskomnadzor when it appeared. It was planned to use it instead of digital passes. After they drew attention to a bunch of shortcomings, data in open and so on, it was deleted, and then they began to use it for those who are with confirmed coronavirus, but in a mild form is isolated at home, - explains Anastasia. - Installation of this application is a condition of insulation at home. By holding accountable, these are the first cases that we heard about. But it seems to me that if the application already fails and apparently gives incorrect data on human geolocation, then this can be a rather massive story. If the technique does not work correctly, then it is unlikely to incorrectly worked for only one or more people. ”

Information about incorrect fines for users of the application appeared on May 10 and at Kommersant: about a fine-also 4 thousand rubles-32-year-old Muscovite Vadim Arapov reported to the publication. At the same time, according to him, he also did not leave the apartment. Kommersant also drew attention to dozens of reviews on Google Play and App Store about the incorrect operation of the application and the same erroneous fines of 4 thousand rubles.

However, according to Julia herself, she did not establish the “social monitoring” application. Anastasia Burakova believes that the fine could still be erroneous, since in the system of tracking patients with coronavirus, which are on an outpatient solution, the cameras of external video surveillance and person recognition are also involved. “The accuracy of the data obtained from the cameras may not be very high, the camera can define a person incorrectly. And Julia says that neither she nor her colleagues left the limits of the apartment at that time. They work in medicine and understand what it is fraught with. ”

“MBH Media” contacted Yulia Yakovlevna, Lyudmila*, also working as a nurse in the Botkin hospital. It has been on isolation from April 19 with her family. On May 6 and 7, SMS-improvisations of fines, also two in a row, at 4 thousand rubles came to her son. According to Lyudmila, neither she nor her family members during quarantine left the apartment. At the same time, the woman says that she also did not install the “social monitoring” applications and the police did not come to them.

“The son entered the“ State Services ”, watched his fines, he has them there. The second is not yet, but one is already hanging, 4 thousand, ”says Lyudmila.

According to the nurse, she did not succeed in contacting anyone about the fine. The daughter found a telephone of district bailiffs, but could not get through. The Lyudmila herself, according to her, the quarantine had to end on May 3, the son - today, May 11. At the same time, she did not come any alerts about negative tests, according to the nurse herself, but they said that quarantine could be finished in the operative system.

“On the third of May, when the quarantine was supposed to end, I have not yet left, because I only had the fifth test,” Lyudmila explains. - I called to the clinic at first, they said to the opera station there. And they answered in the operating system that since you were not called, it means that you have a negative one and you can go out if there was no call. ”

Gordy Saltykov works in the theater museum. April 9, after he made a CT in a private clinic, Saltykov was hospitalized and ended up in the city clinical hospital No. 15 named after Filatova. There he stayed on treatment from April 9 to 15, with a diagnosis of coronavirus infection.

“Then, on the basis of blood tests, I was offered to switch to outpatient treatment, asking if there are relatives over 65 and pregnant women at home. I said no, they told me that then they could write me home, ”said Gordy MBH Media. - I was discharged. One or two days later, a doctor from the district clinic came to me, she was handed over to information about me from the 15 hospital. They took the analysis again, the fourth, took from me, from my wife, then from the children's clinic came to the child, a 6 -year -old child. Wife was given to sign a resolution (on quarantine - “MBH Media”), a resolution was signed for the child, and since that time we were already on quarantine. ”

Gordia Saltykov claims that on quarantine the whole family was safely and without violating anything. “Delivery works, friends, thank God, live in an apartment opposite, helped with garbage,” says Saltykov.

On April 26, Saltykov received an SMS on the phone, informing that he needed to install the Social Monitoring application.

“I am a law -abiding person, I set it,” says Saltykov. - I see the program, I understand that she will monitor me by geolocation. It is necessary to send, it means that selfie regularly. Well, please, I did this: 26, 27, 28, 29. On the 29th, SMS comes that it is necessary to put the same program to the wife, although we have both quarantine periods of both the 30th. ”

At the same time, according to Saltykov, from April 26 he had a second negative analysis for coronavirus - because he was preparing to become a plasma donor. Gordy plasma, he said, passed on May 4, 4 days after the end of quarantine.

“Somewhere in the evening of April 29, the program“ Social Monitoring ”began to fail very much. He asks to send a selfie, I will take a picture of myself, send it, and the program writes to me: Sorry, the incorrect work of the program. This happened exactly more than four times, ”says Saltykov MBH Media.

April 30, says Gordiy, he had to end with quarantine. He ordered a pass the next day to go to the district clinic and close the sick leave.

“I am removed by our head of the therapeutic department, makes some manipulations on the computer, and everything, it would seem, is closed,” says Saltykov. -And on Monday, in my opinion, on the 4th, I open my e-mail and see that I received a message from the website of the “State Services”: you have a fine of 4 thousand rubles. I am in a slight bewilderment, to put it mildly, try to find out something. I understand that I can’t find out anything, I go in a circle. Thank God, a familiar lawyer with whom, in fact, I was lying in the hospital in the same ward, prompted: he says, call the head control of Moscow in Moscow. I’m calling, they say, write on mos.ru, electronic reception, we will consider your appeal. I sat down in a detailed way on May 6, with the application of all possible prints, my tests and sick leave, I put it all and sent to the Military Control and Department of Information Technologies. ”

But after a few days, Saltykov discovered two more fines, when he accidentally saw in payments on Mos.ru two such fines for 4 thousand rubles. “But then I completely got into the expression,” says Saltykov.

In all fines it was written that the case was considered on May 3.

“It is obvious that this is a certain number, this is not a violation of May 3. Firstly, on May 3 I did not leave home at all, and secondly, I have been withdrawn from quarantine for three days. That is, on May 3 this consideration was carried out. But I think this is not consideration, but the program just worked automatically. Just on May 3, the automation, apparently, reached the automaton to write out a fine. I am sure that people didn’t watch anything there, I just did everything a computer, ”says Saltykov.

After that, Gordia Saltykov again turned to the Department of Information Technology, adding new information on fines. And later he wrote in support of the department on Facebook, having attached data, and there it was possible to get the answer that the requests are in processing.

“And now I'm waiting for the results, with the hope of a big one. Because my wife is without work, a child, I get a salary, of course, very cut. I work in the theater, in the theater museum, so 12 thousand for me this is a lot of money, ”says Saltykov.

Anastasia Burakova says: In order to now appeal fines, you need to wait for an official decree. Because now there are such fines, under Art. 28.6 Code of Administrative Offenses, are assigned without a protocol and person participation - since they involve automatic control means, as in cases of fines for speeding on the road. Only in conditions of restrictive measures, both applications and video surveillance cameras with person recognition can work. The administrative commission considers the case without the participation of a person, and then must send a copy of the decision.

“We will get the full text of the resolution, we will already have an idea at what stage this technical failure happened. Because there they are required to write the entire motivation part. But I suspect that the case is not a single one, and maybe someone else of the Muscovites who did not report anywhere in the media could also get such messages, ”says Burakova.

The city hall is considered “unlikely” errors when making fines for self -isolation. On May 8, the head of the Glavkontrol of Moscow, Evgeny Dantikov, said that 35 thousand fines have already been written out from the Social Monitoring application and video recording cameras, and “not one of them has yet been appealed.” “If a citizen believes that the fine came due to a malfunction of the application, he can use the existing appeal mechanism. It is necessary to wait for the receipt of an official custom letter with a decision on the commission of an administrative violation, in which the circumstances of the violation will be set out in detail, ” said TASS official. According to him, in case of disagreement from fines, a complaint about the decision can be sent in writing or electronic form within ten days from the date of its receipt to the body that was a fine, or to the district court at the place of residence.
