The Moscow City Court upheld five fines against Memorial under the law on “foreign agents.” One fine was canceled

Moscow City Court Judge Elena Novikova upheld five of the six rulings on fines against Memorials and their officials under the article on the dissemination of information by a “foreign agent” on the Internet without specifying the inclusion in the register of “foreign agents” (part 2 of article 19.34 of the Code of Administrative Offenses) . The court canceled only one fine: in the case of Yan Rachinsky, chairman of the board of International Memorial, about the absence of a “foreign agent” marking on the website “Personnel of the USSR State Security Organs. 1935−1939". The case was remanded for retrial.

In a conversation with OVD-Info, lawyer Natalya Morozova, who acted as a defender in all six cases, stressed that the decision was canceled on procedural grounds. In the first instance, the judge did not allow Morozova to attend the meeting as a defense counsel, and the Moscow City Court agreed that this was a gross violation.

The decrees on fines for International Memorial and Yan Rachinsky were left unchanged due to the lack of marking on the website “Victims of Political Terror in the USSR”.

The court also upheld the fine of HRC Memorial for the twitter page and website Illegal Profit Accounting in the North Caucasus against the Human Rights Center Memorial. In addition, the court did not begin to cancel the fine to the chairman of the Council of the organization Alexander Cherkasov due to the lack of marking on the pages of the HRC in VKontakte.

On May 28 , the Moscow City Court also approved a fine of 100,000 rubles to Yan Rachinsky, Chairman of the Board of International Memorial, according to the press service of the human rights organization. • Over the past six months, 28 protocols have been drawn up against the Human Rights Center "Memorial" and "International Memorial" on non-compliance with the law on foreign agents.
