"Now I will be painfully killing you"

A young dagestan is pursued by an ex -husband. Police and investigators on the side of the rapist

Gullya Kazanbieva claims that her husband beat her for five years, but the investigation did not include this in the case file. The woman was lucky: her husband was attracted under the article "Intentional infliction of medium severity of harm to health." He faces up to three years in prison. However, such a mild punishment is not enough for her ex -husband, the lawyers of the Memorial say. And they continue to ask for help from the Investigative Committee.

On September 13, 2019, Makhachkala brought a 25-year-old Gula Kazanbiev to one of the hospitals with a broken upper jaw, closed craniofield injury, a concussion, a fracture of the forearm, numerous bruises on the face and body.

A few hours before, she was tormented by her ex -husband Abdurakhman Kurbanov, according to investigators.

Gullya married Abdurakhman in 2014, a year later the son of Ibraim was born (from the first marriage a woman has a daughter).

When Gullya was in the seventh month of pregnancy, she accidentally found out that her wife has a second family (Sharia admits polygamy - D.Z. ). Gulle did not like it, and she asked her husband about divorce. He hit her in the face, as Gullya "New" tells.

For the first time, she fled from Kurbanov to a daughter -in -law in Makhachkala in the spring of 2015, unable to withstand the beatings: Abdurakhman beat her with his fists in the face, body, head in front of the child. For the escape, the husband beat the throat with a stick from midnight and until 6 in the morning, saying: "You ran away from me on these legs."

In a conversation with the “new” Gullya listed cases because of which her husband could raise a hand on her:

• The stranger looked in her direction

• She did not immediately answer her husband's call,

• She forgot the password from her husband Instagram.

• At the end of 2015, Kurbanov pushed to the ravine to Gulell - and began to throw stones. According to her husband, she crossed the road in the wrong place.

Relatives persuaded the dump to complain about her husband in the police, but she was afraid to angry him even more. In addition, Kurbanov constantly reminded Gulle that his father Ramazan Kurbanov, a local businessman - communications in law enforcement agencies. Gullya gave an eloquent example: her husband in 2016 was wanted for aiding illegal armed formations (NVF), but for some reason he was not held accountable. They say that his father could “smear him”.

As Gullya says, after she achieved a divorce in 2018, Abdurakhman began to pursue her, threatened to “burn alive”, “cut, take off”, “strangle” and “kill” in personal correspondence. From the threats went to action.

In the summer of 2018, Gully's parental house flooded with gasoline, where she was visiting at that time, and tried to set it on fire.

This incident was not recorded anywhere, says Gullya.

According to Gullya "New", then the district police officer did not accept the statement from her mother, which Kurbanov also threatened to kill. In the police department, the woman was advised to pick up a complaint, promised to talk with her husband’s parents to affect him.

“The only thing I remember is his evil face and my unreal fear,” says Gullya. - I closed in the bathroom. He knocked out the door [to the bathroom] in a second - and took me out of there. The first blow, I remember, it was very painful: I had a fracture of cheekbones, nose. I flew away from the first blow.

As Gullya recalls,

When he lifted her by the throat and pressed the knife blade to his cheek, Gullya “reconciled” with the fact that she was ended.

“Now I will be painfully killing you and gradually cut your body so that you are tormented before you die!” - Gullya conveys the words of the ex -husband at that moment. “Did you block my phone number with these fingers?” Now I will cut these fingers!

When Kurbanov was distracted by a friend who wanted to leave the house, Gullya jumped from the first floor out the window and began to call for help, as Gullya recalls. According to the neighbors, Kurbanov first tried to catch up with his wife, but seeing his neighbors got into the car and drove away.

- I went to the neighbors, I could not understand that he had left. Repeated: Close the windows! All the time repeated. Then she lost consciousness.

The next day, Kazanbiev woke up in intensive care. For several days she could not speak, move. In the extract from the hospital (there is at the disposal of the “new”) nothing is said about the fracture of the lower jaw. The criminal case under the article “Intentional infliction of medium severity of harm to health” (Article 112 of the Criminal Code of the Russian Federation, restriction of freedom up to three years) was excited on October 28, a month and a half after the events.

Local lawyers refused to take up this matter - they were afraid of the relations of the rapist’s family, and Gullya turned to Nadezhda Borodkina for help, which collaborates with the Memorial human rights center.

Protection requires, referring to the order “On the approval of medical criteria for determining the severity of the harm caused to human health”, to retrain harm to the health of the heavy - the lower jaw was broken in Gully. Then Kurbanov will take place under Article 111 of the Criminal Code of the Russian Federation “Intentional infliction of grievous bodily harm” (maximum punishment - 10 years in prison). But the investigator for especially important cases of the Kizilyurt inter -district investigative department of the IC of the Russian Federation in the Republic of Dagestan Murad Gadzhiev stubbornly refuses to do this.

-In this case there is some stubborn reluctance of the investigator to look into the eyes of the truth and say: "A broken jaw is not medium severity harm to health." According to the by-laws, the actually broken jaw is serious harm to health. Why does the investigator refuse to take this into account? - explains the lawyer of the human rights center "Memorial" Marina Agaltsova.

Nadezhda Borodkina twice petitioned for the conduct of the Judicial Psychological and psychiatric examination of Kurbanov, but the investigation ignored the application. Over the past six months, she wrote a bunch of complaints to the chairman of the IC Alexander Bastrykin and the head of the Investigative Department of the IC of the Russian Federation for Dagestan Oleg Potanin.

- And what should I do now? My client is now really in danger! - Outraged by the inaction of law enforcement agencies Nadezhda Borodkin.

Lawyer Marina Agaltsova notes that, unlike most cases with domestic violence, where the police refused to intervene, a criminal case was still instituted against Kurbanov. But they pursue an ex -husband under a very soft article.

“It is important for us to show that the system really cannot make it so that he no longer beats his wife.” If we take Chechnya as an extreme example of how Islam can be interpreted, we must pay attention to the recent death of Madina Umaeva. Then Kadyrov said that this was a family business, and also made his mother apologize. In my opinion, in Dagestan it is easier with the rules - there is no such radical Islam, ”explains Marina Agaltsova. - But, nevertheless, it is better not to interfere in families from the Caucasus. In our case, there was no such thing that the family discouraged the sores not to submit an application for him. The family, in principle, supported her, but she for a very long time pulled with the submission of an application to the police.

Not only in Dagestan, but in general in Russia it is difficult to achieve a criminal prosecution of domestic violence. As the lawyer of the Memorial notes, the situation in the “religious” republics is complicated by the fact that, firstly, we have decriminalized beatings. Secondly, the police do not want to intervene.

Now the criminal case on Abdurakhman Kurbanov is located in the Kumtorkalinsky District Court. It will be considered by Judge Amiraliev. Defenders this week will apply for the protection of the victim. But, as a rule, in such matters, the petition is rejected.

It is believed that the victim did not prove that she is in danger of real danger.

- If I were in the place of Gully, it seems to me that the only thing that could save me was to leave for another region. And the ex -husband would not have learned about my location, because there are no other ways to protect in Russia, ”Marina Agaltsova sums up.

Gullya thought to move to another region, but outside Dagestan she has no relatives. And she is sure that the ex -husband will not leave her alone.

Abdurakhman Kurbanov is now under house arrest. According to Gully, he continues to threaten her - in February, on the extension of the deadlines of the arrest, he said to her in a whisper in court: “I will not leave it like that. You will rot in prison. ”
