
The judge of the Tver District Court of Moscow Elena Bulgakova fined Leonid Drakin and Alexander Poychev for 10 thousand rubles, two detained on single pickets in support of the “Ombudsman of the Police” by Vladimir Vorontsov, as well as in support of the detainees on shares in his support. This was told by the OTD-Info by the civil activist Leonid Drakin, and also reports Mediazona.
Drakkina was fined under an article on violation of the rules of participation in the action (part 5 of article 20.2 of the Code of Administrative Offenses) due to a single picket on May 30 in support of the journalist Ilya Azar detained for the same picket. The court decided that the civil activist participated in a hidden form of a mass public event, held on one topic.
The Plenum of the Supreme Court in 2018 explained that several single pickets can be recognized as one action, but he listed a number of conditions that must be established during the consideration of the case.
According to the Armed Forces, single pickets can be considered a mass event if the pickets:
“Firstly, there were no pickets nearby. Secondly, the previous single picket was an hour and a half before me. The community of goals is difficult to see, especially since the previous picket was dedicated to Vladimir Vorontsov <...>, while I stood [in the picket] for the freedom of Ilya Azar, ”said Drakin.
A civilian activist, together with a lawyer from the OVD-info, Alexander Lokhmutov, stated about 10 petitions. Including the call of the police who detained Dragkin, and to watch a video of the member of a single picket. The court rejected all the petitions.
The leading radio station "Echo of Moscow" Alexander Poyshchev was fined due to the campaign on May 28, the OTD-info said in the "protest apology". The court found him guilty under the same article on violation of the rules of participation in the action (part 5 of article 20.2 of the Code of Administrative Offenses).
Then he, along with another leading Echo of Moscow, was detained twice, despite the presence of a press cortic. Journalists did not participate in pickets that day.
