Judge of the Ishimbay City Court of the Republic of Bashkortostan Rimma Vasikova arrested for three days Bayras Gabidullin, who was detained at a protest against deforestation on the Kushtau Shikhan. This is reported by “Apology of Protest”.
Gabidullin was found guilty under the article of disobedience to the demands of police officers (Article 19.3 of the Administrative Code).
11 August 12:45 Judge Vasikova on the same day, August 10, considered another protocol under the article on failure to comply with a lawful demand of a police officer (Part 1 of Article 19.3 of the Administrative Code) in relation to Bayras Gabidullin, Idel.Realii reports .
In this case, Gabidullin was also sentenced to three days of administrative arrest. As the publication writes, in the first case the judge counted the day during which the detainee was in the police department into the arrest period, but in the second case - not.
Member of the Human Rights Council under the head of Bashkortostan Elza Maulimshina, who spoke in court as the activist’s public defender, told the publication “Idel.Realii” what exactly he is charged with:
“In the first case, Gabidullin was charged with allegedly obstructing the passage of a police vehicle on August 5. The video presented does not record any “obstruction” on his part. He wasn’t even in front of the car, but was simply videotaping its movement from the side.”
Maulimshina emphasized that the car that Gabidullin allegedly interfered with (a custom minibus) did not have any police identification marks.
“In the second case, the protocol and police reports indicate that on August 6 Gabidullin allegedly did not comply with the police’s demands to stop “acting as a human shield” in preventing the access of special equipment from the Raw Materials Company to the mountain. But in court, the same police said something completely different - that he allegedly refused to go to the police department and thereby disobeyed them. Again, no evidence of this was presented,” Maulimshina added.
