Before the debate, lawyer Elman Pashayev tells reporters that his client today pleads guilty. At previous meetings, the actor assured everyone that he did not remember anything.

“We talked with Efremov for two days,” says the lawyer. - And Efremov said a good phrase. He says: “At the time of the crime, the people sentenced me to me. I am a honored artist of the people. And I was ready to bear punishment by the verdict of the people, when the crime was committed”. ”

The meeting really begins with the recognition of Mikhail Efremov. When Judge Elena Abramova asks if he is ready to continue the process without the participation of the second defender Elizabeth Shargorodskaya (she did not come to court today), the actor agrees and tries to make a statement. “I admit my guilt,” says Efremov. But the judge interrupts - now is the time of the performance in the debate of the prosecution.

The state prosecutor Diana Galiullina, a girl with long dark brown hair, first reminds that punishment under Part 4 of Article 264 of the Criminal Code, sane Efremova, is tightened: earlier the maximum term has been seven years, but now-12.

The accusation considers the actor's guilt in the accident completely proven. The state prosecutor notes that almost all the witnesses said: the jeep was precisely Efremov. Their words confirm the videos. At the same time, during the examination, the car did not find faults, and in the blood of the actor they found alcohol and drugs.

The state prosecutor considers the testimony of defense witnesses doubtful. And he explains that Witness Tevan Badasyan, who allegedly saw someone else in the jeep, was not in Plotnikov Lane, where Efremov got behind the wheel. His words refuted the video recording from surveillance cameras installed in the lane.

Another witness, Alexander Kobz, who told that the jeep was not Efremov, but a famous person whose name he cannot recall is poor vision, Galiullina notes. And his testimony also does not correspond to video recordings from surveillance cameras. A similar situation with the testimony of his friend Andrei Gayev.

“We reliably do not know the motives by which these witnesses tried to save Mikhail Efremov. But it was established that their indications are not true, ”the state prosecutor summarizes.

Mikhail Efremov writes something in a notebook and does not look at the state prosecutor. His friend, artist Eugene Mitt, sits with a notebook in the hall. In addition to him, only journalists in the meeting room.

Sighing, Mitta draws one after another of the participants in the process. “Efremov did not admit himself guilty, referring to the lack of memory,” Galiullin continues. - Although during the investigation he gave a confession and repented of his deed. As we see, the amazing forgetfulness and selectivity of Efremov’s memory did not immediately arise. ”

Despite this, the prosecutor's office asks the court to take into account the mitigating circumstances: Efremov has three minor children, and he himself has health problems. In addition, he is engaged in charity capacity, has state awards, and also transferred 200 thousand rubles to each victim in the case. At the same time, all the victims, except for the eldest son, Sergei Zakharov Vitaly, abandoned this money.

“Human life is of the highest value. It is impossible to fully compensate the moral harm caused as a result of the loss of a loved one, ”the state prosecutor continues. “By the deep conviction of the prosecution, the first steps to correction are the awareness of our guilt and sincere repentance, which we, unfortunately, did not hear at the hearing.”

Correction of Efremov, the prosecutor’s office believes, is impossible without real punishment. “The title of Honored Artist does not give the right to ride drunk,” says Galiullina. And he asks the actor to be sentenced to 11 years in a general regime colony. And also to recover from him in favor of the son of Sergei Zakharov Vitaly 500 thousand rubles, in favor of the rest of the victims - one ruble each (they themselves insisted on this amount, emphasizing that they did not need money from Efremov).

Hearing the requested time, the artist Eugene Mitt sighs heavily. And soon the hall leaves.

The following in the debate are representatives of the victims. The first word is taken by lawyer Irina Khairullina - together with Alexander Dobrovinsky and Anna Butyrina, she represents the interests of the widow, the youngest son and brother Sergei Zakharov.

Khairullina notes that before the accident, everyone knew Mikhail Efremov “as a big actor”, and his civil position “was close to someone and someone was not, but nevertheless impressive”: among other things, Efremov was engaged in political satire in the project “Citizen Poet”.

“But today we cannot talk about these circumstances: neither about his famous relationship , nor about the past merits,” the lawyer continues. “The law is one for everyone: for a simple courier of the delivery service, and for the people's artist of Russia.”

Khairullina, following the side of the prosecution, repeats that Efremov’s guilt has been proven. And the statements of his defenders that someone else is to blame for the death of Sergei Zakharov-passers-by and even Zakharov himself-they say that "Efremov is ready to use any loophole to get away from punishment." According to the lawyer, the Zakharov family could soften if the defendant repented and apologized, but this did not happen.

“The testimonies of the [friend of Mikhail Efremov and the poet Andrey] Orlov seemed sincere to us. We took the courage and asked him for his poems [written on the day of the funeral of Sergei Zakharov], handed them to the victims. You can’t even imagine how much gratitude they have for a simple human participation, ”says the lawyer.

- Pay more! - Elman Pashayev addresses her. But she does not react and emphasizes that the victims confused Efremov’s behavior in court.

“We did not see Mikhail Efremov here as the witnesses characterized him: [his friends] Nikita Vysotsky, Tatyana Berkovich and [wife] Sofya Kruglikova. Good, generous, ready to help strangers. Perhaps he is this, but not in relation to the victims, ”says the lawyer and asks the court to bear a fair sentence, which will lead to" the inevitability of punishment even for such a famous person. "

Colleague Khairullina Anna Butyrina decides not to dwell on the already sounded evidence of guilt and draws the attention of the court to witnesses of defense: Alexander Kobts, Andrei Gayev and Tevan Badasyan. She says that each of them "impressed the inconsistency of the testimony." And he asks not only not to take into account what they said in court, but also to check them under the article on knowingly false testimonies.

Butyrina also recalls that representatives of the victims every meeting heard insults from Elman Pashayev. And the lawyer Efremov allegedly threatened her that sooner or later he would “deal with her”. In this regard, Butyrina has already applied to the Investigative Committee.

“In this process, I was struck by the behavior of Pashayev and Efremov,” the lawyer continues. “In my opinion, such behavior is blasphemous and disgusting, and there is no forgiveness to such behavior.”

She, like the prosecution, asks the defendant to appoint 11 years of a general regime colony. At the end of the speech, Efremov sits, bent over, his face almost touches the table.

“Mikhail Olegovich himself put himself in such a situation. Who does not drink from the actors? Who does not drink from Russian citizens? We have such a disaster - we drink. But he drank - do not get behind the wheel. And if you drank, you need to answer for your actions, ”adds Tatyana Golovkin, the lawyer of the eldest son, Sergei Zakharov. And he emphasizes that Efremov’s statement about the guilty “belated”.

Sergei Avertsev, also representing Vitaly Zakharov in court, agrees with her. He indicates that the compensation proposed by the prosecutor’s office of 500 thousand rubles (Zakharov himself filed a lawsuit for 7.5 million rubles) is unacceptable. And he calls for the court not to consider Efremov’s case as an ordinary: “The power of Mikhail Efremov lies in his popularity, his fame. The fact that his act, any of his word is reflected in hearts and souls. Efremov’s statements made my client feel like a bug. ”

The last of the lawyers of the victims is Alexander Dobrovinsky. He is convinced that in court it is not the case of the “Honored Artist, the son of famous parents”, but the case of “Russian citizen Mikhail Efremov, who committed the crime, which entailed the death of a native of the Ryazan region of Sergei Zakharov”.

“From our beloved culture, the repentant sinner, he decided to turn into an ordinary criminal who wants to avoid punishment,” the lawyer concludes. “I am very sorry that the big actor turned out to be such a little person.”

“Why do you need 11 years? What are you doing? "

The speech of the lawyer Elman Pashayev is the longest - and takes about three hours. Most of the time Pashayev speaks of money. He repeats over and over again that it was the side of the victims that arranged a “show”, “festive event” and “dirty theater” from the process. And it was the opponents that Efremov could not compensate the victims of moral damage: lawyer Alexander Dobrovinsky forbade his principals to communicate with Pashaev and publicly stated that they would not accept the money of the actor. “We have repeatedly tried to ride, negotiate. Michael every day asked what with the victims. I say: “Michael, we are not the victims with whom you can agree with,” Pashayev says emotionally.

And he adds that none of the relatives came to the hospital and the morgue to Sergey Zakharov. “A man in the freezer lay, and they ran on TV channels, talked to the whole country!” - Pashayev is indignant. At the same time, Pashayev distorts the facts: the hospital was the eldest son of the deceased Vitaly Zakharov. Muscovite Irina Sterkhova came there, with whom Sergey Zakharov has lived for the past 20 years. Zakharov’s legitimate wife Margarita and youngest son Valery could not come from Ryazan to Moscow, as they were preparing for the funeral of his grandmother.

“We just searched for the truth, we never suited a hysteria,” Elman Pashayev finally moves on to the essence of the accusations. He complains that the defense side experienced difficulties when addressing independent experts-all of them refused to participate in the process, explaining that "they were banned."

“I can't understand what you want. Why do you need 11 years? Efremov repeatedly said: “Execute me.” What are you doing? Efremov is a famous person - Elman Pashayev appeals to the representatives of the prosecution. - Now they will write everywhere: “Navalny is lying in the hospital, now Efremov will be imprisoned for a position.” Do you understand what will happen? Why are you creating destabilization inside our Motherland? We came to court for a fair sentence. What are you doing? " The state prosecutor Diana Galiullina has been looking at Pashayev’s lawyer right in the eye all this time.

The lawyer is also dissatisfied with what was said about the witnesses he found: “I don’t understand where the law says that the witnesses of the victims are telling the truth, and the defense witnesses lie?”

Pashayev is sure that his client was never proved: no one saw that Efremov was driving a drunk. “Belated guilty admission-there is no such formulation in the Code of Criminal Procedure. Pences guilty - bad. He does not admit guilt - bad, ”he says.

Judge Elena Abramova’s lawyer tells him to make a fair sentence. “Efremov did so much for the people, where does such anger come from? - Pashaev is perplexed. - When Efremov plowed from morning to night, he had fun. And as an accident, he became a villain. ”

The actor’s defender asks to impose a punishment not related to imprisonment. And if this is not possible, then "at least a colony-settlement."

Mikhail Efremov refuses to participate in the debate. But decides to come up with the last word.

The actor immediately notes that due to popularity he is not judged as a “simple person”, but “in full”. And, as his defender Elman Pashayev, he in many ways blames the lawyer of the family of Zakharov Alexander Dobrovinsky - for example, that the process turned into a show, and with the victims it was not possible to “make peace”. At the same time, Efremov claims to the victims himself, he does not experience negativity. On the contrary, he sympathizes and worries for them.

“I really immediately said that I will not excuse me. And that's why I'm here, ”says the actor. He explains that he could take advantage of the “telephone right” and then the court in his case would not have taken place at all.

“So, I went to court and did not dismiss, but I am wrong in this. I did not admit guilt - and in this I am wrong. I just wanted to hear, evidence to see - it was wrong too, it was necessary to recognize without evidence - Efremov continues a little irritably. - Well, 11 years old, what, are you not enough? In general, I understand that I am wrong in everything. ”

As at the beginning of the meeting, he says that he pleads guilty and sincerely repents. But at the same time, he still doubts that he really controlled the car at the time of the accident, because he does not remember this. “There are such chic evidence. I probably did it. If I did it, I don’t know what to do next, ”says Efremov. - I want to say that alcohol is, of course, a wild evil. You need to know the measure always. Because if you do not know the measures, you will go to the bunks for 11 years. ”

The actor asks for forgiveness from the Zakharov family and reads a poem that he wrote on the ninth day after the death of Sergey:
