The Dzerzhinsky District Court found Marina-Victoria Nagornykh, who was detained due to an action of solidarity with protesters in Belarus, guilty under the article on violation of the rules for participation in a public event (part 5 of article 20.2 of the Code of Administrative Offenses), and imposed a fine of 10,000 rubles. This was reported by the public defender from OVD-Info Vladimir Vasilenko, who represented the interests of the Nagorny.
According to Vasilenko, the judge turned the consideration of the case into a meeting of an "extraordinary court", the creation of which is prohibited by the Constitution.
“Listeners were not allowed into the hall, despite the fact that I filed a petition for the admission of listeners to the courtroom. In fact, the judge single-handedly, by his decision, transferred the open court session to a closed session without a corresponding decision.
Also, the judge did not satisfy any of the defense's petitions, with the exception of the only one - to get acquainted with the case materials. The judge ruled on the case on the spot, without leaving the deliberation room. According to the law, the court is obliged to retire to the deliberation room to make a decision and analyze all the materials of the case, the Plenum of the Supreme Court spoke about this. But the judge decided to make a decision on the spot.
I filed a challenge to the judge, and the court continued to consider the case. After he got acquainted with the materials of the case, the judge proceeded to consider the petition for recusal. The judge did not satisfy the challenge, and made a decision on the spot, although he had to retire to the deliberation room and issue a written motivational ruling, on the basis of which he refuses to satisfy the defense's petition. He did not issue any written decision. That is, it was a real emergency court, ”commented Vasilenko on the circumstances of the court session.
