The story of the case

Yuri Dmitriev is the head of the Karelian branch of the Memorial Society, a researcher of the Great Terror, one of the founders of the international memorial memory of the victims of the political repression of Sandarmokh, the author of several books of memory, in which the names and biographies of thousands of those executed in Karelia during the Stalinist terror are published.

Dmitriev was arrested in December 2016. He was charged with several articles of the Criminal Code, including in depraved actions of a sexual nature and the manufacture of pornography with the participation of a minor adopted daughter. In April 2018, the judge of the Petrozavodsk city court Marina Nosova acquitted Dmitrieva for all grave articles, upheating only the accusation of weapons storage. However, already in June, the Supreme Court of Karelia canceled the acquittal and sent the case for a new consideration to the Petrozavodsky City Court. An article on the violent actions of a sexual nature against a minor was added to the initial accusations.

The case was considered by Judge Alexander Merkov, who justified Dmitriev in all respects, except for violent acts of a sexual nature. He sentenced to imprisonment for 3 years 6 months. The court used the 64th article of the Criminal Code, which allows to impose a milder punishment than provided for, in the presence of exceptional circumstances.

The public responded to the court decision in different ways. Someone considered that such a short time can be considered a pardon, but the main support group of the historian considered him unfair and demanded the complete excuse of Dmitriev.

Director Oleg Lipovetsky noted that such a sentence will not affect the attitude of honest people to Dmitriev.

“In our time, our judicial system does not pass acquitting sentences. As you know, there are fewer than in Stalin's times, therefore, on the one hand, this can be called success, of course. When they are charged with such an article by which they can give 15 years and give 3.5 years, of course, this is the glory of God. For honest people, the name of this person will remain pure,” Lipovetsky commented.

The journalist and human rights activist Zoya Svetova called "exceptional circumstances", according to which the judge issued a term below the minimum that Dmitriev is innocent.

The prosecution did not agree with the decision of the city court and requested to increase the sentence from 3 years 6 months to 13 years of imprisonment in a maximum security colony.
