
The Russian government plans to approve the legal status of apartments and allow them to register at the place of residence by the end of the year. This is stated in terms of actions to restore the economy.
“Determining the legal status of apartments with the possibility of registering in them at the place of residence - December 2020,” TASS quotes the corresponding clause of the document. At the same time, the plan specifies that to resolve the issue it is required to adopt the relevant federal law.
Recall that now the apartments relate to non -residential premises, and they cannot be registered in them, although in fact the apartments are housing. In addition, increased housing and communal services tariffs and tax rates are used for them, and in case of problems, the developer of apartments are not protected by law.
At the end of September, Deputy Prime Minister Marat Khusnullin said that the bill on the legal status of apartments in Russia is planned to be adopted before the end of this year. “We have prepared a law to determine the legal status of apartments. Now there are many disputes, this topic concerns Moscow and large cities more. What are apartments, how to recognize them, how to count social norms on them: we plan to make this decision before the end of this year,” the Deputy Prime Minister said.
Back in 2018, a bill was submitted to the State Duma on the transfer of apartments into the category of residential premises. The explanatory note to the document noted that the construction of apartments has become widespread in large cities and their unexplored legal status gives rise to a significant number of problems for citizens (the inability to register at the place of residence in such premises) and for cities (the unsecured citizens of social infrastructure). Then the bill criticized the Supreme Court, and after a while he was withdrawn from the State Duma.
Last year, the Ministry of Construction developed another bill regulating the construction of apartments. The department proposed to change the housing code and establish the procedure for transferring non -residential premises to apartments. In January of this year, Khusnullin said that the amendments that clarify the status of apartments can be adopted before the end of the year, then the Deputy Prime Minister recognized the need to adjust the legislation in this area.
