The court halved the sentence of the former vice-president of Rosgosstrakh

The Moscow City Court today halved - from eight to four years - commuted the sentence of imprisonment to the former vice-president of Rosgosstrakh PJSC Sergey Khachaturov. The article on legalization was removed for him and other articles were reclassified.

In July of this year, the Dorogomilovsky court sentenced Sergei Khachaturov to 8 years in prison, finding him guilty of embezzlement and fraud for 8 billion rubles.

Today, the Moscow City Court on appeal of the defense overturned the verdict of the district court under Art. 174.1 of the Criminal Code (“Money Laundering”), having terminated the criminal prosecution under this article due to the absence of corpus delicti with recognition of the right to rehabilitation. “The resolution actually states that the transparent use of income is money laundering. It is good that the Moscow City Court dealt with this episode and canceled the verdict of the court of first instance in this part, ”said Khachaturov’s lawyer Maria Blagovolina.

In addition, the court reclassified Khachaturov's actions from articles 160 of the Criminal Code “Assignment” and 159 of the Criminal Code “Fraud” to paragraphs of article 165 of the Criminal Code (“Causing property damage by deceit or breach of trust”).

Another person involved in the case, the former shareholder of Rosgosstrakh Bank Nadezhda Klepalskaya, was sentenced to a three-year suspended sentence, she was released in the courtroom. In July, she was sentenced to six years in prison.

• Khachaturov and Kapelskaya were detained in the spring of 2018. The plot of the case boils down to the withdrawal of assets from PJSC Rosgosstrakh through a company owned by Khachaturov on the eve of the transfer of Rosgosstrakh to Otkritie.

• The elder brother of Sergey Khachaturov, Danil Khachaturov, was the largest shareholder of Rosgosstrakh before the deal, but at the end of 2016 he agreed to sell the company to the then private bank Otkritie. The transaction was completed in 2017, and a few months later the bank was under the reorganization of the Central Bank. In exchange for the company transferred free of charge and a number of other assets, Danil Khachaturov was supposed to receive a share in Otkritie, but he never did , but his brother Sergei became a defendant in a criminal case.

• In September, Rosgosstrakh filed a lawsuit in the United States against Danil Khachaturov for $205 million.
