The Kiev District Court of Simferopol limited the time for familiarization with the materials of the case to the defendants in the second Simferopol case of Hizb ut-Tahrir Raim Aivazov, Osman Arifmemetov, Eskender Suleymanov and Ruslan Suleymanov. this on its Facebook page . reports Crimean Solidarity
The familiarization period for Osman Arifmemetov, Ruslan Suleymanov and Eskander Suleymanov was limited until November 20, 2020, for Aivazov - until November 26. The FSB investigator asked to limit the period of familiarization of all defendants until November 2.
Lawyers for the accused told Crimean Solidarity that there are more than 50 volumes in the case. At the same time, the latter has not yet been formed and not provided for review. In addition, the lawyers spoke about the obstacles in getting acquainted with the materials of the case, which arise through no fault of the defendants.
“Guys generally find it very difficult to get acquainted with audio and video materials, since only two laptops and two headphones were allocated for 25 people. Material evidence in this criminal case has not been provided to us so far, ”said Lawyer Edem Semedlyaev, who defends Aivazov.
Semedlyaev added that his client was not taken out at all for 18 days to familiarize himself with the case materials because of the quarantine in his cell. The lawyer noted that it was impossible to get acquainted with such a large volume of materials of the criminal case in such a short time.
Lawyer Ayder Azamatov, who defends Arifmemetov, said that, at the request, the defense filed a petition with the investigator for the priority provision of material evidence and audio files that are in the criminal case file. However, the investigator, at the request of the defense, did not provide them.
“The deadline that was set for us to familiarize ourselves with the materials of the criminal case violates the rights of my client: it reduces to a formal acquaintance with the materials of the criminal case and does not allow us to form a defense strategy for the upcoming court hearing,” adds Ruslan Suleymanov’s lawyer Lilya Gemedzhi.
The defenders also drew attention to the conditions of detention of the accused. Eskender Suleymanov's lawyer Rustem Kamilev said that his client was kept in a cold cell, where he was given a "stub of a blanket", which is not enough. Because of this, Suleymanov is cold and hardly sleeps.
Lawyers also spoke about the violation of the right to health protection: lawyer Azamatov said that his client was not provided with medical care for symptoms of SARS due to the lack of drugs in the isolation ward.
Defender Lilya Gemedzhi, who defends Ruslan Suleimanov, stressed that he was taken out of the detention center along with Aivazov, who is in quarantine due to the coronavirus detected in his cellmate.
