The moment of activation of Arslanbekov coincided with the period when the Office for Coordination of the capital construction of the Makhachkala administration revealed the fact of the illegal construction of a two -story building. At the same time, there was a trial in the lawsuit of the Makhachkala City Hall on this subject, where Omar Arslanbekov acted as the defendant. Then he filed a lawsuit to recognize the right to the house and land. The court attracted experts - cadastral engineers, they recognized the demand illegal.

Judging by the available court decisions, the house tried through the court to legitimize the cousin of the investigator - Gulzhanat Arslanbekova . The judge of the Lenin court , Magomed Okholov, satisfied her lawsuit, despite the fact that representatives of the city hall were not present at the meeting. The judge referred to the fact that the lack of permission to build in itself could not serve as the basis for refusing a lawsuit. However, on July 4, 2017, Ozholov canceled the decision of 2014, which recognized the ownership of Samostroy. Then the court did not know that the site located on the street. G. Tsadasi, 51, was allocated by Omar Arslanbekov.

A source of the Cheka said that on August 10, 2019, he nevertheless registered the rights to a building with a cadastral number 05: 40: 000056: 12422. The basis indicates the resolution of the head of Makhachkala No. 366 dated 07.24.1998 and a certificate of constant perpetual use of land. On the basis of the same documents, the ownership of the site with the cadastral number 05: 40: 000056: 50 was registered.

But the decision refers to the right to fix the atelier building for Arslanbekov, but no documents provided for in Art. 40 FZ-218 dated 07/13/2015, which serve as the basis for registering ownership of the building. For example, permission to put an object into operation. Moreover, the provision of a land plot on any right is not talking about at all, only the area of the land plot on which the building of the studio is located is indicated.

Such a practice existed, square meters were indicated that the copyright holders of buildings in the future understood the land plot of which area they have the right to claim when redesigning or re -registering it for rent. These issues are regulated by Art. 2 FZ-137 dated 10/25/2001 “On the enforcement of the Land Code of the Russian Federation” and the Law of the Republic of Dagestan dated December 29, 2017 N112. Such land plots according to regulatory acts should be redeemed at full cadastral value. But this has not been done, which means the damage to the city of Makhachkala is caused. Loud business and loud detention

The investigation believes that false documents were drawn up on behalf of Ragimkhanov in conspiracy with unidentified persons. Prisoners present illegally the provision of more than 30 land plots. Most of them are located in the microdistrict of the gearbox and Primorsky residential district of Makhachkala, on the street. The damage caused to the state was estimated in the amount of more than 370 million rubles. At the moment, all the charges have been removed from Figrate Rajabov, and he is free.

Pressure and deal with the investigation

A year after the persuasion of his father, Shihveledov made a deal with the investigation and recognized three episodes of fraud - allegedly for selfish purposes, he illegally took 11, 30 and 40 thousand rubles from citizens for the provision of registration services in 2016 and 2017. In response to this, the senior investigator in court requested the termination of the criminal case and the appointment of a judicial fine. And the court appointed him a fine of 50 thousand rubles.

Next in line is another judicial consideration in the Kirovsky District Court in the case of a private cadastral engineer.
