The judge of the Simonovsky District Court of Moscow dismissed the administrative case under the article on repeated violation of the rules for participation in the action (part 8 of article 20.2 of the Code of Administrative Offenses) against a participant in protests against the construction of the South-Eastern Expressway, who asked not to publish his name. This was reported by a lawyer from OVD-Info Ekaterina Ryzhova, who represented his interests in court.
The court has not yet issued a reasoned decision, so it is not known on what grounds the proceedings were terminated. Ryzhova connects the court's decision with the failure of the police to appear at the hearing and significant contradictions in the case file.
In particular, the lawyer drew attention to the contradictions in the indication of time. In the materials of the case, the police indicate that the action allegedly took place from 10 am to 10 pm. At the same time, according to the protocol, the activist was detained at 22:20, that is, 20 minutes after the end of the action.
“The detention took place 20 minutes after the meeting. Therefore, how he could be a participant, a potential participant, is unknown. Also in the report, the officers write that they detained [the activist] at 21:30, and in the protocol - already at 22:20,” Ryzhova said.
The court summoned the police for questioning in court, but they ignored the court's request to appear, which caused the case to be adjourned several times.
