Physicist Anatoly Gubanov was arrested in Moscow on suspicion of treason. His son Gleb Gubanov told Taki Dela that the family has not been able to contact him since December 7.
Anatoly Gubanov is a 63-year-old employee of the Central Aerohydrodynamic Institute (TsAGI). On December 3, the Lefortovo Court of Moscow arrested him - the man was accused under the article of treason , which provides for up to 20 years in prison.
Gleb Gubanov noted that he does not know the reason why such a charge was brought against his father - the case is closed. According to him, Anatoly was also involved in the international project of a hypersonic civil aircraft.
The man said that his father knew a lawyer whom he wanted to turn to for help. However, in the evening after his arrest, Anatoly changed his mind and entered into an agreement with another lawyer.
“Neither we nor he knew this man. We, in turn, entered into an agreement with another defender - Olga Dinze. After her arrest, she came to the pre-trial detention center to get a meeting with Anatoly, but she was not allowed to see him. She was only told orally that her father was refusing to protect her and that she would receive a written refusal by mail. I don’t know for sure what’s going on there, but it seems strange to me that my father refuses a lawyer whom his relatives trust,” Gleb said.
Gleb Gubanov clarified that his father called him twice from an unknown number, and also gave the family a note in which he said that the conditions in the pre-trial detention center were good.
“During the difficult years of perestroika, when many TsAGI employees found another job and went abroad, my father still continued to work there. I'm sure my father is not guilty.
I am sure that he is an honest man and a patriotThe fact that he continued to work at TsAGI during the most difficult years of perestroika shows his patriotism, desire to serve his country and does not at all fit with such an accusation,” says Gleb.
On December 17, the Moscow City Court will consider an appeal regarding the selection of a preventive measure for Anatoly. Lawyer Dinze and his family demanded that Anatoly’s pre-trial detention be replaced with house arrest. Gleb noticed that 10 years ago his father had cancer - lymphoma, which is now in remission. According to him, such a stressful situation could cause his condition to worsen.
On the same day. On December 17, the appeal of the second lawyer, with whom Gubanov entered into an agreement in the pre-trial detention center, will be considered. Dinze clarified that she tried to obtain from the Moscow City Court the materials of the criminal case and a copy of the decision of the Lefortovo court for review. However, she was refused, citing the fact that the materials contained a statement from Gubanov that he did not want her to defend him. According to her, if this is really the case, then her complaint will be withdrawn from consideration and she will not be able to represent Anatoly’s interests.
“On December 5, in order to get a meeting with him in the pre-trial detention center, I contacted the investigator and he told me that he was not ready to receive me, and told me to come on the 7th. They wanted to take these two days to carry out all the investigative actions, bring charges against him without my participation, and also interrogate him repeatedly. I know for sure that the investigator asked Gubanov to write a statement of refusal in order to prevent me from participating in his defense. The investigator cannot select this statement in the absence of a defense lawyer, in connection with which one can question the existence of a voluntary expression of the will of the person without any coercion.
I believe that Gubanov had a significant psychological impactThere is Article 49 of the Code of Criminal Procedure of the Russian Federation , according to which, if necessary, a lawyer is granted a meeting with a participant in a criminal case. They didn't provide it to me. I believe that this refusal was forced and not voluntarily declared on the part of Gubanov,” Dinze claims.
A relative of Anatoly Gubanov, Maria Pogodaeva, wrote on Facebook that the family is now collecting signatures for the Lefortovo court with a request to change the preventive measure. “Anatoly is not dangerous to society, he is a very modest and worthy person, he does not deserve to be in a pre-trial detention center when his guilt has not been proven. His health may not hold up,” the girl noted.
