Gayane writes to me - a prisoner who has been sitting in the women's colony in Vladimir for the last six years on charges of fraud. That's just no fraud, as the lawyers say, was not there.

An exemplary family

“My story began eight years ago,” Gayan continues. - During this time, even those minor evidence of my innocence that were disappeared. I only have my words. But no one wants to listen to them, and even more so. ”

In fact, it all started even earlier, when in Khanty-Mansiysk, the mother of Gai, an entrepreneur of Georgian descent Natalya Ciclauri, met a man named Huseyn-Zade Altai Oktay Ogly. He will later change the name and become Arthur Isakov.

Natalia and her new acquaintance began an affair. At that time, Little Gayane lived with her grandparents in Georgia. After some time, the couple got married-and the girl moved to Khanty-Mansiysk. Altai Octaevich suggested calling him dad. The girl accepted her stepfather and sincerely fell in love.

Years later, she will continue to call him a father, she will tell reporters that she was always surrounded by love, and forbid lawyers to talk about “dad” badly.

“Relations in their family were good and warm until May 2012,” says one of the lawyers Gayan, Veronika Bondarenko. “Then a serious conflict occurred between Arthur Isakov and Natalya Cyclairi.”

Divorce and division of property

In the spring of 2012, Guy realized: her family is crumbling. Natalia Ciclawi owned shares in several companies both in Russia and abroad. But in 2010, her husband tried to get a residence permit in Germany, informing the local authorities that he invested more than 10 million euros in a business in Germany. They found the story of the suspicious and opened a criminal case of laundering income. Natalia managed to prove that we are talking about her money earned in Russia. The accusations from Isakov were removed. And between Natalia and her husband, a loud divorce proceedings began with the war of compromises in the media.

“In fact, Isakov performed fraudulent actions in order to cause damage to his wife, re -registering their shares in German business for third parties,” continues Veronika Bondarenko. “At the same time, all assets in Russia, including the family of the family in the Odintsovo district, were issued to the legal entity.”

Gayane participated in the family business. Perfectly educated, with a diploma of the Financial Academy, after an internship in Oxford, the girl helped her mother. When the divorce and division of property began, Natalya made Gayan the general director of her three companies. The lawyers assured: nothing threatens the girl. Natalia, along with two younger daughters, was outside of Russia.

“Isakov claimed not only a section of shares in business, registered with his wife, but also for the property of companies. According to the law, he had no right to him, - continues Veronica. “This was confirmed by court decisions.”

And with the property of the three LLCs, transactions passed. The documents were signed by the general director - Gayane Zainabutdinov. Her stepfather tried to cancel them through civil lawsuits, but each time he received a refusal. Realizing that he would not achieve anything, Arthur Isakov found a different way to take everything: he filed an application for the initiation of a criminal case against his ex -wife and Gayan.

Sentence

“So my family from respectable turned into scammers, into criminals. And neither the investigation nor the court want to figure it out, because we are dangerous for a civilized, high society, ”Gayane writes, and behind the words there is a burning, simple pain.

Arthur Isakov achieved his goal. In December 2015, the Lefortovo Court of Moscow found Gayan guilty of fraud and sentenced it to six years in a general regime colony. Judge Elena Kaneva and this did not limit herself. By her decision, Gayan was supposed to pay his stepfather more than 78 million rubles.

“Gayane did not commit any fraudulent actions,” says lawyer Anastasia Samorukova. - When at the beginning of 2019, my colleague Natalya Zemskova and I joined the work on this case, we studied the verdict. He was ugly. It was impossible to understand why the court decided that the actions of our client were fraud. And if fraud is a form of theft, then what was stolen? According to the verdict, it turned out that Guy abducted not property and not even property law, as the law implies. The right to property law - it was this obscure structure that was the subject of theft. But in accordance with the law, it is simply impossible to steal. ”

According to the court, the same transactions that Isakov were so eager for cancel, demanded his consent.

“By law, they do not require it. Yurlito, the company is an independent owner. If Isakov were a co -founder of these companies, his consent would be mandatory, the lawyer continues. - Having received, during a divorce, his 50 percent shares in the business of Mrs. Ciceluri, Isakov could become a business participant. But he did not even try to do this. ”

But in the end, Gayane made a fraud. Neither the appeal nor the cassation instance canceled this sentence. With his help, not half, but the entire business of Natalia Cicelsuri and property, Arthur Isakov managed to re -register with himself and a certain Vyacheslav Efimenko, completely unfamiliar to these events, neither Gayan nor her mother.

“It was hell, who brought down my father to my family, using the administrative resources and family ties of his accomplice,” writes Gayane. She calls Vyacheslav Efimenko in a letter "Black Raider."

Sorry for the girl

Gayane, not fully believing in what was happening, went to serve his sentence in Vladimir. In the colony, she worked as a nanny, looking after the children of other prisoners, and was waiting for justice. Guy Zainabutdinova spent five and a half years there, while lawyers tried to get a revision of the case. In the end, practically not hoping for success, they made a complaint addressed to the chairman of the Supreme Court of Russia Vyacheslav Lebedev. But the complaint was considered. The case was referred to the second cassation court.

“The meeting took place on December 12, 2019,” says Samorukova’s lawyer. - We were sure: the sentence must be canceled! But he was upheld, despite the direct recommendation of the Supreme Court to carefully study the arguments of the defense again. All that we managed to achieve - Gayane was reduced by six months. "

Already on December 31, 2019, Guy was supposed to be released. True, the girl had nowhere to apply for registration at the place of residence. The house where her family lived went to Isakov, and the stepfather wrote out of him a former wife, and his two daughters, and Gayane.

You won't go anywhere

Hopes for liberation collapsed almost immediately. A few days after the meeting with the court with a motion to leave the girl in the pre-trial detention center, the deputy chief of the 1st department of the SU SU SU in the Southern Federal District Irina Panova appealed. All because of another criminal case, initiated in May 2016, immediately after the first sentence entered into force. Now it was about laundering income.

“On December 20, 2019, the court decided that Gayane would remain in jail,” says Veronika Bondarenko. - The new article does not implies imprisonment until the investigation and trial are underway. But this did not bother anyone. "

According to lawyers, the court explained its decision by the fact that Gayan has nowhere to live, which means that there is no way to apply for registration. Despite the fact that the lawyers concluded an agreement under which the girl was ready to shelter her family friends, the judge was adamant.

“The court expressed distrust of this agreement, because Gayane was not present when signing it,” says Anastasia Samorukova. “But how could she be present if she was in jail all the time?” No explanation. After that, Veronika Bondarenko already signed the same agreement with Gai. She was ready to settle the girl in her apartment and register her there. But this did not work. "

The lawyers again sent a complaint to the Supreme Court, but the second time there was no miracle. All their appeals remained unanswered. Gayane was again taken away from freedom, when there seemed to her one step.

“The purpose of all this is to break a young woman so that she pleaded guilty of a crime she does not commit,” says Veronika Bondarenko.

Keep the mind

Two years ago, Olga Romanova, the head of the charity fund for assistance to convicts and their families “Rus Sitting”, learned about the Gayan case, and Gayan had support and support, which she no longer hoped for.

“Olga simply could not remain indifferent to the fate of the traffic police,” says Anastasia Samorukova. - She was the first to start talking about Gayan in public space. Thanks to Olga and the Fund, this story became known in the media. In Novaya Gazeta, two large articles by Leonid Nikitinsky were published. This is very important, because this is the only way we were able to attract the attention of the public and get help from human rights defenders. ”

Three high -class lawyers were already working on the Gayane case, so the fund concentrated on another - on human, friendly participation. “The Rus of the Sitting” managed to find volunteers who were ready to constantly support Gayane. With all their might, they showed the girl: she is not alone, behind the walls of the isolator they are waiting for her. The volunteers wrote and write letters to her and transmit parcels with simple, but important gifts - things, products, books. They became a support for Gayane, which remained with the system almost one on one. According to Olga Romanova, one of the girls became a truly close friend for the traffic police.

“I tried to imagine what a young woman feels, who, without any fault, was in prison because of the divorce of her parents and sits there for years,” says Olga. - For what? How did she save the mind? Where does such optimism come from? And how will she live when all this will end? "

In May 2019, Gayane health deteriorated sharply. The girl needed an operation. She was hospitalized in a prison hospital, but there doctors could not do anything. It was possible to transfer the girl into another medical institution and operated only in late November.

“This is a terrible mockery of a person,” says Anastasia Samorukova. - Now Guy is in jail again. We filed a complaint with the ECHR on the measure of restraint. She has already been sent for consideration to our authorities. The Russian Federation should give its answer until January 25, 2021. And we are still waiting for a new sentence. ”

All this time, letters from volunteers awaiting its liberation come through the walls of the pre -trial detention center to Gayan. And the employees of the fund begin to prepare. They know from experience: getting free is half the case. We must still learn to live in the wild after so many years of imprisonment. Guy will not be easy.

“There is hope that its term will be able to reduce,” says Olga Romanova. - But the most important thing is what will happen to the wiper after all this. There are many questions. Where will she go? What will he do? Where will it live? Our psychologists are already waiting for her. They will work with Gai, help her adapt to the conditions, from which for so many years she had already managed to wean. We will all be with her and try to do everything possible so that she will return to a normal life. ”

The story of Gayane turned out to be quite loud, so the “sitting Rus'” managed to quickly find people who were ready to reach out the girl’s hand. But there are hundreds of prisoners outside the walls of the pre -trial detention center and colonies, no one helps whom, except for the experts of the fund. Only in December 2020, specialists processed 280 letters from prisoners, held 615 legal advice, sent 49 parcels in the colony and pre -trial detention center, coordinated 14 groups of parental mutual assistance - this is far from all. The fund exists exclusively for donations, and if they run out, the prisoners and their families will remain completely without support. Even 100 rubles a month is tangible help for those who are ready to help people on whom society and the system will rather put a cross.

I read the letter, feeling powerless rage. Guy writes: “The powers that be have the right to judge and mercy. Justice in our country is just a theater, and my life and the life of my family are an insignificant obstacle. My situation is not monstrous. What do you?! This is just the ordinaryness of our civilized, humane society. And you are stupid if you are looking for help from stateweight ... "
