The accused of the execution of colleagues in the Trans -Baikal military unit, Private Ramil Shamsutdinov made the last word in court. On December 22, in the second Eastern District Military Court, the debt of the parties in the criminal case was held. "Ramil Shamsutdinov in the last word said that he was brought to this step (murders of colleagues. - Note Newsru.com ), he did not want this, he repented in his deed," the lawyer Ruslan Nagiev wrote on his VKontakte page .

He added that the state prosecution asked the court to find the conscript guilty of all points of the prosecution and "do not show condescension to it." The defense insisted on the opposite.

“Shamsutdinov committed a crime in a state of strong emotional excitement (affect) caused by systematic bullying, beatings and deprivation of sleep for three days,” the lawyer added.

According to Nagiyev, the deprivation of sleep, according to the European Convention, is torture. In addition, several witnesses confirmed the facts of hazing, from which Shamsutdinov suffered.

Another ordinary defender, Ravil Tugushev, turning to the jury, asked to show compassion for the defendant. “This is a young man, he is only 20 years old. Give him an opportunity, albeit in many years, but return home and see loved ones,” Zabnews lawyer quoted.

Recall, on October 25, 2019, in the village of Gorno in Transbaikalia, a serviceman of the warehouse of nuclear ammunition warehouse (military unit N 54160) Ramil Shamsutdinov shot 10 colleagues. He was called up from the Tyumen region in the summer of 2019. As a result of the shooting, senior Lieutenant Pyankov, Captain Evseev, sergeant of the contract service Roman Kovalev, corporal Andreev, ordinary Bogomolov, Nikishin, Kuropov and rocked, died. Two more servicemen, ordinary counts and shpak, were injured.

According to the Ministry of Defense, the soldier had a nervous breakdown due to "personal circumstances." The Commission of the Department found that there was an “interpersonal conflict” , and Shamsutdinov was “psychologically incompatible” with one of the officers who were part of the guard. The commission did not confirm the facts of physical violence against the soldier.

The head of the Ministry of Defense Sergei Shoigu said that he had previously ordered to send security units for long tasks (more than three days) to the army employees under the contract, and not a military service soldier. But his order was grossly violated , which led to such a "glaring crime."

The investigation checked several versions of the incident, including the one that the murder occurred due to xenophobia: supposedly colleagues mocked Shamsutdinov because of his nationality. According to one of the former Solder soldiers who served in the same part, grandfathers flourished there.

In December, Shamsutdinov was recognized as a victim in the case of an endless relationship.

In January, Shamsutdinov’s open letter was also published, in which he explained his actions and brought condolences to the families of the dead. "I regret that I could not restrain myself and went to an extreme step, but I had no other way out. I could not endure and further mockery over myself," the letter said.

According to the soldier, he did not hide from the call and later “wanted to connect his life” with the army. “But I did not expect to get into such hell. There was nowhere to run and complain. I myself do not understand at what point I broke,” Shamsutdinov wrote. “Apparently, the instinct of self -preservation worked, only now I begin to realize how much grief I brought to people and broke my life.”

Earlier, Shamsutdinov told his father that “prison orders” reigned in his units, and recruits were subjected to a humiliating rite associated with sexual violence. On that day, the officers promised to "lower" the ordinary. "They said, they warned that they were raped. The lieutenant told me that day that everything, you know, will be all after the guard. All the other young others were already omitted, I know. And this evening, it means that my turn was nowhere to go, what should I do?" - said Ramil. According to him, "this part, this viper, had to be dispersed for a long time."

The father of the soldier Salimzhan Shamsutdinov believes that only grandfather could push him to the crime. "What could have? Grandfather only. This is uncontrolled on the part of the officers. They turned a blind eye to everything that was happening, humiliation, insults. He was patient, so patient, non -conflict, everything was withstanding everything. If he was offended, he was mocking, he did not enter into conflict. So he would have shot him eight people, it is incomprehensible! - explained Salimzhan Shamsutdinov.

The accusation of hazardous relations was brought by a conscript Ruslan Mukhatov. He was convicted of several episodes of bullying the soldiers of the younger draft. So, on Sunday, September 15, 2019, when there were no senior officers in the unit, he forced the soldiers to perform the exercises not provided for by the program - “catch butterflies” (squat and jump on command, clapping his hands) and walk in a goose on the spot (“sea infantry”). “He did not let us relax, I saw how Glory Murkin fell with cramping and cried with pain. Mukhatov made him get up,” Shamsutdinov’s testimony read in court.

Mukhatov that day also in a boxing glove “pierced the moose” to other soldiers (forced them to cross their hands at the level of the forehead and beat). At a meeting on February 20, Mukhatov said that they themselves asked him about beating. “He did not say this before, but now he began to say that his soldiers provoked it. We believe that this is absurd and implausible,” said Shamsutdinov’s lawyer Ruslan Nagiyev.

In September, Mukhatov hit Shamsutdinov in his shoulder and lower leg when he went to smoke at a wrong time. According to the voiced testimony of Shamsutdinov, in the first months he did not touch him in the unit, but closer to Dembel began to behave more aggressively, and "other old -timers supported him." Mukhatov himself admitted that he mocked Shamsutdinov and still seven soldiers.

In March 2020, the court sentenced Mukhatov - two years in prison and a fine of 30 thousand rubles. The court took into account that Mukhatov was first prosecuted, and also took into account the position of victims of condescension. The mitigating circumstance recognized partial confession of guilt with Mukhatov and voluntary compensation for damage: he paid the victims of 500 rubles . The court did not find aggravating circumstances.
