The court extended the arrest of a blogger who made a video about the management of a cemetery
The Balashikha City Court of the Moscow Region has extended for a month the detention of blogger and author of the Mortally Dangerous YouTube channel Andrey Deineko, who is charged under an article on causing harm to health due to filming a video in the administration of the Nikolo-Arkhangelsk cemetery in Balashikha. This was told to OVD-Info by lawyer Anastasia Samorukova, representing the interests of Deineko.
Also on December 24, the Moscow Regional Court dismissed an appeal against the previous decision of the Balashikha Court to arrest Deineko. Lawyer Samorukova clarified that the court excluded from the rationale for extending the arrest the wording that Deineko could allegedly hide.
At a meeting in the Balashikha court on December 25, the investigator petitioned for an extension of the arrest of the blogger and justified this only by the fact that the inquiry did not have time to carry out a number of investigative actions. The court granted the petition, Deineko's arrest was extended until January 29, 2021.
The defense asked to choose a preventive measure not related to arrest. At the meeting, the judge wanted to prohibit asking questions to the interrogating officer, and answered all the questions of the defense counsel: about the reasons for the demand for arrest as a measure of restraint, about the effectiveness of the investigation.
Almost all remaining investigative actions will be carried out at the request of the defense. Lawyer Samorukova said that it is almost impossible to carry out investigative actions in the conditions of a pre-trial detention center, where, due to, among other things, coronavirus restrictions, visits to detainees take place only in a room for short visits - with a dividing glass and tubes for negotiations. Samorukova noted that it would be in the interests of the investigation to change the preventive measure that would allow Deineko to come to the investigator.
- Deineko was detained on December 1 at Domodedovo airport, on December 3 the Balashikha court arrested the blogger. At the moment, Andrei Deineko is in pre-trial detention center No. 1 of the Moscow Region in Noginsk. Initially, he was charged (the documents are at the disposal of OVD-Info) under the article on the intentional infliction of minor bodily harm out of hooligan motives (clause “a” part 2 of article 115 of the Criminal Code), on November 30, the charge was reclassified to a more serious article on intentional infliction harm to health of moderate severity (clause "e" part 2 of article 112 of the Criminal Code).
