The Moscow City Court upheld the decision to fine the doctor following his arrest at Moskalkova’s reception

On December 24, the Moscow City Court upheld the decision of the district court, which imposed a fine on doctor Valentina Shainazarova because of her detention at the reception of the Commissioner for Human Rights Tatyana Moskalkova. She herself told OVD-Info about this.

In September, the Khamovniki Court of Moscow fined Shainazarova 10,000 rubles, finding her guilty under the article on violation of the rules for participation in the action (part 5 of article 20.2 of the Code of Administrative Offenses). Her interests in court were represented by OVD-Info lawyer Yekaterina Selezneva, lawyers Mansur Gilmanov, who collaborates with Apology of Protest, and Nikolai Kuryanovich. “In its decision, the court did not take into account either the financial situation of our client, or the fact that she is a disabled person of the second group, or the fact that she was detained for nothing,” lawyer Selezneva emphasized at the time.

As Valentina Shainazarova notes, at the appeal the judge listed all the arguments in her favor, and then unexpectedly announced that the decision of the first instance on her guilt remains in force. Shainazarova drew attention to the fact that the address of the place of detention was even incorrectly written in the protocol - the address indicated in the document (Ruzeiny Lane, 19 p. 4) does not exist.

The appeal meeting was postponed several times and was held only on the fifth attempt. Having a disability, Valentina Shainazarova experiences great difficulties when she comes to the courts during the morning rush hour, and in winter even in icy conditions. She said that as a result of judicial red tape, her health deteriorated. Lawyer Mansur Gilmanov notified the court that he would not be able to attend the hearing on December 24, but the judge did not postpone it again, Shainazarova was left without a defense lawyer. She plans to continue to appeal the fine in cassation and the Supreme Court.

On the same day, December 24, Valentina Shainazarova received a letter from the police saying that she would be put on a preventive record after an appeal. As Shainazarova said, the police had to respond to her October request for documents, on the basis of which the precinct district Biryulyovo Zapadnoye promised to put her on a professional record before the appeal. But instead, in its response, the Ministry of Internal Affairs indicates that the facts in the appeal were not confirmed, the arguments were found unfounded, and reports that due to the administrative case under part 2 of Article 20.2 of the Code of Administrative Offenses (another article on the organization of an uncoordinated action), after the decision ships Shainazarova will be registered. In this regard, Shainazarova is sure that the police are putting pressure on her.

Shainazarova believes that the administrative case against her was fabricated by the ombudsman's office, since she was detained and a protocol was drawn up precisely after the head of the reception room, Moskalkova, called the police after seeing a single picket.

After her arrest in September and publicity, Tatyana Moskalkova promised Shainazarova to take her case of beating in the hospital under her personal control. At the moment, no progress is observed, the doctor said. Shainazarova has been visiting Moskalkova for almost five years, since April 2016, the Ombudsman’s office endlessly studies materials, finds violations, writes conclusions, sends them to the Main Investigative Committee of the Moscow Investigative Committee and the Prosecutor General’s Office, but receives replies.

Valentina Shainazarova was personally at the reception at the Prosecutor General's Office and explained that not a single examination of the case was carried out with her participation, but the representative of the department ultimately refused her demands. Shainazarova was told that she allegedly refused the examination herself. The doctor emphasizes that this is not so.

The information about the planned entry of representatives of the Office of the Commissioner for Human Rights into the appeal against Shainazarova's case at the cassation stage has been removed as untrue.

• Valentina Shainazarova and Zinaida Kirillova were detained at Moskalkova's reception on 1 September. The women tried to make an appointment with authorized Tatyana Moskalkova, but they had a conflict with an employee of the institution. At the entrance, one of the women, Zinaida Kirillova, stood in a single picket, Shainazarova was nearby. Suddenly, the policemen came up, detained them and took them to the Khamovniki police station.
• Surgeon Valentina Shainazarova told OVD-Info that in 2016 she was beaten by former colleagues and policemen. After that, her hand stopped functioning. Since then, she has been trying to achieve justice in various instances, including in the office of the Commissioner for Human Rights.
