The court in Saratov on December 25 sentenced to five years in the colony in the case of drugs of a local resident Alexander Studitov. False Dmitry

In June 2019, an ordinary case was opened in Saratov under the “drug” article: a local resident acquired about one and a half grams of prohibited substances for a thousand rubles. He used part of the “bookmark”, and kept the rest with him. When the drug police entered the man, he introduced himself to Dmitry Rubinstein, and during the investigation he submitted documents to this name. Law enforcement officers did not additionally check the identity of the detainee. Outwardly, the brunette from a photograph in the passport was quite like a dark -haired suspect.

The criminal case was instituted under Part 2 of Art. 228 of the Criminal Code. The court took place in August of the same year. A man who introduced himself to Rubinstein was sentenced to four years conditionally.

The sentences of drugs in Russia are familiar, but in this case the court sentenced a person who did not even know about the initiation of the case. Dmitry Rubinstein is the name of the man’s half -brother, who came across a police officer. In fact, his name is Alexander Students, he is 26 years old and he was convicted twice by the time the crime was committed. Rubinstein is an orphan, which was adopted by the student of the student in childhood.

Arrest

Dmitry Rubinstein himself was all this time to work in Moscow. Perhaps he did not find out about the criminal case if the false Rubinstein did not forget to celebrate the police, as it should be in a conditional term.

In March 2020, law enforcement officers called Dmitry Daniele's wife and said that her husband was on a federal investigation wanted by criminal case.

Rubinstein returned to Saratov, the second court changed the conditional term for three years of imprisonment, and the perplexed man was sent to a maximum security colony. Alexander of students all this time was free.

Six months in prison

Rubinstein managed to achieve justice only six months later, all this time he was on false accusations in places of imprisonment. He recalled that in the summer of 2019 his reception (and dear to Studitov) mother Tatyana Ilyasova promised to help with receiving an apartment that the state should give out orphans. For this I asked for his documents. The date of communication with Ilyasova coincided with the date of initiation of the case, from which Dmitry concluded that it was the consolidated brother that led him for a period. However, Rubinstein’s appeals to the Investigative Committee and other bodies did not give a result.

Everything changed in the summer when the lawyer of the convicted person Anatoly Torkunov, along with Daniela, recorded a video message in the name of the Prosecutor General. The story received a great resonance and reached the State Duma deputies, as well as to the chairman of the Investigative Committee Alexander Bastrykin.

In August, Rubinstein's proceedings were resumed, the court released him from custody and he left the Saratov colony of strict regime No. 33. At the entrance of the guy, several television channels, wife and friends were met. Interestingly, there was no paced brother and adoptive mother among them. According to Dmitry, quoted by the Enf-Info agency, he does not communicate with Alexander and does not plan to communicate, because he "does not do what he needs."

True, already in September, students themselves told reporters that he was unsuccessfully trying to change Dmitry’s sentence.

“My petition (so in the original -“ MBH Media ”) that I was guilty, was written 15 days after Dmitry Rubinstein was“ closed ”. The document was sent by registered letter to the Investigative Committee of the Leninsky district of Saratov. Why did the letter go for so long - I don’t know, ”he told the Saratov 24 television channel.

Cancellation and new verdict

On September 15, Rubinstein's sentence was canceled, and the case was returned to the prosecutor's office. The students now ended up in the bench. The case against him was considered under the articles “illegal acquisition and storage of drugs on a large scale” and “attempt on illegal acquisition without the purpose of sales of narcotic drugs in a significant amount” (part 1 and part 2 of article 228 of the Criminal Code of the Russian Federation). Judging by the case file, in addition to purchasing in June 2019, he once again acquired drugs after Rubinstein released to freedom, at the end of September of the outgoing year.

On December 25, the court sentenced the student to five years in a general regime colony.

After the intervention of Bastrykin, cases were also instituted under the articles “Falsification of evidence in the criminal case of a serious crime” and “Returning a deliberately innocent person to criminal liability” (part 3 of article 303 and part 2 of article 299 of the Criminal Code of the Russian Federation). The head of the investigation committee instructed to verify the actions of the police and bailiffs who did not “break through” the identity of the student. Now the investigation will find out if they did it by carelessness, consciously or for other reasons.
