The court extended the preventive measure for those involved in the “federal booth” case
Judge of the Tverskoy District Court of Moscow Olga Zatomskaya extended until February 8, 2021 the ban on certain actions for supporters of the “indefinite protest” Olga Misik, Ivan Vorobyevsky and Igor Basharimov, accused under the article on vandalism (part 2 of article 214 of the Criminal Code). The interests of the defendants in the case are defended by lawyers from OVD-Info Elena Sheremetyeva, Dmitry Zakhvatov and Sergey Telnov.
Lawyer Telnov emphasized that the prosecution used all the same arguments as in previous meetings as a measure of restraint. As in early December, the prosecutor said that it was impossible to soften the measure of restraint for the defendants, since they “may hide, threaten witnesses in the case, or otherwise interfere with the investigation.”
Lawyer Zakhvatov pointed out contradictions in the position of the prosecution. He believes that the measure of restraint is already impracticable due to the fact that it does not prevent the defendants from "hide right now." Also, the accused cannot threaten witnesses, since all witnesses in the case are law enforcement officers and, moreover, have the right to carry weapons.
Zakhvatov stressed that the inquiry "artificially delays" the investigation: according to the prosecution, the fact of the crime and involvement in this act has already been stopped, which means it's time to take the case to court.
On December 14, the Tverskoy District Court fined a participant in the picket in support of the defendants in the “booth of federal importance” case for 150,000 rubles. The picketers were represented by OVD-Info lawyer Ekaterina Selezneva.
