The court rejected the appeal to extend the arrest of those involved in the second Simferopol case of Hizb ut-Tahrir
On January 14, the Third Court of Appeal, located in Sochi, dismissed the complaint for the extension of the preventive measure against the defendants in the second Simferopol case of Hizb ut-Tahrir, who are accused under articles on organizing or participating in the activities of a terrorist organization. On appeal, the court decided to keep Dzhemily Gafarov, Remzi Bekirova, Enver Ametov, Alim Karimova and Tofik Abdulgazieva in the pre-trial detention center.
“The court worked like a conveyor belt, allocating half an hour for the process, not allowing them to express their position. Everything was expected,” commented one of the lawyers who participated in the meeting via video link. The defendants told the court that they did not commit any terrorist crimes. Jemil Gafarov's defense pointed to his advanced age, disability of the second group and deteriorating state of health.
However, the court did not agree with the arguments of the lawyers and extended the detention of the Crimean Tatars.
Remzi Bekirov is considered by the investigation to be the leader of the cell, he is accused under the article on organization in the activities of a terrorist organization (part 1 of article 205.5 of the Criminal Code). The rest are charged with participation in the activities of a terrorist organization (part 2 of article 205.5 of the Criminal Code). All five are also accused of preparing for a violent seizure of power (Article 278 of the Criminal Code with the application of Part 1 of Article 30 of the Criminal Code). Together with other defendants in the second Simferopol case of Hizb ut-Tahrir, they will be tried in different groups of five people .
- In the second Simferopol case of Hizb ut-Tahrir, 29 Crimean Tatars are being tried, 25 of them are in a pre-trial detention center, four are wanted. The case was opened after mass searches on March 27, 2019. The defendants are accused under articles on organizing or participating in the activities of a terrorist organization (parts 1 and 2 of article 205.5 of the Criminal Code, respectively) and preparations for a violent seizure of power (article 278 of the Criminal Code with the application of part 1 of article 30 of the Criminal Code).
- In the first Simferopol case of Hizb ut-Tahrir, on June 18, 2019, the North Caucasian Military Court in Rostov-on-Don sentenced five defendants to imprisonment for terms of 12 to 17 years in a strict regime colony; on appeal, were reduced the terms of all five by six months .
