The wires stretch on the low ceiling and the ragged walls, the floorboards bend under the feet, the only window looks at the wall of the neighboring house. Space in 65 square meters. meters are divided into a children's and parent bedrooms using home -made partitions, including from hangers with clothes. “There was a kitchen here, but she burned out,” explains Elvira, his wife Rustam. -A year ago, in the winter we had a fire, probably due to the dilapidated wiring. At this time, there were husband and children.
Rustam extinguished the fire with his bare hands, burned, fell into intensive care.
Our favorite cat died. At this time, I drove the younger ones to training and returned to the ashes. It is impossible to convey my despair: winter, cold, husband in the hospital, we and children on the street. "
While Rustam was lying in the hospital, and Elvira and her children lived with friends, lawyers of the district administration prepared a claim for eviction. The lawsuit began in February 2020 and stretches to this day.

Rustam by education builder, veteran of the Second Chechen War, Elvira-designer-model. In the early 2000s, the young family rented an apartment in Vsevolozhsk. But after the birth of his daughter and son, the apartment question stood up.
“On TV, we heard the call of Governor Valentina Matvienko that the city needs wipers, it was especially emphasized that everyone would be provided with official housing,” the couple said. - We phoned several areas. In the housing office No. 1 of the Central District, we were delighted: "Finally, we will have wipers with sane persons." In 2004, Rustam was hired, promising to allocate an office apartment "in the near future." In the meantime, they offered temporary housing. It was assumed that on a large stable we would live on the strength of a month for two months, no one could think that we would stay here for many years. The apartment was practically destroyed, flooded with boiling water, without window frames. Rustam took all the dirt, trash from it, inserted glass into the windows, and we drove - my daughter went to first grade, the son was still a baby. ”
Elvira, like her husband, went to the wipers, receiving a plot in which there was a courtyard of their new house. Rustam worked nearby - "in the Hermitage." He cleared the snow at night near the Alexandrian pillar, pricked ice on the palace embankment.

After 15 years of continuous work experience, the family was supposed to receive a housing for social hiring. But the reform of the housing and communal services broke out, the municipal residents of the company became joint -stock companies, and the apartment promised to the janitors turned into a mirage. Then many quit, they were replaced by unpretentious migrant workers. Rustam's family was nowhere to go, they continued to live in a temporary dwelling on a large stable, trying to solve the apartment issue.
Spouses go to receptions to St. Petersburg officials since 2006: they are asking either to provide them with the promised official apartment, or to legalize the one that is: the room on the large stable was considered non -residential, that is, unusable for living. Over the years, the janitors recognized all the leaders of the housing committee and the administration of the Central District.
Some promised to help, others directly stated: "Children in the orphanage, themselves outside!"
“They went to Moscow several times to the president’s reception,” says Elvira. “But all our appeals went down to the administration of the Central District, and the head of the district did not want to meet with us - it is inappropriate, he says.”
The only thing Rustam and Elvira achieved is the translation of an apartment from non -residential status to residential. 20 meters were recognized as suitable for housing with that only window. But they still did not give the apartment, issuing the ownership of the Central District.

A series of claims
All these years, the family of Rustam Shagimardanov did not have St. Petersburg registration. The registration address is still Vsevolozhsky, in the apartment of a relative. Regional registration with actual residence in the city created a vicious circle. The family does not have St. Petersburg benefits that are relying largely, on travel in public transport, to pay for circles and school dinners. Regional benefits-service in the clinic and 50 percent payment of utilities-burn out, as they are distributed only at the place of registration in Vsevolozhsk.
Now, officials are sent there for a large family. They are trying to prove in court that Rustam and Elvira and children allegedly live in Vsevolozhsk and every day go to work in St. Petersburg by six in the morning.

Although, in fact, Rustam and his family have been living in St. Petersburg for more than 15 years and, given the qualification of sedimentary, have the right to register as in need of housing. Children go to St. Petersburg schools, attend circles, the family lives in the city, which has a lot of evidence. But the court refused their request only because there is registration in Vsevolozhsk. Logic is as follows: once there is a residence permit - it means that you live there. The arguments that the apartment in the Leningrad region does not belong to them, the owner can at any time sell it and the family will have to look for a new place of registration is not heard in court. The actual accommodation in St. Petersburg did not become an argument for the court. Formalism defeated.
“Officials talk to us in court dismissively, it seems that they are frankly mocking,” says Elvira. “We brought to the court of our neighbors, who confirmed that we have been living on a large stable for many years.”

But the court decided that Elvira and Rustam did not provide sufficient evidence that they have been living in St. Petersburg for 15 years. And in the Leningrad region they were refused to provide even a maneuvering fund, again referring to a residence permit in a foreign apartment in Vsevolozhsk.
The Housing Agency of the Central District, among other things, filed a lawsuit against the recovery from Rustam and Elvira for management, maintenance and maintenance of the common property of the apartment building in which the disputed apartment is located, this also included heating and interest for 16 years.
Officials considered that the family "unreasonably enriched" during the time of residence in the center of St. Petersburg.
“It came out under a million rubles. Counted from 2004 to today, the spouses say. “The fact that we asked all the years everywhere, up to the district police officer, to issue a rent, but we were denied everywhere, saying that there are no legal grounds on this, no one is about exciting anyone now.”
A separate lawsuit, another half a million, the administration of the Central District filed for compensation for damage, which the city suffered as a result of a fire.
“Full absurd,” Rustam is indignant. - We made repairs in the apartment for our money - we carried out wiring, inserted windows, paid the debt of the electricity administration, concluding an agreement with Petroelectrosbyt in its name. It turns out that now we must pay our own repairs to the administration. ”

We came to the janitors and remain them
The Administration of the Central District of Novye said that there were no legal grounds for living in the apartment in the Bolshaya Konyushennoye by the Shagimardanovs, referring to the decision of the Dzerzhinsky District Court, which in the summer of 2020 satisfied the claim for eviction, considering that since the family of wipers has neither a warrant, nor a social rental agreement, nor registration, then the right to occupy the living space either. Lawyers helping the family appealed this court decision in the city court. The appeal will be considered in February.
In 2010, after the communal reform, the spouses were forced to quit the housing office, but continued to work as janitors: Elvira, as it is expressed, “in science” - in the House of Scientists named after Gorky, Rustam serves the territory of the Hermitage.
“We came to this city by janitors and remain them,” they say. - We go out for cleaning at any call - both at night and on holidays. Therefore, it is surprising that this attitude towards us. It's a shame that we are completely reproached, as if we had committed some kind of crime. And our fault is just that we once believed Matvienko, who promised the janitors, and came to Petersburg. ”
