
The trial of the coordinator of the Krasnodar "headquarters of Navalny" Anastasia Pandacia Panda began at about 12:30. Judge Roman Zhmetkin found the activist guilty of an administrative offense and sentenced her to 10 days of arrest. This was reported to the "Protocol" by lawyer Alexander Valyavsky.
At the very beginning of the meeting, the lawyer Anastasia Panchenko drew the attention of the court that there was no inventory in the case and the sheets of the case were not numbered: “This generally excludes the opportunity to somehow refer to evidence in the study. And the second: the defender’s petition has not been considered. The lawyer said that in this category [case], an administrative investigation is carried out. This petition was obliged to consider. ”
Alexander Valyavsky also asked to attract the prosecutor to the case: “In this case there is no prosecution and in fact you are the prosecutor. I believe that the principle of equality of parties, justice is violated. You cannot be the prosecutor in this case and we do not understand who to compete with. Therefore, we ask to attract the prosecutor in the case of him to explain to us what the charge is expressed in this case. ”
Judge Roman Zhmetkin rejected the petition for the participation in the prosecutor’s case, since in the case of an administrative offense this is not necessary.
Alexander Valyavsky also said: “Dear court, I draw your attention that my client did not commit any offenses. The materials presented to the court have information that she allegedly posted information about the procession. Placing information is not an element of the organization. No information that she somehow prepared this public event, or participated in his organization. The court is not represented. The placement of information about the rally does not form an administrative offense. If you go to social networks now, they are simply overflowing with information. If by analogy, apply to each citizen who posted information that this is planned on January 23 this peaceful procession, then in the Russian Federation, probably, half the country will be brought to administrative responsibility. ”
The court retired to the deliberation room to make a decision. Returning, the judge Roman Zhmetkin read out the decision: 10 days of administrative arrest.
