The Ministry of Justice and the Central Bank are developing a bill to prohibit the transfer of funds under writs of execution directly to accounts abroad, a participant in the discussion told RBC and was confirmed by a representative of the Ministry of Justice. To receive compensation under this document, even foreign citizens and companies will need an account in a Russian bank.

The Central Bank confirmed that “comprehensive changes to legislation” are being worked out to combat dubious transactions through writs of execution, but did not comment on the restriction of transfers abroad. These amendments will help minimize transfers in favor of “unscrupulous collectors” for money laundering and tax evasion, a representative of the Ministry of Justice said.

The Ministry of Justice and the Central Bank were already developing a bill on this topic in 2019. But then the government did not consider the document; comments were made on it. Now we have returned to this issue.

The legalization of dubious income through writs of execution became widely known in 2017 after the disclosure of the “Moldavian scheme”, when foreign companies issued fictitious loans to Russians and went to court to collect debts. In 2020, schemes with executive documents became more popular, the Central Bank reported.

According to experts, limiting transfers based on writs of execution may have a negative impact on the business processes of Russian companies. The initiative is not supported by Delovaya Rossiya, since, according to the organization, bona fide debt collectors will suffer from it. “Opora Rossii” also believes that the measure carries rather risks for business.
