The trial of Navalny in the case of “slander in the veteran” was absurd even by Russian standards. Reporting Christina Safonova from a very strange meeting

On February 5, the second trial of Alexei Navalny went to the Grandmother's District Court of Moscow. This time - in the case of slander on a participant in the Great Patriotic War Ignat Artemenko, who in 2020 appeared in the agitation video RT in support of the amendments to the Constitution. "They did not find another prosecutor?" - The indignant voice of Alexei Navalny comes from the glass cage. This week he is judged for a second time, and in both cases the prosecution is represented by Lieutenant Colonel Ekaterina Frolova.

Frolova - tall, with black hair gathered in a bundle and a breast voice - in response to the indignation of the politician replies that he has the right to declare her a discharge. But Navalny no longer reacts to it and is already addressing the hall, where about 30 journalists are sitting (about 50 more press officers and at least two representatives of foreign embassies are observing the video broadcasting process from two other halls):

In anticipation of his defenders - Vadim Kobzev and Olga Mikhailova - Navalny looks at the screen installed in the hall. The camera shakes, and a woman with a fluffy shock of blond hair in a pink suit appears on the screen.

Next to her is a very elderly man in a blue military uniform. All breasts are hung with rewards. This is the victim-94-year-old Ignat Sergeevich Artemenko. Due to the poor state of health in the trial, he is involved in video communications. Behind the veteran a small room, forced by old brown cabinets. Ignat Sergeyevich silently looks into the camera, a few minutes later a woman puts a white medical mask on him in a pink.

“Your honor, maybe you will stop mocking the elderly.” He will not live to the end of the process, ”says Navalny and asks the judge to allow the veteran to remove the mask.

“Nobody canceled sanitary rules,” the judge Vera Akimova objects to him. This is a large woman with long black hair collected in the tail.

Finally, Navalny’s lawyers appear in the hall: Kobzev is the first to come, a little later - Mikhailov. Judge Akimova announces the meeting open and asks Navalny to introduce herself. Before considering the petition, the judge points to the screen, where the image is still displayed from the veteran’s apartment.

“We have a victim of Ignatenko in the video,” says the judge.

“He is not Ignatenko,” Coobzev corrects the lawyer.

- And what's the difference! - caustically exclaims Navalny.

Disrupting him, the judge explains to the victim of his rights and asks whether they are understandable. Sounds of interference are heard, some kind of seething and crackling through which it is difficult to make out: "Yes, understandable."

Navalny claims a “petition and protest”.

“I am really disgusting and unbearable,” he begins. - This man [Ignat Artemenko] is in very poor condition. And you use it for several months like a doll. I am stinging to be allowed to lie down and remove the mask. You are mocking a 95-year-old man! ”

The judge objects that Artemenko has relatives who can take care of him. “His relatives trade them to get some money! - Emotionally objects Navalny. “If after a while he grabs the heart, you will be to blame.” The veteran himself is silent and remains in the mask.

Meanwhile, the judge allows Navalny and his defenders to talk and declares a break. However, the judge believes to communicate, they should in the presence of police officers and bailiffs - in a small hall there are at least ten of them. The judge proposes to correspond to the objections of lawyers and Navalny that they have the right to confidentiality.

Judge Akimova doubts that there is such an opportunity and asks about it, looking somewhere to the side-there are a bailiff and a spokeswoman, and there is also an open door to the deliberation room. When Navalny asks him to explain what was happening to him, Kobzev seriously replies: “Alex, the court asked someone, it is possible or impossible. Not the judge is the most important here. There is someone more important, and now the judge is waiting for an answer. ”

"Protect Putin and his friends with medals"

On June 2, 2020, Navalny, “having intent to the public distribution of knowingly false information” published a RT channel in his telegram channel and twitter in support of the corrections to the Constitution, the prosecutor reads the accusations.

The video was shot by actor Ivan Okhlobystin, astronaut Oleg Kononenko, designer Artemy Lebedev (after publishing the video, he called not to participate in the amendments) and other famous Russians. Each of them read out on a camera on a phrase from the preamble of the Russian Constitution, after which the orders of a minute video announced: "We accept the Constitution of the Russian Federation." Among others, Ignat Artemenko also starred in the video.

Under the video, Frolov continues, Navalny published the following text: “Oh, here they are, darling. I must admit that while the team of corrupt Kholuyes looks weak. Look at them: this is a shame on the country. People without conscience. Traitors. "

“Navalny knew that Artemenko would defeat the honor and dignity, undermines his reputation,” the prosecutor insists. The veteran himself at this time, without blinking, looks into the camera, however, from another room. Now behind him is a portrait of a man and a woman.

When the prosecutor Frolov finishes, Navalny says that he is not clear to him. The state prosecutor, the politician notes, said that he slandered Artemenko intentionally, but they were not even familiar.

Ignat Sergeyevich continues to look silently at the camera. Judge Akimova interrupts the policy and repeats several times that he is accused of "the spread of knowingly false information." The next is the lawyer Kobzev. In a long speech, the defender explains that, according to the law, for accusation of slander, it is necessary that the perpetrator knows in advance that he is lying. However, in the commentary of Navalny, his defenders were convinced, there were only “evaluative judgments”.

“Specific words or phrases that, according to the accusation, defeat the honor and dignity of Artemenko in the decision and indictment, are not indicated,” Kobzev continues. And he notes that because of this it is not clear what accusations the defense should be refuted.

“The accusation is that he called the faces [starring in the video] pigeons? What does he consider the team to be weak, but is it really very strong? Or is it not a team at all? The accusation is that he called the faces of Kholui or sales holuis? Shame, people without conscience or traitors? " - suggests Kobzev.

According to lawyers, the next criminal case against Navalny appeared, “to stop his anti -corruption investigations” - and not allow to participate in the elections. According to the “political background”, according to the defense, it also says that it was excited after checking, which lasted only a few hours.

In conclusion, Kobzev calls the accusation “unreasonable”, “unmotivated”, “arbitrary”, “unclear”, “unclear”, “politically motivated”, “contradicting the norms of the current legislation” and, finally, simply “illegal”.

After hearing the opinion of the defense, the judge Akimova again offers to speak out to the prosecutor Frolova. "And my attitude to the charges?" - Navalny is perplexed. After a short dispute, the judge gives the word policy.

“I understand well why this case arose, why it was fabricated,” says Navalny. “The whole thing was invented by PR managers, journalists, Russia Today, [Margarita] Simonyan.”

And he notes that the authorities “experience big problems” when cases against him are considered in court, because “everyone knows that the investigators are fabricated, the prosecutors are unscrupulous, and the courts are corrupt.”

“Therefore, it took some more cunning thing,” continues the thought of Navalny. -It is necessary that in the courtroom I have opposed not prosecutors or investigators, but something more saint. The idea arose: "Let's find a veteran, put the medals on it." And there was an unscrupulous campaign that promoted amendments. And the goal was one - so that Putin remained for life. There were many nasty things, one of them is this video. There are many who starred in it: designer Artemy Lebedev, actor Ivan Okhlobystin ... "

“Alexey Anatolyevich, enough,” the judge abruptly interrupts.

- No, not enough! This is my attitude to the charges.

In response, Akimova assures that the attitude of Navalny is already clear. But he continues: “You understand why, saying about this video, that Kholuis and traitors starred in it, I do not see either Lebedev or Okhlobystin here. Because it would be inconvenient for you to say that I slandered them. Because Artemenko has medals, Lebedev has green hair, and I don’t know Okhlobystin, a bag of cocaine. ”

“You have completely perverted criminal law,” Navalny emotionally appeals to the judge and the prosecutor. - You are lying that I slandered Artemenko. And now you use it to protect him with medals of Putin and his friends-thieves! ”

"I am not a shame on the country, but its defender"

When the prosecutor offers to go to the interrogation of Artemenko himself, Navalny remarks: the veteran, apparently, does not realize what is happening in court - and what and how to say to him tells the woman sitting next to him in pink.

Lawyers are also concerned: they do not know who organized the broadcast, where exactly the veteran is and who is with him. From the beginning of the meeting on the screen, in addition to a veteran and a woman in pink, the male hand with a black fitness tracker flickered at first, and then the hand of another woman.

Judge Akimova repeats several times that Artemenko is participating in a meeting on the video in connection with his advanced age and health. But realizing that such an answer is not enough, he asks the veteran who is next to him.

Artemenko is still silent-a woman in pink speaks for him, but because of a bad connection, none of the sitting in the hall can make out her words. With the exception of the judge. “This is a daughter,” she explains. Lawyers pay attention to the fact that no one else heard this.

“Why do I hear then?,” The judge is perplexed.

“You don’t hear, you invent,” says Navalny. Akimova makes him a remark.

In addition to the daughter, there is at least another woman next to the veteran, says Navalny, explaining that she had heard her voice. “I would like to understand who is sitting there,” he continues. - Is this an investigator? Is this Margarita Simonyan eats beaver ? "

Lawyers insist that everyone who is in a room with a veteran show them. The judge explains that the voice belongs to another justice of the peace, who came to the apartment in order to identify Artemenko and clarify his rights. And to the requests to show her, he answers: "There is a secret to the image of a judge."

However, soon a woman in a striped jacket appears in the frame. She says something, but even scraps of words are not heard in the hall-only wheezing. Lawyers are asking to establish a connection or "stop this disgrace." The judge agrees and declares a five -minute break. But after him, the connection does not become better - though wheezing replaces continuous clanging and creaks. And next to the veteran, Artemenko is already sitting another woman - in black.

“There was a pink woman, there was a striped woman, now black,” says Navalny. The woman seems that because of the interference, her surname is not heard, but it is clear that the judge is she.

At the request of the court, Artemenko finally begins the story of what he knows about the case. Slowly and quietly, Ignat Sergeyevich explains that during the war he participated in the partisan movement, was injured in forcing the Oder River, fought on the Belarusian front and served in the army for 39 years.

In June 2020, the veteran found out that Navalny called him a traitor. “It very upset me very much. I have to defend my honor, ”he says with pauses. And after a protracted silence, he adds: “I used to give detailed testimonies. Now I feel bad and ask you to stop interrogation. ”

“Why are you kidding him?” - Navalny says loudly.

“I want Navalny to publicly apologize before me and the memory of actor Lanovoy ,” the veteran suddenly says.

The prosecutor asks to allow her to voice the testimony that Artemenko gave earlier. But Navalny’s lawyers object - there are no grounds for this. In addition, the defense is sure that the veteran did not prepare his speech for the court himself.

Navalny agrees: “He was given a piece of paper before our eyes so that he would read these three phrases, including“ I want to stop interrogation. ” You will burn in hell for taking the 95-year-old grandfather, put medals on him and use it! He does not understand a single question! "

Artemenko, as before, silently looks into the camera. Judge Akimova satisfies the request of the prosecutor, and leaves the request of the defense.

Most of Artemenko during the investigation was devoted to his participation in the war. “I have many awards, I can’t list everything at once, a whole box,” the prosecutor Frolov quotes him.

And he goes to the story of how the veteran found out that he was slandered. According to the testimony, Artemenko decided to star in the RT video from “patriotic goals” - and he did not receive any money for this.

The veteran recognized the fact that Navalny “throughout the country” called him “a traitor and a holu” from the neighbors when he was in the country.

“I was very offended. I did not understand why Navalny did so, because he did not even know me, ”the prosecutor quoted Artemenko. - I was worried for a long time and in the afternoon of June 9, my well -being worsened. I felt bad because of experiences about how the people now think about me after the critical statements of Navalny. I would like him to apologize before me. I am not a shame on the country, but its defender! I do not get a hawk! I have never passed anyone! I am not a person without conscience! "

Frolova followed to the additional protocol of interrogation. She again reads the memories of the veteran about the war (as “the Nazis arrived in the village on horseback”), when Artemenko suddenly tries to say something. The judge sitting next to him explains that the veteran became ill. Through a bad connection, the word skipped: "ambulance."

- From the very beginning, I said that it will be so! Because you are kidding him! - Emotionally reacts Navalny.

"Do not offend older people anymore"

The meeting resumes only after an hour. A loud clang of the side door, Navalny is made in a glass cage. He looks at the screen with misunderstanding. There, instead of Ignat Artemenko, is an elderly woman and a completely different room: a carpet on the wall and a closet on which a toy pig sits with a hanging legs.

- Write in the protocol! - commands Navalny. - I tell you that relatives will be strangled by the grandfather with a pillow, then to say that I brought him. They will kill him!

“I also want to note,” the prosecutor is caught. - Artemenko brought Navalny.

The politician begins to shout: “You dragged him here like a mannequin! Did you need to put on someone? So they would put on her, ”he says evilly, pointing to the prosecutor.

“This is not a tunic, but a military uniform,” the judge corrects. The prosecutor once again asks to make a remark policy.

Finally, the participants in the proceedings again pay attention to the screen. Suddenly an elderly woman who appeared there, according to the judge, is a veteran neighbor, Galina Andreevna Morgulis. Like Artemenko, she was born in 1926, and therefore participates in a meeting on the video. Next to her is also another woman - this is a justice of the world, the judge Akimova explains.

The connection is still bad, but Galina Morgulis manages to tell that she has been familiar with Artemenko since 1972. The veteran, according to her, is a “good man” and “shed” him. Morgulis heard about this on TV.

-Once Ignat Sergeyevich came against honor? - asks the prosecutor.

- Oh, what are you talking about! This could not be! - the witness answers.

-He once betrayed his country? - continues the prosecutor.

“I can’t even answer it,” Morgulis says in bewilderment.

- Have you heard that Ignat Sergeyevich starred in a patriotic video?

“Well, I heard that in this video they sang it,” answers Galina Andreevna. In the hall there are shirts.

Свидетель Моргулис соглашается.

Следующим вопросы задает Навальный. Его интересует мнение Галины Андреевны, что сделали бы белорусские партизаны (такие же как сам Артеменко) с теми, кто «украл их пенсию». Но ответить не дает прокурор — она просит снять вопрос как не относящийся к делу. По просьбе прокурора суд снимает и другие вопросы политика: «Хорошо ли, богато живут пенсионеры?», «Считаете ли вы предателями тех, кто поднял пенсионный возраст в нашей стране?», «Живет ли хорошей, богатой жизнью Игнат Сергеевич?» и какая у него пенсия. Защита каждый раз протестует, но это ни к чему не приводит.

Когда Навальный замечает, что ему не дают задать ни один вопрос, судья Акимова поясняет, что все они «не по существу».

— Все, что говорит прокурор — по существу. А все, что я — не по существу! — заявляет политик.

— Вы здесь обвиняемый, — напоминает судья.

Навальный в очередной раз говорит об «издевательстве над пожилыми людьми» и спрашивает судью, о чем может рассказать свидетель, узнавший о деле «из телевизора».

«Так вас и обвиняют в распространении клеветы в сети интернет», — серьезно отвечает судья Акимова. Навальный с улыбкой обращается уже свидетелю:

— Галина Андреевна, вы пользуетесь сетью интернет?

Еще один свидетель обвинения — Владимир Акимов из Пензенской области. Акимову 27 лет, хотя выглядит он значительно старше: среднего роста, с короткими русыми волосами, в синем свитере и такого же цвета джинсах.

Акимов рассказывает, что в начале прошлого июня в одной из «политических групп» во «Вконтакте» наткнулся на слова Навального о людях, снявшихся в ролике в поддержку поправок в Конституцию. Слова политика он расценил как клевету. Особенно его задело, что Навальный так высказался в адрес ветерана. «Игнатенко Артема… Артеменко Игната Сергеевича», — поправляется Акимов. И уточняет, что, по его мнению, этот человек «никак не может быть предателем».

Возмущение Акимова было таким сильным, что он обратился в правоохранительные органы (однако куда именно — в МВД или СК — и когда свидетель вспомнить не смог). «Это моя гражданская позиция. Для меня, как и для граждан моей страны, люди, которые освободили мою родину, являются святыми», — вдохновенно произносит свидетель.

— А за Артемия Лебедева вам не было обидно? - Navalny is interested.

— Мне за всех обидно, — отвечает Акимов. И добавляет, что не пожаловался и по поводу остальных участников ролика, так как «это люди состоятельные и здоровые»: «Если надо, они сами постоят за свою честь».

Тогда политик спрашивает, писал ли он отдельно про ветерана Артеменко или про «неопределенную группу лиц». «Вы писали про всех», — настаивает Акимов.

— Вы слышали такую фразу: «Единая Россия — партия жуликов и воров»? — не сдается Навальный. И получив утвердительный ответ, спрашивает свидетеля: «Считаете ли вы, что это клевета в отношении каждого члена партии?»

«Можете меня удалить. Я ничего не понимаю»

В зале на экране снова незнакомый человек. На этот раз женщина, чей возраст установить сложно: волосы ее скрыты платком, а половина лица — медицинской маской. Ее зовут Зинат Темурова, она сиделка ветерана и очередной свидетель обвинения.

Адвокат Михайлова замечает, что Темурова «явно не 1926 года рождения» и возражает против ее допроса по видеосвязи. Возражение оправдано: помехи в трансляции усилились, и разобрать хотя бы одно слово свидетеля невозможно.

Но прокурор не согласна. По ее словам, та не может покинуть ветерана — хотя после вызова скорой о его самочувствии участники заседания не вспоминали. Навальный называет это «чушью», но судья Акимова его обрывает: «Все достаточно, переходим к рассказу». «А можно уточнить?» — вмешивается адвокат Михайлова. «Нет, вы уточнять уже ничего не можете», — строго говорит судья.

Темурова начинает рассказ, но ее по-прежнему не слышно. На этот раз — даже судье и прокурору. Зато в кадр попадает мужская рука. «Секретарь, мне интересно, вы понимаете, что она говорит? Отвечая на вопросы Навального, свидетель рассказывает, что по ссылке, которую ей прислал внук ветерана Колесников, было не только видео, но и подпись: «Алексей Анатольевич Навальный оклеветал ветерана войны». Однако объяснить, что это за сайт, Темурова не может. Колесников же, добавила свидетель, написал заявление на Навального.

При этом следователя она видела дважды: в первый раз, когда он пришел домой к Артеменко, чтобы допросить его; второй — когда допрашивали уже ее. Происходило это, по словам Темуровой, в школе.

Прокурор снова просит снять вопрос, и судья Акимова снова соглашается это сделать. Против таких действий протестует уже адвокат Михайлова. Навальный кричит: «Я настаиваю, что свидетеля не допрашивали. И все это выдумка. Потому что людей в школе не допрашивают!»

В это же время адвокат Михайлова просит зачитать материалы дела, в которых содержится информация о личности свидетеля. Судья продолжает настаивать, что она уже была установлена.

Прокурор возражает, суд ходатайство не удовлетворяет, и Михайлова предпринимает еще одну попытку разобраться в происходящем — она спрашивает у Темуровой, когда и кем ей выдан паспорт. Но прокурор просит о снятии и этого вопроса, обвиняя защиту в затягивании процесса. Судья ожидаемо соглашается. Допрос Темуровой резко заканчивается.

«Я хочу обратить внимание, что мы так быстро выключили свидетеля, потому что очевидно, что она врет», — комментирует Навальный.

И обращается к Акимовой: «А вы на самом деле судья? Потому что вы не имеете ни малейшего представления о процессе».

«Вы — торговец дедом»

- Good afternoon! Меня зовут Колесников Игорь, — обращается к собравшимся в зале высокий широкоплечий мужчина. На нем, как и на другом свидетеле обвинения, пришедшем в суд, — синий свитер и джинсы.

— Вы — торговец дедом! — почти кричит ему Навальный.

— Алексей, постарайтесь оставаться человеком, — также громко отвечает ему Колесников.

Навальный в свою очередь говорит, что проблема ветерана Артеменко в том, что он «воспитал внука-проститута». Оба начинают кричать.

Прокурор Фролова просит сделать Навальному замечание. Адвокат Михайлова просит суд о том же, но в отношении прокурора. Крики усиливаются.

Когда все успокаиваются, Игорь Колесников рассказывает, что его дед снялся в ролике RT по приглашению канала, а денег ни он, ни его родственник за это не получили — только брендированные подарки. Вскоре после публикации видео Колесникову позвонили журналисты и рассказали, что его деда оскорбляют. «Поначалу мы старались от этой информации оградить Игната Сергеевича», — сообщает Колесников. Но ветеран все же узнал о клевете в свой адрес и ему стало плохо.

— Я сегодня прочитал то, что было написано [о заседании]. Что мне гореть в аду, что я торгую дедушкой, — внезапно меняет тему Колесников. — Я обращусь к юристам. Пускай он [Навальный] докажет, что я хотя бы копейку за это получил, а не только имел кучу расходов на юристов.

— Гореть в аду судье, а вы просто торгуете, — замечает на это Навальный и переходит к вопросам.

— Вы сказали, что просили [сиделку] Зину ничего не говорить дедушке. Зина 15 минут назад сказала, что вы отправили видео и попросили его показать [ветерану]. Кто из вас лжет? - asks Navalny.

Колесников успевает ответить, что отправил ролик уже после того, как ветеран узнал о случившемся. Вопрос Навального снимают, участники процесса снова начинают друг друга перебивать и кричать.

«Вы мне скажите, почему вы не извинились перед дедушкой? У вас же была возможность?» — громко и эмоционально обращается свидетель к политику. Тот в ответ повторяет: «Вы торгуете своим дедушкой!»

Прокурор просит удалить Навального из зала. "Proof! Вы из клетки это говорите, докажите!» — кричит Колесников Навальному. Судья просит адвокатов успокоить их подзащитного.

Когда зал вновь затихает, Навальный просит занести в протокол протест на действия судьи. Акимова, говорит он, сняла вопрос свидетелю «по выдуманной причине», как только удалось поймать его на лжи. «Если вы не можете формулировать вопросы, не формулируйте», — реагирует на это судья.

Навальный дословно повторяет ранее заданный вопрос. Колесников на этот раз поясняет, что сиделка показала ролик его деду «самовольно». Политик вновь спрашивает, кому верить в этой ситуации. Колесников настаивает, что ему. «Зине платим зарплату мы, — объясняет он. — Она могла испугаться. То, что она сказала — неважно. Важно то, что сказал я».

Прокурор Фролова вновь просит сделать замечание Навальному. Защитник Михайлова — прокурору. Судья Акимова просит адвокатов «как профессионалов» следить за поведением их подзащитного. Но Навальный продолжает задавать вопросы:

— Вы сказали, что ни вы, ни Артеменко в правоохранительные органы не обращались, правильно?

— Не обращались, — подтверждает Колесников.

— А Зина сказала нам, что дедушка писал заявление. И для этого уединился с вами в комнате. Is it true? — продолжает Навальный. Колесников вновь все отрицает. Тогда политик просит суд изучить его заявление из материалов дела.

Об этом же просит адвокат Кобзев, и неоднократно. Сначала судья Акимова интересуется, ходатайство ли это. Потом спрашивает, в связи с чем. А затем и вовсе заявляет: «У нас не стадия исследований», — имея в виду, что прочесть заявление в правоохранительные органы во время допроса свидетеля, его написавшего, якобы нельзя.

Кобзев вновь повторяет ходатайство. И судья вновь интересуется, для чего необходимо это заявление. Навальный окончательно выходит из себя и кричит:

— Я много раз был в суде. Вы вообще понимаете, как идет уголовный процесс?

— А вы понимаете, что вы — подсудимый? — громко спрашивает у него судья.

— Вы даже не можете сфабриковать дело грамотно. Меня это оскорбляет! — продолжает кричать Навальный.

Перебранку прерывает прокурор Фролова. Она просит отложить судебное разбирательство и допрос, напоминая, что заседание длится с самого утра и рабочий день уже окончен.

«Снова получается, что я прижал вас к стенке, и вы объявляете перерыв! - Navalny is outraged. — Потому что свидетель не знает, что говорить, ведь заявление есть. And you do not know. Я настаиваю, что прокурор просит о перерыве, потому что я подловил одного из ваших фабрикаторов и торговца дедом на вранье!»

Следом политик спрашивает уже у судьи Акимовой, почему его ходатайство не разрешено, хотя он заявил его раньше прокурора. «В следующем заседании!» — говорит судья. И несколько раз повторяет: «Сейчас у нас ходатайство об отложении дела».

Адвокат Михайлова замечает, что защита хочет предъявить документ свидетелю, пока он в зале. «Свидетель, если захочет, явится», — говорит на это судья. «Когда вы его подготовите», — снова кричит Навальный. Колесников в свою очередь кричит, что готов продолжить заседание. Но судья его прерывает, переносит заседание на неделю и быстро покидает зал. Навальный с возмущением и грустью смотрит на журналистов.
