
The Krasnoselsky District Court of St. Petersburg set a fine of 5,000 rubles to the indefinite disabled person of the III group of groups by Evgeny Agafonov for “participating in an unauthorized action” on January 31 in support of Alexei Navalny.

According to law enforcement officers with whom Judge Julia Ushanova agreed, the man not only “blocked the road”, but also “along with other participants in the action shouted slogans (!) During the rally”.
Evgenia lawyer Sergei Loktev (cooperating with the “protest apology”), told Novaya Gazeta that his client was engaged in design and woodcarving. During the action, he left the house and was heading to the World of Arts store. Loktev did not know the fact that in St. Petersburg was taking place in St. Petersburg, and could not hear the police to “stop the action” for objective reasons. When the man was detained, he explained in the brutal language that he had problems with hearing, but law enforcement officers still decided to put Agafonov in a car zak. He was not provided with a gap.
After the detention, he spent nine hours in the police. According to the lawyer, the man did not understand why he was detained.
Now Eugene intends to appeal the fine appointed by the court. Agafonov lives with his wife - also a hearing disabled person. The fine of 5 thousand for them is a large amount, since almost all funds received from benefits and pensions have to be postponed to repay the mortgage, the lawyer said.
“We want to appeal this fine,” says Loktev. “We hope that nevertheless, the City Court of St. Petersburg will terminate the case due to the lack of an administrative offense, since Eugene did not go out into the street to participate in the action.”
It is still difficult to talk about the prospects for satisfying the complaint, according to the lawyer.
“We have any proceedings - whether it is administrative or criminal, or civil - must correspond to the interests of the citizen, the interests of justice and the law. Unfortunately, all these conditions are not observed in our situation, ”Loktev concluded.

It should be noted that by making a decision on the appointment of a fine “For shouting slogans” to be incapable of saying to a disabled person, the court was “humane”: 5000 rubles - below the minimum sanction under part 6.1 of Article 20.2 of the Code of Administrative Offenses (“Violation of the established procedure for holding a rally that interferes with the movement of pedestrians or vehicles”), which is 10,000 rubles.
