What is the essence of the matter

That is, the legal persecution of Mrs. Le Pen began under the "old regime". Nevertheless, even then, as now, a little more than a year remained before the elections, and the current president (Hollande) still planned to nominate for a second term.

It is also important to note that the publications were made against the backdrop of shock, which the country was experiencing a month after Parisian terrorist attacks on 11/13/2015, in which 130 people died.

The family of American journalist James Fouley, whose photograph of the murder also posted Le Pen, on the same day published a statement demanding to delete the publication. Le Pen deleted the photograph of Fowley, leaving the rest of the images.

The prosecutor’s office calls this fact “aggravating circumstance”. In addition, the state prosecution insists that minors could see the images.
