Freedom of speech or incitement? The case of the ex-president of the United States

The US Senate continues to consider the charges against Donald Trump in an impeachment.

The forty -fifth President of the United States is charged with an incitement to rebellion. The authors of the indictment believe that Donald Trump with his rhetoric about the falsified elections provoked the capture of the Capitol building with his supporters on January 6 - on the day Congress calculated and approved the results of the voting college. According to the Constitution, the lower house of Congress approves the prosecution, and the Senate holds a judicial investigation. Trump's lawyer Bruce Castor insists that the actions of the crowds were spontaneous, and the president only expressed his point of view - rightfully guaranteed by the constitution.

This court is not a “freedom in exchange for security”. He proceeds from the presumption that to abandon the freedoms for which we fought for so long is a good idea. We sent the army to other parts of the world in order to obtain from other governments the introduction of the freedoms that we use ourselves. Exchange of freedom for security from an atrocious crowd? Of course not. This cannot be. We cannot allow people to be persecuted for the expression of their political views.

To represent the accusation of the Senate, the lower house appointed several of its members. One of them is the congressman Eric Sulwell.

On December 19, at an hour, 42 minutes in the morning, our commander in chief wrote on Twitter: "Big protest on Washington on January 6. Be there. Let's get in full." You know why he chose this date. She is not random. This was his last chance to prevent the peaceful transition of power. And he gave his supporters the time to prepare. And this was not a single notice. Over the next 18 days, Donald Trump again and again reminded them that he needed to come here on January 6. He told them exactly what was required of them. On December 26, he wrote: "If the Democrats candidate lost the elections because of the fraud of an unprecedented scale and had evidence of such actions, their senators would consider it a declaration of war and fight to death. The Republicans did not do anything. All the same time without a struggle." He said that you are not doing anything, do not struggle, because you are fulfilling your duty, participating in the constitutional procedure for approving the results of voting of electors.

The congressman Joe Negus reminded the members of the upper house about what happened on January 6, to members of the upper house.

Ultimately, the president used his speech as a call to weapons. It was not eloquence. Some of his supporters were preparing for these months. A few days before this speech, the press filled out reports that thousands of people are armed, that they are ready for violence. The Capitol and the FBI police reported that the thousands of crowds were aiming precisely on the Capitol, and on the night before the attack they arrested people on charges of illegal possession of weapons. Donald Trump: We will not let them silence you. It wo n't ! You must fight because our country will not return with the help of weakness. You must show power, you must be strong! We fight, fight with all our might! If you do not fight that there is urine, you no longer have a country!

In response, lawyer Castor applied another argument.

Voters deprived him of his position.

In other words, Trump’s defense recognizes false statements by his client about the leggings during voting. According to press reports, Trump remained extremely dissatisfied with such a tactic of his lawyers.

According to the regulations after the debt of the parties, the prosecution and protection will answer the questions of the senators. And then the upper house will have to decide whether to call witnesses.

To condemn the president, in the impeachian order, a qualified majority is necessary in two -thirds of the vote. The democrats do not have such a majority in the Senate. According to the latest data, six Republican senators are ready to vote for impeachment. Democrats lacking 11 more votes.
