The Union of Journalists of St. Petersburg and the Leningrad region was proposed within two weeks to “ensure the liberation of premises” on Nevsky Prospekt

This is not the first attempt to expel the alliance from an old mansion, the commercial attractiveness of which, after the completion of large -scale repair, has increased significantly. The chairman of the Union Lyudmila Fomicheva, who achieved these works, when the building was at risk of destruction due to a neighboring construction site, filed a resignation.

The monument of the 19th century-the mansion of the dry-zanet became the home of the journalist in the mid-1970s. Since 2004, the Union lived in the old walls under a sublease agreement with the city property management committee. But the walls cracked - literally when they demolished the neighboring building and scored piles for the new one. After stucco molding and painting began to collapse, it became clear that urgent emergency work was needed. Lyudmila Fomicheva achieved their conduct with financing from the city budget.

By the end of 2007, Smolny was created by the ANO “St. Petersburg Center for Information Support”, in order to also oversee the reconstruction of Domzhur. According to the resolution of the city government, the contribution of St. Petersburg as the founder of the Center is the right to use the building on Nevsky, 79 (with an area of ​​2885.5 sq. M), for a period of ten years.

Restoration and adaptation to modern use stretched for almost ten years.

All these years, with a house entrusted by the ANO by ANO, it was Lyudmila Fomicheva who was solved by many related issues. Pulling problems with officials, designers, contractors, forcing to correct the jambs, connecting independent experts, city -defenders and keeping the situation under constant public control.

Even then, colleagues Fomicheva expressed concerns that at the end of the repair, the union would survive from the house on Nevsky under some pretext, launching some business project there.

By mid -2016, instead of economic issues, ANO itself took up the district press and became the founder of the editorial office of the “districts. Quarters. " The editor was headed by the adviser to the governor Mikhail Ivanov (at that time the deputy director of ANO). “The areas. Quarters ”received about 100 square meters. m - as a structural unit of ANO, without concluding a separate contract. The Union of Journalists of St. Petersburg and Lo - four rooms with a total area of ​​89.5 square meters. m - under an agreement of gratuitous use for a term of ten years (from January 1, 2017).

Two months later, Lyudmila Fomicheva became the decision of the board of ANO.

“We had the only candidate supported by the board. And it seems to me that this is the most correct choice. Of course, a person who is directly in the journalistic community should fill their lives and give a new impetus to the journalist’s house, ” said Sergey Serezleev, head of the press committee.

Soon, Lyudmila Fomicheva began to receive unambiguous hints that the union she headed for the Union of Russian journalists. This discussion was intensified on the eve of the 100th anniversary of the SDR, to which the hero of the day I wanted to complete the construction of its "vertical". At that time, only the unions of journalists in Moscow, Kazan, St. Petersburg and the Leningrad Region remained independent structures. In view of their intransigence, the bet, presumably, decided to make parallel structures to create.

In January 2020, the St. Petersburg branch of the SDR was registered. He was headed by the chief editor of the newspaper St. Petersburg Vedomosti, chairman of the Commission on Public Security, Human Rights, Combating Corruption and interaction with the law enforcement agencies of the Public Chamber of St. Petersburg Dmitry Sherich.

And in March, the reign of ANO freed Lyudmila Fomichev from the post of director, replacing it with Mikhail Ivanov. The reason was the appeal of Roskomnadzor, who noticed the second, Greek citizenship of Fomicheva (her parents - from the Pontic Greeks, since 2015, it is forbidden for double citizenship persons to occupy leading posts in media publishers).

Having mastered the new powers, Mikhail Ivanov removed the sign of the Union hanging from the facade of Domzhur for more than a decade. And he hoisted the new one: "St. Petersburg Center for Information Support." Under the assurances that the journalists remain genuine owners of the house, and the expression of sincere respect for Lyudmila Fomicheva, Ivanov refused the union to hold the awarding ceremony of the annual Golden Feather in the building on Nevsky. The first reason in his written refusal was the fact that the application was submitted a day later than the established deadline. The second is the restrictions on coronavirus. This did not prevent the Domzhure forum of the ASMI North-West, awarding ceremony of young artists, laureates of the St. Petersburg Government Prize and other events.

In the summer, ANO ordered an audit of the organization until 2020, which ended by September. As Lyudmila Fomicheva says, she was offered to quickly familiarize herself with the audit materials immediately before the meeting of the board of February 9th. And already there they put in appearance "facts of interest transactions." The board made a decision on the illegality of these transactions and instructed Mikhail Ivanov "to take immediate legally significant actions to demand unprofitably transferred monetary amounts."

Speech, according to the “New”, is about five payments totaling 1.64 million rubles, received to the account of ANO and later transferred to the Union account.

The Law on NPOs (Article 27) recognizes those who are interested in transactions in transactions, if they are with counterparties in labor relations, are participants in these organizations. In such cases, the interested person is obliged to report his interest to the NPO management body before a decision on the conclusion of the transaction, having received its approval.

And Lyudmila Fomicheva, being simultaneously the head of the ANO and the Union, did not receive such a permit. Without denying this, Lyudmila Dmitrievna in a conversation with the “New” explained that the charter of the ANO Conducting such operations through the board is prescribed only for cases with amounts of more than 500 thousand rubles (although one of the money that has been guilty of money moves about 50 thousand):

“Yes, indeed, all these years I had to constantly look for sponsors in order to close those or other financial holes, to solve different problems. For example, we needed funds for organizing a cycle of evenings as part of the Cultural Capital project. Other philanthropists helped with money to the Golden Pen ceremony, to the chairs for the assembly hall ... When the sponsors asked what account to translate, I said - but whatever you wanted, to the ANO or to the Union. I did not see the difference-the matter is general. Now I understand that, probably, I have not taken into account any legal nuances. But all reports are for every amount. And over the years, I attracted many more funds to the needs of the house than 1.6 million that they now want to recover from me. ”

In confirmation of her words, Lyudmila Fomicheva introduced the “new” with payment documents on the sponsorship attracted by her - in only one year she had more than 7 million rubles.

It seems that the decision made by the board on “interested transactions” worked at the warm -up of the second point of the agenda: on the illegality of transferring to the gratuitous use of the premises of the domino to four journalistic NGOs, including the Union of Journalists of St. Petersburg and LO, and on the abolition of the relevant agreements.

To notify everyone about the need to free the premises in a two -week period was entrusted to Mikhail Ivanov. At the same time, it was emphasized that it is not forbidden to take measures in agreement with ANO. This is approximately as with the constitutional right to freedom of rallies and meetings: applications can be submitted as much as you want, but there are a thousand reasons for the refusal.

The board ordered a separate paragraph to provide four heads of journalistic organizations as members of the board of working premises in Domzhur, "based on the principle of an approximate parity." He is really approximate - for Lyudmila Fomicheva, who heads the oldest and most large organization of St. Petersburg journalists (over 2 thousand people, the second regional organization after Moscow) retained 35 square meters. meters.

Dmitry Sherich (his SDR cell at the beginning of the year totaled a little more than 200 people.) It found it difficult to answer the “new” how much he had to punch. While the St. Petersburg branch of the SDR is occupied by former exhibition spaces in the second floor.

It is noteworthy that the contract for the regional structure of the SDRR of these premises was not signed by Lyudmila Fomichev, but by Mikhail Ivanov. Having then seen any violations of the charter in such an agreement.

“Yes, according to the same tagged scheme, I drew up an agreement with Sherikh,” Ivanov confirms.

“New” tried to clarify with Mikhail Ivanov that it was the board that considered it unlawful in contracts for the provision of premises by journalistic NGOs.

“I would not want to draw the final conclusions now,” Mikhail answered. - First you need to understand all legal moments, as the rule entrusted me with.

- So, maybe it was necessary to figure it out first, and then reset the contracts?

- There is a decision of the board, I am obliged to fulfill it. It is not about the fact that the contracts just need to be thrown into the basket, we must conclude new ones that will not contradict the rule of law.

Meanwhile, in the 2017 agreement, concluded with the Union of Journalists of St. Petersburg and Luo, it is said that it can be terminated ahead of schedule only by court decision.

Having received from Mikhail Ivanov the order to release three of the four occupied premises until February 24, Lyudmila Fomicheva sent a letter to the chairman of the board of ANO, the head of the Smolninsky Press Committee Vladimir Ryabovol. At which she appreciated the decision to terminate the contract as illegal and actually depriving the Union of Journalists of St. Petersburg and LO “place of traditional stay”. And she notified that the Union "reserves the right to use the premises granted under the agreement of 2017, up to the decision in court."

- The house remains a platform for all journalistic NGOs, they all remain our friends and settlers, no one drives anyone! - hastened to assure the “new” Mikhail Ivanov the next day. - But the premises are not individualized in old contracts, there is no consent of the owner of the premises, and this is a city. And the contracts are not registered in Rosreestr. The main thing is that you should not translate the question into a political plane.

- And it was impossible to conclude a new contract without exposing NGOs?

- Once again: no one drives anyone away, everyone remains in their places.

- That is, no one should release the premises until February 24?

- No.

- Do you intend to send them letters about the abolition of this order?

- If there is a need for this. In any case, this issue will be agreed with the board. I can promise that there will be no arbitrariness. It may really not be so chopped off the shoulder. We begin to understand this.

The Chairman of the Press Committee Vladimir Ryabovol evaded the answer to the question “New” about whether Smolny (as the founder of ANO) shares responsibility for incorrectly executed treaties at the journalist’s house, why all the past years did not see any flaws in them and why it was impossible to issue new, correct agreements without instructions on the release of premises.

Instead, Vladimir Ryabovol wrote to us that all issues of financial and economic activities are entirely in the competence of the director of the journalist’s house, who fulfills the decisions of the board.

At the same time, Mr. Ryabovol assured that "the question of" eviction/exile "from the house of the journalist any of the existing journalistic organizations was never even discussed."

It remains to understand how this certification correlates with the signature of Vladimir Ryabovol under the protocol of the meeting of the board he headed, entrusting Mikhail Ivanov to immediately notify these journalistic organizations about the release of premises within a two -week period.
