
“They [in an orphanage] understood that I was a native grandmother, saw how the children rush to me, hanging around her neck,” says Alla Nikolaevna. - We were given to chat for about an hour, however, under supervision. And on February 22, 2019, their father called, my son: “Mom, look what is happening there! I’m just with D. ( the grandson of Alla Nikolaevna, we are forced to hide the names of the children as the law requires . - Ed. ) Speak, and he was in the subway! He says we are going to visit the teacher. I asked to transfer the phone to the accompanying person, and immediately the phone turned off.
From that moment on, the phone of the children was disconnected. He was issued to Alla Nikolaevna and paid for two months in advance. Two months later, the girl answered him, said that she was buying a phone in the market and she was given a number. She, of course, knew nothing about the three missing children.
They did not know anything or pretended that they did not know, and in the orphanage. They said: “They were taken from us,” and that’s it. No more information.
About how the father of three children and their native grandmother are trying to return them to the family, tearing out of the captivity of soulless state custody, I learned from the employees of the Foundation “Volunteers to help orphans”, which is managed by Elena Alshanskaya. They tied me with Alla Nikolaevna Granal. All the time that I listened to her seemed to me that this family was surrounded by robots programmed to pronounce only one single phrase: "You have no rights." Or-inside some bad game, not that impassable, but very dumb and cruel: the game hangs, removes all the preservations and is endlessly rebooted.

Alla Nikolaevna Granalskaya is from Ukraine, has been living in Moscow for more than 30 years. She was 49. In 2010, the eldest son-Igor, came to live from Melitopol. Then he brought Svetlana into the house, a fragile 18-year-old girl with a difficult fate: she grew up in an orphanage, her sister died in her eyes ... Alla Nikolaevna fell in love with the light as a daughter, and when her grandchildren began to be born, she helped young parents as she could. Igor offered Svetlana to legitimize relations, but her relatives pressed her: “Do not sign, he will take your apartment!” A one -room apartment in South Butovo Svetlana was provided by the state - like an orphan. So it turned out that all the children in the patronymic of Igorevichi, but their surname is not father, but mother.
He and Igor had three children, they lived together for six and a half years, and then a discord began. Igor and Svetlana parted when the younger girl was not yet a year old. Svetlana then asked Alla Nikolaevna to pick up the baby, referring to the fact that she was very difficult for her alone. I was happy to take it. A few days later they took the eldest son, who is now ten. The boy is sick with diabetes, and Alla Nikolaevna graduated from a special school to properly take care of the child. Then they took the middle boy (now he is nine). Svetlana came to visit the children, took them with Igor to the clinic, sometimes she took them for a week to her. But not often - she had her own life, another man.
Children lived with dad and grandmother for two and a half years. And on the night of August 10, 2018, Sveta died in a dream from cardiac arrest. And it was from this day that the many -faced monster was pulled by his nose and began to gently peer into the orphaned family.

- They tell me why I did not begin to make custody during the lifetime of Sveta? - says Alla Nikolaevna. -Yes, it never occurred to me, our children, why decorate something? Who could know that a 27-year-old young woman suddenly dies?
Alla Nikolaevna works as a seller, the son was engaged in the repair of apartments, legal literacy leaves much to be desired. Yes, and people could not imagine that some papers could blow up their lives.
A few days after the funeral, they took care of the place of residence of Sveta. They seemed to be explained what documents need to be collected. But they said that while there are no papers, the children cannot remain without a legal guardian, and since the grandmother and the uncle of the deceased Sveta are indicated in the materials about the relationship, they decided: temporary custody will be decorated for uncle, they say, the apartment conditions allow.
The problem was that Igor, the father of the children, at that time did not have a passport - was lost, only a photocopy. I had to go to Ukraine to restore documents.
Children from the family to my uncle were taken away on August 28, 2018.
- When they took the children, I told the adoptive parents that the elder needed a special care 24 hours a day. I put an alarm at night for every 2 hours, because sugar can fall or rise at any time, ”continues Alla Nikolaevna. “And they respond to me that they themselves will figure it out.” As a result, in two months the child ended up in the hospital several times!
The first time from the foster family, the boy was in the hospital, because for several days a high sugar rate was kept, he did not go astray. He lay there for about 10 days, and Alla Nikolaevna visited him. When the child got to the Morozov hospital for the second time, the head of the grandmother asked the head of the grandmother and asked: "Do you want to pick up the child?" - And she offered to talk to the lawyer of the hospital.

Alla Nikolaevna asked her question: why is the baby for such a short time for the second time in the hospital? And she received an answer: there was no proper care to bring to such a state of the child, you need not to observe him at least three hours. The manager added: doctors must warn the custody of this.
And the hospital’s lawyer will tell Alla Nikolaevna what should be done first of all-which for some reason, officials from the guardianship did not say a word.
The boy recovered, he was discharged, his grandmother called up with him, asked which of the children to bring. I bought everything that they asked, and many more winter clothes. I called the guardians to agree on a visit. Once, then two, then ten, then went astray. No one answered. She began to call the recovered grandson - the same story.
Of course, people are strangers, and in order to come to meet children, we must agree. But there was no patience for ethics, and she decided. She had five large bags with things, so she went with the youngest teenage son. The intercom behaved the same way as the phone: he did not answer. They managed to get into the porch, they called the doorbell, they opened it. But there were no children. The "adoptive uncle" said: they failed, could not provide round -the -clock care - and took care of all.
Where? The man did not know, he only said that the older boy was again in the Morozov hospital.
- He had nothing in the hospital - even a bottle of water. Neither a cup, no spoons, no plates, ”Alla Nikolaevna says with horror. - I went to the manager. It turned out that the boy was being prepared for the orphanage, because adoptive parents refused the children.
She did not take care, but they themselves refused the children, without even telling me! And it also turned out that the boy was brought in an ambulance unconscious.
The child explained to me that in the morning their police took away and the children were sitting there from morning to evening without food. Can you imagine? The police did not even think of feeding young children. What are the police, foster parents to children even did not give sandwiches with them.

- The trouble is that unqualified legal assistance was provided to her grandmother and her son at the initial stage. The person was sent to collect certificates and documents for Ukraine, although all this could be done while remaining in Moscow. If he had not left, and if not for the problems with entering Russia, now everything would be different.
When the father of the children, Igor, gathered all the necessary documents, it turned out that for an unknown reason, Russia indefinitely closed him to the territory of the country. For what - do not explain. He is not convicted, not brought to any responsibility, is not wanted. Now Igor is trying to challenge this decision, but so far unsuccessfully.
Alla Nikolaevna brought the documents collected on the advice of a children's hospital to the guardianship authorities, in the Moscow district of Solntsevo. And there they said: we will not accept your statement, the children are already given to the state institution and now it is impossible to issue a temporary custody, only ordinary custody is possible, but for this you need to go through the school of adoptive parents.
And the native, blood grandmother went to study at the school of foster parents in order to take her grandchildren whom she raised from birth.
The children, meanwhile, were sent to the shelter “The Bank of Hope”, and the grandmother wore gifts there. The first time to meet with children, and on the second - no longer. They said that we need permission from guardianship. From the guardianship they answered - after a month and a half - that she has no rights to children, since there is no written confirmation (!) That she consists with them in a family relationship. There is no piece of paper.
“The mother of the children died, dad cannot return to Russia, the only close relative who has the right and the opportunity to continue to communicate with them in this situation and breaks to this, overcoming all the obstacles, this is a grandmother,” the lawyer Victoria Dergunova continues to comment on the situation. - She is not a stranger to children from the street, she is a native grandmother with whom they lived and to whom they had a stable emotional affection.
Later, the court was appointed a genetic examination to establish the kinship of grandmother and grandchildren, the results of which confirmed the kinship by 99.9 percent.
Nevertheless, Alla Nikolaevna, even before the ships, managed to see the children, she literally crawled into the shelter on the New Year holidays of 2019. And in January, the kids were transferred to an orphanage in Novo-Pedelkino. There was already a tough ban on visiting and “programs”. Alla Nikolaevna turned to a psychologist at the school of adoptive parents. It turned out that in the orphanages the so -called aist day is held: any person, presenting documents, can come there on this day, chat with children, and for potential foster parents they conduct excursions.
- And I went there on a stork day on February 16, 2019. I have different surnames with children, so no one suspected that I am a grandmother. I immediately saw the younger one, he sat sad, detached on an armchair. I called, he took off from this chair and flies to me: "Grandma!" And then I see the elder, they together throw me on my neck, hung. Then they also met with the granddaughter. About 20–25 minutes they gave us to talk, then the time was leaving.
Alla Nikolaeva and psychologically that day seemed to come out - he says that after the meeting there was a terrible state. She fell ill that day. I did not know that you could emotionally exhale like that.
After she was never allowed into an orphanage. Paid: "You have no right!" Although, of course, they saw the joy of children when meeting her and could not but understand that it was their native grandmother.
Alla Nikolaevna overcame the powerlessness and despair with activity. And another joy from the fact that now she could talk with the older grandson on the phone.
And then the children disappeared. The phone was blocked, then an unfamiliar voice answered this number, and in the orphanage they said that they no longer had children and did not continue the conversation.
Alla Nikolaevna phoned all the orphanages of Moscow and the Moscow Region. No traces. She went to the Department of Social Protection of the Population, and only here she was informed that children now live in a foster family in another region of Russia. Just at this point, the grandmother graduated from the school of foster parents ...
All that Alla Nikolaevna now knows is the city where the children live, and what their name is their adoptive parents.
“If I used to know about the fund where President Elena Alshanskaya,” says Alla Nikolaevna, “the children would not get into the orphanage, and then to the foster family.” I now have a Moscow residence permit, and at the time when I ran around the guardianship, I was Lipetsk. They told me that the children are Muscovites and give them to me - to worsen their apartment question. And to give to another city to strangers is not a deterioration? I did not know much and did not understand, now the fund provided me with full legal support, and several ships have already passed. We demand that the foster family allow me to at least communicate with children. At first they did not believe that I was a native grandmother. The DNA expertise was held, which confirmed the relationship. The refusal is still. I tried to talk with my adopted mother. Answer: "I do not want to talk to you!" Why can't I see my grandchildren?

-The court refuses his grandmother to communicate with the children on the grounds that, firstly, dad did not establish his relationship with children, and secondly, his grandmother did not confirm her own kinship with her son (father of children). This position of the court contradicts not only the current legislation, but also common sense. It turns out that the court of first instance determines the subject of proof, appoints an examination to establish the kinship of the grandmother and children, and then, despite the positive result, makes a refusal decision. With reference to a circumstance that was not even recognized as legally significant during the consideration of the case. Having put the rights of grandmother to communicate with children depending on her son (father) with them, she was actually deprived of an independent right to communicate with her grandchildren guaranteed by family law. The position of the court: If the parent himself cannot or does not want to communicate with the children for some reason, then you should cut off the entire related line from contacts with them. What are the interests of children in this case is hardly clear.
Now children do not communicate with any of their relatives. Perhaps this was done in case the dad sets his blood kinship: it can be said that due to the long separation, their attachment to each other broke off and the children should be left in the foster family. But let's recall what this is said in the Family Code, which is understood by the interests of children? Live and educate in the family, know their origin, the priority right of parents to educate their children in front of all third parties. All state policy is aimed not to take away children from the family and provide her all kinds of assistance in reunion if the separation still happened.
The foster family raises children not free of charge. In addition, children are considered orphans, as the mother died, and the father has not yet set kinship, which means that each of them has an apartment.
... On March 17, Alla Nikolaevna will have another court in Rostov-on-Don. She asks only one thing so far: give me an opportunity to meet.

- The grandmother and father of the children themselves came to guardianship, applied for the advice of what to do in such a situation when their mother died, and the father was not officially formalized. Even with the current legislation, guardianship could recognize paternity on the basis of testimony, that is, to interview other relatives and neighbors who would confirm that this is the father of the children. Bypassing the court and the DNA test, they could recognize him as his father, and in the meantime he would collect the necessary documents. If the guardianship authorities seemed to be dysfunctional, they could put it in control, connect social protection so that they would observe and at the same time support a family, financially not very secure. Of course, it was necessary not to take the children, but to arrange preliminary custody of the grandmother. Children would stay at home. According to this scenario, everything was supposed to develop.
It is impossible for a person who is not specifically prepared, who does not have a specialized psychological education, work where he should decide every week, who to live with his own children, but who doesn’t, who from who to pick up the child, and to whom to leave.
Through employees of the guardianship authorities, many tragic situations pass, and they must make all decisions themselves. Now they have to rely on their subjective opinion. Serious decisions cannot be given to one or two employees. The procedure for assessing the situation in the family should be enshrined, psychologists should be assessed by child-child relationships. After that, the guardianship authorities must collect a consultation, which will include different specialists and on which all together they will make a balanced decision.

In a structure that is designed to assist people, including those who fell in a difficult situation, simply did not pick up the phone. Or, taking it, they clicked the "hunger".
