The Moscow City Court canceled the fine for an environmental activist who opposes the development of a park in Kuntsevo

The Moscow City Court has canceled a fine for eco-activist Alexei Sobolev, who opposes the construction of a park on Ivan Frankopod Street, an understudy of Kutuzovsky Prospekt. Sobolev himself told OVD-Info about this, the information is also published on the website of the court.

Thus, the Moscow City Court overturned the decision of the Kuntsevsky District Court, which found the activist guilty of petty hooliganism (part 1 of article 20.1 of the Code of Administrative Offenses) and fined him 1,000 rubles.

An administrative case against Sobolev was initiated after the events of September 29, 2020, at the peak of the protests against the construction of the park on Ivan Franko. On that day, he and other activists were on duty when the construction guards approached them and began to provoke a conflict.

Security officers called the police and accused the park defenders of cutting off some banners, and also stated that Sobolev was drunk. As a result, the activist was detained and taken to the department, where a protocol was drawn up.

In the document, the police made mistakes, writing that Sobolev was born in 2000, and also indicated that he was in a state of intoxication. The Moscow City Court drew attention to all these shortcomings and returned the case for a new trial.

In a conversation with OVD-Info, Sobolev noted that the same judge of the Kuntsevsky court imposed a fine on him in the case of petty hooliganism, who had previously fined him 10 thousand rubles due to a public meeting with developers in Kuntsevo (part 5 of article 20.2 of the Code of Administrative Offenses) .
