
The Law on the Organizers of the spread of information was adopted as part of the “Spring Package” back in 2014. According to the norm , Ori is considered “a person who carries out the functioning of information systems or programs for the transmission, delivery and (or) processing of electronic user messages” of the Internet (Article 10.1 of the Law “On Information”). As explained by Svetlana Kuzevanova, a senior lawyer of the media protection center ( the organization is included in the list of foreign agents . - Ed. ), The owners of almost any site where there is communication between users fall under this definition.

According to the law, Ori are obliged to store data on the facts of reporting reports and within six months the content of the messages, as well as provide direct access to the FSB officers (Article 10.1 of the Law on Information). Constant access should be provided using special equipment (its information distribution organizers should be installed at their own expense). In addition, Ori should appoint a responsible employee for working with the FSB and develop an interaction program.
Among the first participants in the registry were large Internet companies-Yandex, Mail.ru Group and VKontakte. Later they were joined by Tinder, Vimeo, WeChat and other services (at the beginning of the introduction of Or, the then deputy head of Roskomnadzor, Maxim Ksenzov, promised that foreign platforms “without exception” would be entered into the register). In June 2020, Roskomnadzor introduced Tinkoff’s mobile bank in the register, and in November he added the Picabu and Yaplakal entertainment portals there.
Now, according to Roskomasvoboda, about three hundred organizations are considered the organizers of the distribution of information, and it is sometimes very difficult to trace logic in the sample.
There are many and completely unknown resources, such as the sites of the Center for Social Services of the Elderly and Persons with Disabilities of the Tarasovsky District, the State Clinical Hospital No. 5 of Volgograd, as well as the Electron-35 technique store from Cherepovets.

- The register of Roskomnadzor is filled inconsistently. At the very beginning, the list was included in the list - these were social networks. Then various sites began to be added there, and periodically among them the media were found. The key in determining the organizer of the dissemination of information is the established communication between users. In the media, a commentary system often works, there is a forum and various feedback forms, ”explains Kuzevanova.
In total, Roskomnadzor decided to take several dozen sites of regional publications so far, including the “Caucasian Knot” page, Ural news agency URA.RU, as well as the Voronezh media “Notepad” and “My.online”. The Ufa list also included the Ufa edition of Prufa (before changing the name "Stuff"). The notification from the RKN received them a year and a half ago. According to the “new” editor of the platform Aigul Musin, the editorial office did not dispute the need to include in the register, since they did not know what the consequences would be. As a result, at the end of last year, the editorial office came from the FSB Office for Bashkiria, which said the need to draw up a road map in which the further interaction of the service and the defendant of the ORA list will be spelled out. At a meeting with the director of the PRUFA publication, the service representative explained that the company should at its own expense purchase encryption equipment that stores and transfers information to the FSB about readers who leave comments on the site.
- The cost of equipment is estimated at about 25-30 million. But it is still at the development stage, that is, it does not physically exist. Nevertheless, it will probably appear. It was immediately obvious that our organization would not pull such a cost. And not only ours, any media, if it is not a large federal one, will not be able to purchase this equipment and not go broke, ”says Musina.
As a result, at the end of January of this year, “Prufs” turned off the comments on the site, despite the fact that this step, according to the editor -in -chief, was painful. “The commentary platform was a place where our reader core was actively exchanged by the opinions where the authors with readers took place,” Musina explains. After disconnecting the comments, the publication filed a notification of this to Roskomnadzor with a request to withdraw “Prufs” from the register. However, the department replied that this is possible only because of either the liquidation of the legal entity or the death of the founder.
“Now we are no longer taking any actions and are on expectation, hoping that this absurd law will nevertheless make changes that will give the opportunity to at least leave the registry,” says Musina.
What to do does not know in another regional media, which was entered into the register of Ori five years ago. According to the representative of the publication who wished to remain anonymous, after included in the register in the work of the editorial office, nothing changed, and none of the law enforcement agencies came out to contact the media.

- In the document that sent Roskomnadzor (is at the disposal of the editorial office) the reasons for entering the register are not indicated. [We were ranked for Ori] notifying order. Then we did not dispute the decision, because we did not understand what this could affect. On our servers, data on users are not stored at all, so we cannot store them. We have a commentary service, but it is external, it is not stored on our server. We do not collect personal data, ”the interlocutor of the newspaper explains.
The main reason for the introduction of the Ori Register in 2014 was a desire to provide law enforcement agencies with easy and quick access to user communication.
“In fact, this is another way of pressure on citizens,” Kuzevanova claims.
Moreover, for many media, in addition to the ideological component, a monetary issue can be an obstacle to the implementation of the law. So far, the necessary equipment has not been developed (according to Kuzevanova, it is promised only by 2028), introducing in the register more resembles the “probing of the soil”. However, when it is created, the cost of equipment may exceed twenty million rubles, and it will have to be installed even more portals.
- Most resources, including the media, do not take money for the provision of services. That is, people do not pay for articles of free news or the same Novaya Gazeta. So the media will not be able to shift the costs of installing equipment to their users, ”Kuzevanova explains.
After notifying Roskomnadzor, the portal is obliged to send a notification to the register within ten days. If the editorial office decides to ignore the requirement of the RKN, the media will threaten a fine of up to 300 thousand rubles (Article 13.31 of the Code of Administrative Offenses), while you still have to enter the register. If the publication does not want to enter the register again, the RKN can finish it again, or file a lawsuit to block the media website until the registry is included. At the same time, according to Kuzevanova, there are very few such cases in Russia so far, and the courts usually “under the copy” are satisfied with the claims. One of the few positive cases recently happened in Kaliningrad - after the trial, Roskomnadzor abandoned the lawsuit to block the Rugrad.eu business portal for refusing to join the ORA register. At the same time, all the signs of Ori were removed from the site to this moment.
- In the procedure, the exit from the registry is not prescribed. If you want to get out, you will need to file a notification in the RKN with a request to change the registry recording. However, whether this will free the media from the installation of equipment is not at all clear. In addition, so far there were no such precedents, ”Kuzevanov summarizes.
