The government cancels education: the first regulatory documents have been published

It would seem that they had already scrapped their at the end of last year, having studied the text of the project made in the Duma of the FZ on education "in terms of conducting educational activities." But no - it is not so bad that it could not become even worse. First of all, this applies to the quality of Russian lawmaking in recent years. And even if the bill introduced to the lower ward is clumsy, illiterate and odious, there will always be those who will help to make the text even worse.

So it happened with amendments on educational activities. In the original text of the bill introduced the first part of the new article 12.2. “General requirements for the organization of educational activities” was as follows.

“Individuals, individual entrepreneurs and (or) legal entities are entitled to carry out educational activities subject to the requirements provided for by this Federal Law, as well as other regulatory legal acts of the Russian Federation.”

It was with this wording that the bill was adopted in the first reading shortly before the New Year. But in the table of amendments recommended for the adoption by the State Duma Committee on Education and Science, and posted on the Duma website on February 17, 2021, we already see a noticeably supplemented text.

From this moment, state authorities, other state bodies, local governments and their authorized organizations are indicated as the main enlighteners.

It will be appropriate to remind the reader, not every day addressing the text of the Constitution, that, due to the amendments adopted in 2020, local governments and state authorities are included in the unified system of public power in Russia - they interact for the most effective solution of problems in the interests of the population living in the relevant territory (despite the fact that Article 12, which is one of the foundations of the constitutional system, says that the bodies of Local self -government is not included in the system of state authorities). So now they will also carry out educational activities - in our interests with you.

The proposed changes were arranged by the Federation Council, the Council of Educational Activities did not even consider, due to the optionality, the legal administration of the upper house and the three committees of the SFILI of positive conclusions. The law on amendments was signed by the head of state, officially published. The wording of the first part of the article “General requirements for the implementation of educational activities”, prepared by the Duma Committee on Education and Science, now has become part of the law and looks like this

“ Educational activities are carried out by state authorities, other state bodies, local authorities, authorized organizations, and also have the right to implement individuals, individual entrepreneurs and (or) legal entities subject to the requirements provided for by this Federal Law and other regulatory legal acts of the Russian Federation.”

And now the government, by virtue of its constitutional obligation to ensure the implementation of federal laws, is preparing a draft resolution on the approval of the Regulation on the implementation of educational activities.

And here is the main, first direction in the list is the spread of the spiritual and moral values ​​of the peoples of the Russian Federation, historical and national-cultural traditions. Other values ​​and traditions should not be distributed, because this can be qualified as a negative foreign interference in the educational process and conducting destructive actions in relation to the Russian state and society. The popularization of the best samples of world culture is allowed, which federal executive bodies will carefully select for us.

The most important thing in the amendments on educational activities and the draft Regulation on the implementation of this activity is the image of the state as the main enlightener.

Mind The Language, as they say in the camp of the most alleged enemy. Enlightening activities are carried out by state authorities and other state bodies together with the amendments that have lost their original purpose to the MSU. Physical and legal entities are only entitled to implement it-subject to compliance with the requirements of the Federal Law “On Education” and other regulatory legal acts of the Russian Federation. And in order to deprive some individual or legal entity, the right to carry out educational activities is enough to adopt the next regulatory act containing requirements that are impossible for such a person. Cleaning the ranks of potential enlighteners can be carried out quickly and efficiently.
