Chirniy served seven years of strict regime in colony No. 12 in the city of Bataysk (Rostov Region).

In 2014, it became known about a criminal case brought against residents of Simferopol who were trying to fight against the transfer of Crimea from Ukraine to Russia. They were charged with two arson, which caused minor damage, as well as planning some terrorist attacks.

Aleksey Chirniy and Gennady Afanasyev, who cooperated with the investigation and agreed to have the case considered in a special manner, received 7 years each. Later, both retracted part of their testimony, in particular, those they gave against other defendants in the case. Alexander Kolchenko, who admitted his insignificant participation in one of the arsons, received 10 years, and Oleg Sentsov (according to the investigation, he was the organizer of the group), who completely denied his participation, received 20 years.

In September 2019, Sentsov and Kolchenko were extradited to Ukraine as part of an exchange of political prisoners. Afanasiev was expelled to his homeland in 2017.
