The morning of June 1 began with searches at several addresses related to politicians Dmitry and Gennady Gudkov. Investigative actions took place both in the apartments and offices of the Gudkovs and in the places of residence of their associates. Among the detainees were Dmitry Gudkov, his aunt Irina Ermilova, accountant Olesia Ludwig, head of the headquarters of Gudkova Vitaly Venidicts and former assistant Gudkov Alexander Solovyov.
Soon it became known that the searches passed in a criminal case on causing property damage by deception or abuse of trust (paragraph “b” of part 2 of article 165 of the Criminal Code). We are talking about the debt for the removal of the basement by the company LLC Sector-2A, the director of which was Yermilova. The company was supposed to make a training center, but as a result, it went bankrupt and has not been conducting any activities for more than five years, Gennady Gudkov said in an interview with Radio Liberty. According to him, Dmitry had nothing to do with this company.
Now Gudkov Jr. and Ermilov are suspects in this case, they were placed in the IVS before the trial. The rest of the detainees after interrogations were released as witnesses.
It also became known that the criminal case was opened on April 28-it is conducted by a senior investigator of the 10th department of the investigative part of the investigation of the organized criminal activity of the Main Directorate of the Main Directorate of the Ministry of Internal Affairs in Moscow, the head of the Agora human rights group Pavel Chikov wrote in his telegram channel. In his message, he talks about the version of the prosecution.
Valeria Gudkova, the wife of Dmitry Gudkov, noted that seven investigative groups and about a hundred attracted law enforcement officials are engaged in criminal proceedings. All detainees were interrogated in the Main Investigation Department of the Ministry of Internal Affairs in Moscow.
Three lawyers cooperating with the ATS-Info, participated in investigative measures in the case of the company and reported details after interrogations.
Anastasia Samorukova, lawyer from the OVD-Info, was during the interrogation of Irina Ermilova. She talked about why they opened a criminal case, as well as about his nuances:
This is a purely civilian relationship. The company's owners entered into an agreement with the Moscow Property Department and how a small enterprise received appropriate discounts. For many years they regularly paid under this agreement.
But after 2015, the Moscow Property Department three times raised them for payment - the company's owners drew attention to the fact that they have a small enterprise. In response to this, officials told them to sign a new agreement anyway, and after that they promised to count at the old bet.
In this regard, businessmen continued to pay, but at the old bet, relying on the promise of officials, the lawyer noted. As a result, the enterprise has accumulated debt. Then they came to the Interdepartmental Commission - there the owners of the company announced the accumulated duty and refused to recount.
As a result, according to the mutual decision of the parties, the enterprise and the Moscow Property Department terminated the contract. “They still have debts - on this occasion, an arbitration decision took place, enforcement proceedings were held. The total debt has formed from 2015 to the present - for the amount of about 3.5 million rubles, as well as penalties, ”Samorukova added.
“For me, it remained a mystery why investigators are engaged in civil law relations. Recently, we have increasingly found the practice of transferring civil law relations into a criminal law plane. This is a very sad practice that kills the economy.
No one will do business and do useful things for the economy if he will realize that at any time for an unknown reason they can be brought to criminal liability. Because the investigator will describe any commercial risk or civil law torts [offenses] from the point of view of criminal law, ”the defender emphasized in an interview with the ATS-Info.
Also, during breaks between interrogations and escorting, Samorukov drew attention to one of the operatives - he, as the lawyer noted, was present in the searches in the Corruption Fund in 2018. The defender suggested that this operative could work in the EC center, since this department has always accompanied searches and other actions in relation to the supporters of Alexei Navalny.
Anastasia Samorukova added that Article 165 of the Criminal Code, which is charged with Irina Ermilova and Dmitry Gudkov, does not imply detention.
Lawyer from the ATS-Info Alexander Salamov after interrogation with Vitaly Venidiktov, head of the headquarters Dmitry Gudkov:
All questions concerned his contacts with the Gudkov family, primarily with Dmitry. They asked about his father, mother, uncle, wife of Dmitry. Further, questions about his contacts with the Fund of Democratic Initiatives [Perhaps we are talking about the Civil Initiative Party-OTD-Info] and how and in what quality he participated in the Gudkov election campaign and in the collection of signatures in his support.
During the morning search, all equipment was seized from Venidiktov, including old laptops. To get to his apartment, the security forces used a grinder.
Lawyer from the ATS-Info Sergey Telnov after interrogation at the accountant of the company "Sector-2a" Olesia Ludwig:
The interrogation was underway in all the well-known case against Dmitry Gudkov and the General Director (LLC “Sector-2A”) Irina Ermilova. Actually, Ludwig is still passing as a witness. She was not detained, she was released, but they promised, perhaps, to be called. Investigators were mostly interested in the insightful of this company, the attitude of Ludwig to Dmitry and Gennady.
In the Main Directorate of the Ministry of Internal Affairs of Moscow, Ludwig was in the morning, she was interrogated for many hours. For several years, a woman was an accountant of the company "Sector-2a". Investigative events ended late at night.
In a conversation with Radio Liberty, Gennady Gudkov called the actions of the security forces “political revenge” to him and his son Dmitry. “The task is to find something so that Dmitry Gudkov could not advance [to the State Duma],” the interlocutor of the publication said.
