We, public figures, elected deputies and citizens whose rights may be violated, consider the bill to limit the passive suffrage of persons involved in the activities of extremist or terrorist organizations as a threat to the legal character of the Russian state and the future of democracy in Russia .
This bill grossly violates a number of fundamental rights and legal principles and applies to elections at all levels. This means that people with opposition views are actually deprived of the right to participate in voting: they will neither be able to become candidates themselves nor vote for their representatives, whose names will not appear on the ballot.
The bill limits passive and, as a consequence, active voting rights enshrined in the Constitution of the Russian Federation (Article 32) and such international agreements ratified by Russia as the European Convention (Article 3 of Protocol No. 1 to the Convention), the Universal Declaration of Human Rights (Article 21) and the Covenant on Civil and Political Rights (Article 25). Considering the case of a ban on voting for Russian prisoners, the European Court of Human Rights recognized that the ban should not be universal and should have compelling reasons. However, the new law can be applied against an indefinitely wide range of individuals who fall under the criteria of “involvement in an activity” and “expressing support by speech.”
The use of this bill would entail political discrimination and limit ideological diversity . The prohibition of discrimination on the basis of political opinion is established by Art. 14 of the European Convention on Human Rights, ratified by Russia. Ideological diversity or pluralism is enshrined in Art. 13 of the Constitution of the Russian Federation. In Art. 1 of the Federal Law “On Combating Extremist Activities,” which establishes the definition of extremist activity, provides a list of 13 points. The practice of interpreting some of them allows us to call “extremist” not even politically radical organizations, but simply opposition organizations.
The bill also seriously restricts freedom of association and association , as well as freedom of speech and freedom of dissemination of information . Freedom of speech and dissemination of information is enshrined in Art. 29 of the Constitution of the Russian Federation and Art. 10 of the European Convention on Human Rights, and freedom of association and association - in Art. 30 of the Constitution of the Russian Federation and Art. 11 ECHR. The free activity of public associations and their support will become virtually impossible. Even the dissemination of information about them will, in fact, be prohibited - after all, the bill will allow anyone who “speaks out in support” of the organizations to be deprived of the right to vote.
The bill ignores the principle of non-retroactivity, enshrined in Art. 54 of the Constitution, as well as Art. 7 European Convention and Art. 11 of the Universal Declaration of Human Rights, ratified by Russia. According to this principle, no one can be held responsible for an act that was not recognized as an offense or crime at the time it was committed. To correct this contradiction, for the third reading it was clarified that its provisions apply to legal relations arising in connection with the holding of elections scheduled after the day of its entry into force. However, support, participation and leadership of “extremist” organizations are not related to the conduct of elections and took place before the law came into force.
Finally, the bill contradicts the principle of legal certainty , the importance of which is regularly raised in the jurisprudence of the European Court of Human Rights. The law must be formulated in such a way that people have the opportunity to foresee the consequences of their actions. Now they can be punished for supporting or participating in the work of an organization whose activities at that time were completely legal.
We demand that the President of Russia not sign this bill and send an appeal to the Constitutional Court to check the bill for compliance with the Constitution of the Russian Federation.
