"Court of Inquisition." FBK and Navalny headquarters are prohibited

The Moscow City Court on Wednesday in the evening recognized as extremist organizations the Corruption Fund (previously recognized in Russia by a “foreign agent”), founded by Alexei Navalny, the headquarters of Navalny throughout the country and the organization of the “Fund for Protecting the Rights of Citizens” (also recognized by the foreigner), prohibiting their activities in Russia. The listening of the case was held closed, as part of the documents wears the stamp "secret", and lasted 12 hours. At the last meeting, all petitions for declassification of the case were rejected. Activists of Navalny’s headquarters told the North to corresponds that the authorities are trying to squeeze them out of the country or force them to betray their beliefs, but they will not give up.

By the decision of the FBK court, the headquarters of Navalny and the "Fund for the Protection of the Rights of Citizens" should be eliminated and immediately stop their activities. According to the law to appeal this decision, organizations have 30 days.

On April 16, the Moscow prosecutor Denis Popov filed a lawsuit in court to recognize Extremist organizations of Navalny. “All our petitions rejected, we made them about 25 pieces,” says Vetoshkina. - Each of our petitions was aimed at objectifying the process so that the judge saw the absurdity of what is happening. But, apparently, no one was interested in this. But when we file a petition for the call of Alexei Navalny as an interested person and we are told that Alexei’s rights are not affected in any way, and then repeat the name Navalny in the process 300 times - well, it's just funny! Closer to the end of the meeting, when I made a request for a call to Navalny as a witness, since we were refused to call him as an interested person, the judge simply screamed and removed this petition from the consideration. That is, he did not even refuse, but simply took off. Apparently, I really wanted to finish it, although we asked him to declare a break, because being in the process for more than ten hours was hard for everyone. It was physically hard for me to even speak. Representatives of the prosecutor’s office spoke about the claim, they had some additions, and then the process was completely carried out. We stated the petitions, we asked questions, the prosecutor’s office never even had questions for us as to representatives of the FBK. Probably, when you just sit and do what they said to you is not difficult. Although somewhere at the tenth petition the prosecutors began to laugh, or it’s hard to sigh that we were delaying, but, from our point of view, it was not necessary to bring 23 volumes then!

- What happened in these volumes?

They could not prove anything, but the court decision was not in our favor

- They simply collected from all over Russia sentences in extremist cases and decisions on administrative offenses. Some decisions did not enter into legal force, some of them have such marks. The prosecutor's office could not prove the connection of these people with the headquarters. When we asked the prosecutor’s office what this connection is proved (because otherwise it is just some random people), they could not answer it. We talked with the principals (they saw unequal materials), we asked them: do you know who these people are? They say: we do not know. As if, if you throw a bunch of papers, then a clear feeling is created that the prosecutors are right. It seems to me that they could not prove anything, but the court decision was not in our favor. Yesterday only a resolutionary part was read out, and if you saw the video, it is quite funny - the judge’s face did not even show there. The full decision will be prepared in the near future, but we do not even know whether it will be published on the court website.

- By decision, the headquarters and the FBK must immediately stop their work. And the fact that they are already closed some time ago matters?

The prosecutor's office could not even explain who the leader, Volkov or Navalny

- There is such an organizational moment that the headquarters in principle does not exist. That is, we tried to understand in court what the "headquarters of Navalny" is. By virtue of legislation, if there are some unregistered movements, they should still have constituent documents. We tried to show the court that, look, the Ministry of Justice has no charter, the headquarters do not exist - who do you want to extend the court decision to? The prosecutor’s office could not even explain who the leader, Volkov or Navalny. They never decided. And the FBK is still functioning like a legal entity, because you can’t close a legal entity, on which there is a duty that was formed as a result of Prigogine's claims.

- Do you think this court decision was required only for the sake of election to the State Duma or will it have far -reaching consequences?

-In the beginning, I confidently told everyone that this was just a reason to spend a bunch of searches later and start a repressive car. After the appearance of this bill, I have the feeling that everything under this law was invented so that millions of people to prevent the elections.

The senior lawyer of the 29 team Maxim Olenichev says that the prosecutor’s office put the Grif “secretly” on the administrative-icon statement, the heads of organizations could only observe from how their organizations are destroyed, otherwise, if lawyers discussed the maintenance of the claim with the leaders, they could disclose the information containing GOSTain.

- This is a very vicious situation: the first time we are faced with the fact that the administrative lawsuit is secret. This is a fundamental violation. In my opinion, this is a general reflection of the situation in the country, because the state increasingly limits the rights of citizens: it comes to freedom of speech, narrows space for criticism. This court is a reflection of the situation that occurs in the country. It is clear that the state uses this opportunity when Navalny is in a colony and cannot participate in these processes. At the same time, the authorities seek to suppress, eliminate all the structures that are associated with Navalny, ”Olenichev believes. - But this is all within the framework of the general trend aimed at suppressing the opposition and civil society institutions. Of course, he will take a certain stage in the process of suppression, but I would not say that this is such a historical process, because other organizations are also recognized as undesirable, foreign agents, extremist. In this context, this court is within the framework of the general trend for suppressing civil activity. Of course, this is an important process, it is socially significant, but I would not say that this is something very distinguished, rather a reflection of a general situation in the country.

Irina Fatyanova , the head of the St. Petersburg headquarters of Navalny, says that she had no illusions that the decision would not be in favor of the prosecutor's office.

“My plan does not change in any way-I still plan to participate in the elections to the Legislative Assembly: firstly, until there was no appeal on this decision, and secondly, my connection with the FBK will also have to be proved, this is a difficult procedure and it is not clear how they will apply the law,” says Fatyanova. -In my performance, these are generally the last elections in which someone can take part except United Russia. I can’t say that I am not afraid of persecution, but you get used to everything, including these circumstances. The authorities are ensuring that people either leave or refuse their values and beliefs, I will not give them such a gift, of course. I cleaned my social networks so that there were no prepositions to prevent me from elections, but this does not mean that I will not speak in support of Navalny or on other relevant topics.

"I continue to fight"

On social networks, the court’s decision was not responded very emotionally, since the majority were ready for this.

Journalist Ilya Azar simply posted the video of the rain TC with a commentary on the representative of the prosecutor's office after the court session with the signature "What a disgrace".

The supporters of Alexei Navalny themselves were not verbose. The former head of the headquarters Leonid Volkov wrote on Twitter: "Well, we work on." FBK lawyer Lyubov Sobol noted that this process "will go down in history as one of the most shameful during the years of Putin's rule." FBK spokeswoman Kira Yarmysh, who is sitting under house arrest, handed over such a text with a lawyer:

He explained the decision by the fact that the preservation of the headquarters would entail criminal prosecution and other risks for Navalny's supporters.

According to the recently adopted law, the supporters of Navalny, even those who did not work in the FBC or headquarters, threatens the fact that if their actions are recognized as the support of an extremist organization, then they will not be able to run in the election of any level.

Maria Petukhova, who headed the headquarters of Navalny in Kaliningrad, left Russia in one of the Baltic republics in mid -May, since "it was very difficult in the last month." At the end of April, the court in Kaliningrad fined Petukhov for 150 thousand rubles for a post on social networks. In February, she spent 12 days under arrest.

Petukhova is already the second ex-coordinator of the headquarters of Navalny, who left Russia. In April 2018, Yegor Chernyuk left the country. After the elections of the President of Russia against Chernyuk, a criminal case was opened for evasion in the army. In an interview with Radio, Freedom, he said that he urgently left Russia due to the pressure of the police and the center for counteracting extremism. Now he is studying in the USA.

• In Murmansk on April 9, unknown people flooded the door to the headquarters of Alexei Navalny with a foam and painted a swastika on it. April 13th managed to open the door. It turned out that the door was hacked, as the electricity was turned off inside the rooms, the wires of video surveillance chambers were trimmed, the swastikas were painted on the walls, and the furniture was spoiled.
• The coordinator of the headquarters of Navalny Violetta Grudin was summoned for interrogation in the case of vandalism, which was excited due to the scratched inscription "Putin the Kilitz" (spelling was preserved).
• The police also called for an interrogation the deputy head of the headquarters of Navalny in Murmansk Alexander Surinov, supposedly on suspicion of transportation of drugs. After checking his things, the police released the activist, not finding anything forbidden.
• In St. Petersburg, the court arrested the head of Navalny's headquarters Irina Fatyanova for 10 days. Fatyanov was accused of organizing a protest rally on January 31 due to the fact that in the group of the headquarters of Navalny they published a video calling to reach the action. On the day of publication of the video - January 27 - Irina Fatyanova was in a special -reception, where she was serving an arrest for a protest campaign on January 23.
