Galina Nekrasova from Kaliningrad achieved the first certificate in the region from the Ministry of Health, allowing her not to wear a mask. Nekrasova is a disabled person with a bouquet of serious diagnoses, she is forced to move by public transport, but suffocates in a mask. And without a mask, a woman was planted twice from the bus. Having received a certificate, Nekrasov now requires transporters to compensate moral damage.

With Galina Nekrasova, we meet in city bus No. 14. On long trips from the private sector on the outskirts to the center of Kaliningrad, she is accompanied by her husband Alexander. On the bus, he habitually puts on a mask. In Galina, the mask is lowered to the chin. The conductor does not make complaints.

- I now showed the conductor a certificate and an extract from a cardiologist, where all my diagnoses are painted. She said that a disabled person. She didn’t even look, she just didn’t say anything and went, ”says Galina.

- Yes, we have a half of the bus disabled here. Everyone always says so, ”comments the commentator who came up. - But usually no one shows documents from doctors. Well, what to do? I allow you to go. Tired of scandaling. I take all the risks on myself - in our instructions it is not written anywhere, what to do in cases of a disabled person.

The 45-year-old Galina has a third group of disability. It suffers from diabetes, encephalopathy, congenital heart disease. She does not have one kidney, she does not see and hears well, there are problems with the spine. A year ago, in the center of the city, the police detained the police in support of the protesting residents of Khabarovsk Nekrasov and broke their shoulder in the process. Pain still does not let go.

Due to problems with the heart and respiratory system, Galina begins to suffocate, barely putting on a medical mask in transport. Typically, trips to the center from the village for traffic jams take more than an hour. But even ten minutes in a mask become a test, says Nekrasova.

Rospotrebnadzor said that there are no exceptions to everyone who wears a mask. At least die, but there are no exceptions

Just the other day, in the clinic of the city hospital No. 2, she received a certificate, which she achieved for more than one month - it took numerous appeals to the doctors, to Rospotrebnadzor and the Ministry of Health. The document states that Nekrasova for medical reasons is contraindicated for a long -term wearing of the mask.

- This is the first certificate in the region. In Russia, if there is, then units. The Ministry of Health of the region told me that this is nonsense, not a single appeal. Because Rospotrebnadzor said that there are no exceptions to everyone who wears a mask. At least die, but there are no exceptions, ”says Nekrasova.

"The conductor screamed that I was abnormal"

Previously, during trips, Galina showed the conductors a disabled person and an extract from a cardiologist listing her diagnoses. In the extract about the impossibility of wearing a mask, there was not a word. In most cases, conductors react to documents calmly. But not always. In April, the driver and conductor of bus No. 14 tried to throw Nekrasovs into the street.

- On April 28, we had to go to the doctor. The story with the shoulder continues, it was necessary to a neurologist, I had a record. I drank painkillers before the trip. Let's go, bought tickets. And after a couple of stops, the conductor asked to put on a mask. I showed her an extract from the doctor, explained that I was very bad, I suffocate, the heat is worth it. And she stated that we would not go until I put on the mask. Like, in our country every second disabled person. She began to excite people.

“The driver said:“ Now we will call the police, ”and went outside with the phone,” Alexander recalls, he accompanied his wife on that trip. - Galina also began to call the police.

At this time, passengers, heated by the conductor, were already outraged loudly. “We shouted that we were abnormal, crazy, we infect everyone,” Galina recalls. Ten minutes later, the next bus came, which he took the passengers. And the Nekrasovs, together with the driver and the conductor, remained to wait for the police and an ambulance-Galina became very bad due to stress. The doctors made her an injection, and the police asked for twice, "I had a mental illness - the conductor screamed that I was abnormal." Galina did not get to the clinic that day.

We were called "covid", "contagious" - conductor, drivers and passengers

On May 10, there was again a scandal on the bus when Nekrasova was traveling, accompanied by her daughter. The bus was stopped somewhere on the outskirts, demanded the family to free the salon. Again I had to call an ambulance and the police.

“We were called“ covid ”,“ contagious ” - a conductor, drivers and passengers,” says Galina. - It happens that passengers stand up for me, but rarely. In the evenings, when people go home, tired, they can tell the conductor that you are already tired of masks, lag behind people. Men usually say that. And conductors do not want to conflict with men, lagging behind, but they mutter under their nose.

After the scandals, the Nekrasovs wrote an appeal to the Kaliningrad-Gortrans municipal enterprise, serving the 14th bus route, told about what happened and asked to clarify what to do if the disabled should go, and he could not wear a mask. However, they did not receive an answer from the enterprise. They turned to Rospotrebnadzor, where they were informed that there are no exceptions to wearing masks in public places.

“The conductions sent me to the clinic, they say, go, take the certificate officially to go without a mask,” says Nekrasova. In the clinic, both the attending physician and the head were refused. The document was issued only in the Kaliningrad Ministry of Health.

"They took the money, and then landed"

After the detention in August 2020, Nekrasov often happens not only in hospitals, but also in the prosecutor's office, in courts. For participation in the action #feed the pigeons, after which she received a fracture, she was also fined 10 thousand rubles. She tried to challenge the fine, but the Kaliningrad Regional Court left the decision of the Central District Court unchanged .

Galina’s disability pension is 8 thousand rubles. “And 10 thousand were forced to pay,” she says.

While Nekrasova was not able to achieve the initiation of the case against the police who damaged her shoulder. She repeatedly turned to the regional prosecutor's office, but there is no movement - they say that the performer "fell ill."

Now the family has appealed to the European Court of Human Rights, and he has already accepted the complaint. The applicant plans to challenge the fine and infliction of bodily harm.

This is the most political question that concerns everyone - both grandparents, and disabled people

In addition, Nekrasova filed a lawsuit against the Kaliningrad-Gortrans enterprise, in which she demanded a hundred thousand rubles as compensation for moral damage for being planted twice from the bus. In the lawsuit, she refers to the Constitution of the Russian Federation, guaranteeing the right to health and medical care, and the Federal Law "On the Basics of Protection of the Health of Citizens of the Russian Federation", which ensures the protection of citizens from discrimination due to the presence of any forms of diseases. The Central District Court has already accepted the lawsuit, it will be considered on August 11.

“We are fighting for the rights of all people with disabilities,” says lawyer Maria Bonzler . - Legists, cores, asthmatics - all who are contraindicated in the heat and stuffiness to put on masks. We will prove that disabled people also have rights. It turned out with the children - there was an order of the governor that children cannot be planted from transport if they do not have money for travel. Is it possible to disabled person? Moreover, they took money for travel from Galina. She paid for the passage, an agreement for transportation has already been concluded. And then they landed it. How to understand this? In the second case, they generally landed somewhere between stops. This issue needs to be resolved with "gortrans" in order to instruct that this cannot be done. You can not configure other people to a person. They can beat and kill is a disgusting story. This is the most political question that concerns everyone - grandparents, and disabled people. "In forensics, this is called strangulation"

The mask regime in public places was introduced by Rospotrebnadzor on October 27, 2020. The resolution "On additional measures to reduce the risks of the spread of COVID-19 during the seasonal increase in the incidence of acute respiratory viral infections and flu" obliges citizens to wear hygienic masks "in places of mass stay of people, in public transport, taxi, parking, in elevators." How to act to those who cannot be in a mask for health reasons are not indicated here.

It is impossible to oblige masks to wear, according to the head of the League of Patient Defenders Alexander Savensky . According to him, there are many complaints about the impossibility of wearing masks in public places, but Rospotrebnadzor does not make any exceptions for the disabled.

- What WHO says: a sick person should sit at home. But if he needs to go straight, he must put on a mask. And those who communicate with him should. Colleagues from Switzerland say: yes, wearing a mask is required there. But if there are contraindications, then you can not wear a certificate if there is a certificate. And 20% of the population have such certificates. And this is unrealistic with us, ”Saversky notes. - In the fall, we sent statements to Rospotrebnadzor from real people who wrote that they fainted in stores, in transport. This is physiology. In forensics, this is called strangulation. We attached complaints, reminded the story when in September in Kemerovo a woman died in a mask right on the street. But Rospotrebnadzor issued a decree on hygiene masks. And how to regard it? "Though you die all"? Therefore, it was necessary to act. We went to court.

Saversky was the initiator of the collective claim for Rospotrebnadzor to cancel the compulsory mask regime. The claim was signed by one and a half thousand people. However, on April 1, the Supreme Court of Russia rejected the lawsuit. The Rospotrebnadzor noted that the sanitary norms introduced from the coronavirus do not violate the rights of citizens. The opinion of Rospotrebnadzor was supported by the representative of the Prosecutor General’s Office, on June 28 the appeal will be held.

- In court, we appealed the very need for masks. Even at a meeting in the Supreme Court, one of the representatives of Rospotrebnadzor in the middle of his speech says: you can see the mask, to breathe hard, ”says Saversky.

According to him, in other regions, the Russians also received certificates similar to the one that they gave Nekrasova. But these were isolated cases.

“There were cases when institutions issued a certificate were also responded,” the expert notes. - In addition, for law enforcement agencies, these certificates mean nothing, this is an empty phrase. What is strange: a mask is a medical product, it must be registered, tests should be carried out, there are contraindications, efficiency and safety are checked - first of all, in relation to the carrier, and not to others. This woman, Galina Nekrasova, should she die for the benefit of others?

But we are not against masks, we are for reasonable use

-If we win in court, it will be clear that in any rules and laws there are exceptions, and people with disabilities can at least achieve something. So far they do not know where to go, ”says Galina. “But we are not against masks, we are for reasonable use.”

The Kaliningrad transport enterprises in their work are guided by the 134th Decree of the Regional Government of December 23, 2020, the head of the passenger transport department and the organization of the Roads of the Kaliningrad administration Alexander Khimich told North. It obliges citizens to wear masks in public places without exception.

I do not really believe that the conductor and driver could configure people against the passenger. In general, there are two truths here, I can't judge

- There is a specific indication: if a person does not comply with a mask regime, then we refuse the service. When introducing a mask regime, conflicts (in transport) were constant, up to the point that we stopped the bus, demanded that a person put on a mask or go out. And now people are used to it, there are fewer conflicts. I would appreciate what happened to Galina Nekrasova as a human factor - they asked a person, a person went to the principle, the second person went to the principle. But you can always agree. And I do not really believe that the conductor and driver could configure people against the passenger. In general, there are two truths here, I cannot judge. On this fact, I have already contacted the head of the Gortrans, he said that instructions would be carried out in addition to the employees to observe politeness in relation to passengers, especially since it is summer, hot, says Khimich. - The liability for violation of the mask regime among passengers is carried out by both drivers and managers of enterprises. Moreover, if a fine of 5 thousand rubles is applied to the driver, then the enterprise is both 50 and 100 thousand. And if there is a repeated violation - up to 90 days of suspension of activity. And raids are carried out regularly, two to three times a week.

The authorities of the regions declare a "critical" situation and crowded hospitals. Gradually, the subjects introduce compulsory vaccination from the Covid-19, which affects trading, catering, services, transport, healthcare and other categories.
