Medusa found out what the charge against Sergei Furgal was being built on. The testimony of the key witness looks unreliable

More than a year ago, on July 9, 2020, the Governor of the Khabarovsk Territory Sergei Furgal was detained near the house, delivered to Moscow, interrogated and arrested the next day. Furgal was charged with organizing two murders and one attempt. Then the Investigative Committee said that he had “irrefutable evidence” of the policy of the politician in the murder - but the investigation has not yet introduced them to the court. Meetings in this high -profile case, which led to large -scale protests, are held closed. Medusa managed to find out what testimony the charge against the former governor is being built: the editorial staff anonymously handed over the case materials; Their authenticity was confirmed by two sources familiar with the circumstances of the case. The former governor of the Khabarovsk Territory Sergei Furgal is accused of organizing two custom -made murders and one assassination attempt. All crimes dates back to 2004-2005, when Furgal was engaged in business: he collected and resold scrap metal in the Khabarovsk Territory.

Entrepreneur Evgeny Zoru Furgal, according to investigators, “ordered” due to the conflict around the hangar in the territory of the former reinforced concrete product plant (feasible, Oleg Bulatov’s former partner, allegedly because he knew about the murder of Zori and was going to blackmail the Furgal and his partner Nikolai Mistryukov . All this told the investigation - however, exclusively from the words of his friend - a former employee of the Khabarovsk criminal investigation department, a long -standing acquaintance and "roof" Vladimir Pershin.

The defendants in the case of a van

Sergei Furgal - the former governor of the Khabarovsk Territory, was arrested on July 9, 2020, is accused of organizing the murders of Evgeny Zori, Oleg Bulatov and the attempt on the murder of Alexander Smolsky. According to the UK , in 2004 he was already detained as a suspect in the murder of Zori, but then the criminal prosecution of the van was discontinued.

Nikolai Mistryukov is a former business partner of Furgal and his ex -wife Larisa Starodubova. He was in a pre-trial detention center from November 19, 2019 to September 10, 2020. The key witness of the prosecution, pleaded guilty to involvement in the murders and attempts and was transferred under house arrest.

Vladimir Pershin is a former employee of the criminal investigation department of Khabarovsk, convicted in 2016 for extortion. The key witness.

Andrey Karepov is a former employee of a van. Arrested on November 19, 2019, is in jail. Does not admit guilt.

Marat Kadyrov is a controller of Mendeleevo Airport on the Far Eastern Island of Kunashir. He was arrested on November 19, 2019, accused of throwing a grenade at the garage of entrepreneur Alexander Smolsky.

"Roof" van in the police

Former Khabarovsk criminal investigation officer Vladimir Pershin is a key witness against Sergei Furgal. His testimony formed the basis of a criminal case, and it is built on them almost entirely.

What connected the van with Pershin? From the story of Pershin, it follows that, working in the police, he was a “roof” of a furgal, which in the early 2000s was engaged in a scrap metal collection business: “So that the brothers are there, the criminal element does not interfere with the business so that they would not run into.” Protecting the business of the van, Pershin "traveled" to talk with representatives of local criminal groups. “Yes, these are mine, do not touch all,” he says in the testimony. “And everything was fine, we collaborated with them, there were no questions.” For his services, Pershin, according to him, received from Furgal and his business partner Nikolai Mistryukov (also accused in this criminal case) 30 thousand rubles a month.

In the late 2010s, Pershin left the police, engaged in car repair and in 2016 was convicted of extortion. He served three years and in 2019 came out conditionally. Once at large, Pershin immediately testified to Sergey Furgal-in July 2019 in the Khabarovsk Hotel Express Vostok. The first interrogation, as follows from the materials of the investigation, was recorded on the video, and it is very different from the rest: there Pershin sets out the story in his own words, and not in the state formulations that appeared in the case later.

It follows from the testimony that Pershin learned that Furgal and Mistryukov are the organizers of several custom-made murders, from Andrei Karepov, who worked for a van since the early 2000s and allegedly provided an intermediary during orders (before that Karepov was a bodyguard of the local criminal authority and informator Pershin). Karepov in his testimony says that he was friends with Pershin for 30 years. He even met Pershin at the entrance of the house after he returned from the colony. “I say:“ Andrey, I'm tired, I have no money. ” He gave me five thousand. Here. I say: “At least a beer drink”. Well, that’s all, we broke up. I’ll call you, he says, ”Pershin describes this meeting in his testimony.

However, the former assistant to Vargov Karepov does not admit participation in the organization of murders-and says that he helped the businessman only in the elections to the legislative Duma of the Khabarovsk Territory in 2005 and in the State Duma in 2007, where the Furgal was running from the LDPR. In 2004-2005, when these crimes were committed, Karepov was an assistant to the State Duma deputy from the LDPR Igor Lebedev, the son of Vladimir Zhirinovsky.

Pershin claims that Karepov told him about the circumstances of several murders, which became known from the news, and in a state of intoxication even called the executors of orders and their value. In addition, Pershin speaks of a certain note “In the Genre of the feuilleton”, which Karepov handed over to Furgalu and Misterukov in 2014. Pershin cannot remember the content of the note, but he believes that it was like a description of the murders.

Strange note

During the interrogation, Pershin says that in 2014 Karepov asked him to hand over to Furgal and his business partner Misterukov’s note, because he himself quarreled with them: they stopped paying his salary.

Pershin recalls that the note was written “in a comic form”: “like - well, what to call it? - In the Crocodile these articles, feuilleton, well, like a feuilleton. The text was such, well, everything is in a comic form about this murder, such as the fact that “conversation with Canadian”, and [the murdered entrepreneur] Zorya - I just knew - a citizen of Canada and Russia. For example, there with this - [killed, but not appearing in the business of an entrepreneur] Voitovich, such as that ... how is it? - “Conversation with blue,” for example. Pershin assumes that the note listed custom -made killings that organized Furgal with Mistryukov: “About eight or ten episodes”. Pershin took this note to Furgalu and Mistryukov and in words conveyed that Karepov was asking for 500 thousand dollars.

“Here, we went and sit ... He [Mistryukov] asks me:“ What is it? ” I say: “I don’t know, these are your affairs” ... - “Well, Canadian, well, this is probably Zorya.” So - once - looked at me ( shows how he looked at Furgal ). After that, Furgal allegedly exclaimed: “What, what?! You have to pay!”, Pershin recalls.

Pershin explains his motive against Furgal as follows: “I just do not want to see this person [Sergey Furgal] was in power, I know him too well for him to be a governor or so on. This is the abomination that will be crossed through a person, wrap his legs and forget. I am afraid that he can do such things, I now [in 2019] already see on TV what he is doing. I just see, guess, takes one from one, transfers the other from the other, and so on and so on, and what will happen next, by the end, I do not know, the Khabarovsk Territory gasped. Who else will he soak, who will he still kill, who will he still “order”? Maybe someone else will begin to order in Moscow? It’s easy to find with his money performer. I would say that this is mainly the reason ... I don’t want to twist with my soul to anyone, if he had not climbed into politics, I would be silent. I would not want such a person to control the people in the Khabarovsk Territory or in general in Russia. ”

Zorya fell ill

In 2004, Furgal and entrepreneur Yevgeny Zorya claimed one hangar with railway tracks, which remained from the building of the former plant in Khabarovsk. Both paid money for him and sued for the hangar in arbitration. The then working in the police, Pershin Furgal allegedly and asked "to do something with a visor." Pershin introduced Furgal to his friend Andrei Karepov.

Already after the murder of Zori in October 2004, Pershin allegedly learned from Karepov how this happened. In the testimony, Pershin says the following:

- I first saw on television that this was killed by Zora. Some time passed, Karepov calls me on the phone and says: “Zorya fell ill. He was very ill very, he probably will not survive. ” And then-again, by passing some time-we were with him [with Karepov], maybe in the car. Because Karepov was an amateur to take on the chest, to drink vodka and, in the process of this alcohol state, boasts with exploits. And he told me that, then, “I had a dawn for a long time, followed him for a month or a month and a half, searched for a convenient moment to deal with him.” Well, also in a conversation [said], so [how] was a little one, that the murder allegedly paid 40 thousand dollars for this.

- Who paid, to whom? - clarifies the investigator.

“I understood so that with a vang,” Pershin replies.

Pershin says about the performer like this: “I came across him, again ... I saw once for two to three minutes. So the name Andryusha climbed into my head. I don’t know ... for some reason ... it is the name. ”

Pershin claims that he met Andryusha in the auto-repair service of the former Khabarovsk police officer Anatoly Palea: Furgal and Mistryukov gave the KrAZ truck to repair, but he was not repaired on time, and then Andryusha took a picture on the phone of the mechanic, due to which the work was drawn. (True, Anatoly Palei at a confrontation stated that he had never owned car services, never repaired KrAZ Furgal and did not meet in any car service with Pershin.)

“Karepov, when he talked about the murder of [Zori], says the type that“ this Andryusha did something. ” And I praised Karepov before that, that, they say, what a young man, a pleasant communication, well, like in operational matters, he thinks how to get up, how to take it off, to imperceptibly. Well, Karepov later: “Well, Andryusha is well done, what a promising boy. Well, he did it, ”says Pershin.

- He did, what exactly? Speak with your tongue, ”the investigator clarifies.

- Killed. He committed the murder of this dawns. Like, you see, “what a good fellow he is,” everything is in this regard, ”Pershin explains.

He describes Pershin “Andryusha” fuzzy: it seems like a fair-haired one, in a sports cap, “a look like a Husky, a look-you look like in an abyss, like some kind of abyss, empty, empty, there is nothing human. Maybe ... fought, in Chechnya. "

According to Pershin, Furgal and Mistryukov ordered the murder of Zori, because "they were afraid to lose this hangar and were afraid to lose money." But he did not bring much money to partners: this hangar himself was filmed by Pershin himself under his business in trade in spare parts for 10-15 thousand rubles a month, and for about a year he paid only utility services.

Soon after the murder of Zori in 2004, Furgal, Mistryukov and another partner-the former district Central District Department of Internal Affairs of Khabarovsk Oleg Bulatov were detained in this case. However, all three were soon released, suspicions were removed from them . And a year later Oleg Bulatov was killed - and now they also accuse the van of this.

Bulatov. Andryusha him and ...

Bulatov was shot near his house in February 2005. Pershin says that the partners allegedly had “friction” due to the fact that Bulatov refused to sell metal at the right price, and then collected a certain “compromising material” on Furgal and Mistryukov and “almost blackmail” them.

-I wanted to either have a grandmother from them, or something else, but there was such a conversation. He wanted something from them, Karepov himself told me. I told him: “What did he want to earn money”? And he said: "No, he did not want it." But I assume that money, - so Pershin describes the motive of the murder.

- A certain time passed and I found out that Bulatov was killed, shot. I had an idea about the connection of his friction with the fact of the murder, ”Pershin says. - Then, around 2008 or in 2010, such a conversation took place. I remember how we drove in a car along Komsomolskaya Street, there was such a thick snow, large flakes, and he [Karepov] told me: Bulatova grazed for a long time, for a very long time. Then it turned out that in the morning he loves to go out at five to six in the morning for water. And he walks, he says, for water. Well, he says, “Andryusha is him and ...” Well, he says: Andryusha, whom you know with whom I met. Andryusha grazed him.

- This is the same Andrei, who was the murder performer of Zori? I understand you correctly? - clarifies the investigator.

- Yes. Because by the murder of Zori, Karepov also told me: “Here is such Andryusha well done. Executive boy, ”says Pershin.

On suspicion of the murder of Zori and Bulatov, in November 2019, Andrei Paley was detained (the namesake of the "owner of the car service" Anatoly Paley). In his testimony, Pershin says that about 2002 Andrei was detained for robbery and he spent some time in a pre -trial detention center, but, according to a close relative of Andrei Pale, he had never previously hit the pre -trial detention center.

Evidence of Paley's involvement in the murder of Zori is based only on the testimony of Pershin. At the first identification in 2019, Pershin was shown 55 photos, but he did not recognize Palea among them. He recognized him only after some time - already of four photographs.

However, from the materials of the criminal case it follows that Paley’s involvement in the murder of Bulatov is also confirmed by Witness Vladimir Nazarov, who in 2005 was next to the crime scene and saw the killer of Bulatov wrapped in a scarf (only his eyes were visible). “I remember the eyes of the attacked man poorly, I can’t describe them in more detail,” says Nazarov in the testimony.

Nevertheless, after 15 years, he identified Pales by his eyes - Medusa wrote about this in the fall of 2020. In the comments on the protocol of that identification, Andrei Paley noted that of the three statists, only he was alone in winter clothes, and the other two in shirts and shoes.

They threw grenades, but not killed

Another episode that is charged with Sergei Furgalus is an attempt on the murder of Alexander Smolsky: in 2004, two grenades were thrown at him next to his garage. Smolsky was a petty entrepreneur in the village of Progress of the Amur Region and was the son of the director of the local State Enterprise . Allegedly, thanks to his paternal relations, he complicated the business of Furgal and Mistryukov, who opened the scrap metal intake in those parts.

Here's how Pershin tells - again, from the words, everything denying Karepov is about the involvement of Furgal and Mistryukov in this attempt:

- And here he [Karepov] told me: "Remember this boy, [son] director of the GRES?" Well, of course, I remember, I say, but I have not seen him in the face. What is it? "Yes, he was thrown with grenades, but not killed, thank God!" There was such a conversation, "but not killed."

- What does it mean by grenades threw? Who threw it? - clarifies the investigator.

-What was thrown out of these matters [conflict with Mistryukov and Furgal] is definitely. Here ... Well, because there were interference to business. And who threw? Well, most likely, Andrei himself is “big”, that is, Karepov. This is what he told me, but did not call who threw.

In November 2019, however, on suspicion of attempted murder of Smolsky, a 54-year-old employee of the airport of Yuzhno-Sakhalinsk Marat Kadyrov was detained. Pershin identified him as a “full -time killer” of the Khabarovsk criminal group, who worked in the “gray horse” cafe. But Kadyrov in his testimony said that he had never worked there.

- So who did the order come from? Explain, otherwise it is not clear, ”the investigator clarifies.

“From Mistryukov and Vargal ... Karepov himself did not call the customer, but ... he [Mistryukov] complained to me, like, my son of this director of Graz got me,” says Pershin.

I don't know, but I claim

In his testimony, Pershin talks about several murders that he connects with Furgal.

- Do you claim that Furgal and Mistryukov are involved not only in the murder of dawns, but also in other episodes? I understand you correctly? - asks his investigator.

“Correctly you called the word - I affirm, I don’t know, but I claim,” says Pershin.

For example, according to Pershin, Mr. In the early 2000s, Mistryukov had problems repairing his boat garage in Vladivostok: builders worked poorly there. Then a certain Zhenya, at the request of Mistryukov, went to talk with the builder Serega, who suddenly appeared to meet with two “bitten” men with bits. Then Zhenya allegedly "took out a machine gun from the car and laid all three."

На вопрос следователя о стоимости этого убийства Першин отвечает так:

— Разговор был такой. Я говорю: «А вот за исполнение заказа деньги какие-то платятся? А сколько вот интересно за Войтовича?» А он [Карепов] отвечает: «Ну ты же цену знаешь». Я ответил, что занимался киллерами и тридцатку тогда стоило, а сейчас — не знаю. Он ответил, что «так и осталось». Я еще уточнил, в долларах ли это, на что он ответил: «В долларах».

Кроме того, по словам Першина, однажды Карепов показал ему оружие — СВД [снайперская винтовка Драгунова], пистолет Стечкина, ТТ и барабанный револьвер — «все, правда, без патронов» — и рассказал, что один раз был в Дагестане и два раза в Донецке. Исходя из этого, Першин решил, что Карепов торгует оружием.

— А из чего вы сделали такой вывод? — уточняет у него следователь.

— Ну, во-первых, я видел это оружие сам, лично. А во-вторых — а что туда [в Дагестан] ездить? Вот я с Дальнего Востока, что мне там делать? В том же Дагестане или Чечне, Донецке? — говорит Першин.

Следователь уточняет у Першина, рассказывал ли ему Карепов о «конкретных своих действиях, которые он выполнял в организации данных преступлений».

— Нет, — отвечает Першин.

— Ничего не рассказывал? — снова уточняет следователь.

— Ничего не рассказывал, — отвечает Першин. — Он просто рассказывал, как произошло и все.

Другие показан ия Першина

В марте 2020-го — примерно через год после освобождения и первого разговора с правоохранительными органами о возможной причастности Фургала к убийствам — Першин дал новые показания в Следственном комитете по Хабаровскому краю; на этот раз — без видеофиксации. Эти заявления заметно отличаются от прежних своими официозными формулировками. Более того, если на видео Першин говорит, что Карепов рассказывал о том, что «Зорю пасли», то без видео — что «Зорю мы давно пасли». Подробнее описан и мотив убийства Булатова: якобы бизнесмен знал, что Фургал и Мистрюков «заказали» Зорю, и шантажировал партнеров.

В первых показаниях Першин пересказывает слова Карепова о Смольском так: «Закидали гранатами, но не убили, слава богу». В новых письменных показаниях, по словам Першина, Карепов пересказывает события уже иначе: «Сказал, что этого сынка начальника ГРЭС подорвали, он затих, больше никуда не рыпается, согласился на условия Фургала С. И. и Мистрюкова Н. В.». Якобы Карепов также говорил Першину, что ездил в Амурскую область, чтобы «подготовиться» к этому преступлению.

Содержание записки , которую Першин передал Фургалу и Мистрюкову, в новых показаниях тоже описано по-другому: появляются новые словосочетания, например, «меч булатный» (видимо, имеется в виду убийство Олега Булатова) и «разговор с сыночком начальника ГРЭС» (подразумевается покушение на Смольского).

Кроме того, Першин говорит, что Карепов признался ему в том, что хотел взорвать «владельца автосервиса» Анатолия Палея за неотремонтированный КрАЗ Фургала — но якобы по ошибке взорвал другого человека, который остался «калекой».

Мистрюков в «шоковом состоянии»

19 ноября 2019 года по делу об убийстве Зори и Булатова и покушении на Смольского были арестованы Андрей Карепов, Андрей Палей и Марат Кадыров. None of them pleaded guilty. Карепов все это время утверждает, что никогда не занимался «силовым блоком» (организацией убийств и покушений), а Мистрюков и Фургал «обращались к нему с желанием стать депутатами законодательной думы Хабаровского края, в чем он активно им помогал».

Помимо Першина показания на Фургала как на организатора преступлений дал его бывший партнер Николай Мистрюков. Он также был арестован по этим делам 19 ноября 2019 года. Сначала Мистрюков вину не признавал; на очной ставке с Першиным говорил, что не подтверждает его слова. Но уже через несколько дней заявил, что готов рассказать о своей роли в преступлении.

Мистрюков на очных ставках

19 ноября у Мистрюкова была очная ставка со Смольским. Он утверждал, что у него с Фургалом и Мистрюковым был конфликт из-за закупочных цен на металл — и партнеры однажды ему даже угрожали. Смольский выразил уверенность, что покушение на него организовали Фургал и Мистрюков, потому что других конфликтов у него не было. Мистрюков все это отрицал.

20 ноября у Мистрюкова была очная ставка с Першиным. Першин на ней говорил, что от своего «источника» знает, что Мистрюков и Фургал — заказчики убийств Зори и Булатова и покушения на Смольского. Мистрюков это отрицал. Адвокат Мистрюкова Эдуард Чургулия пытался задавать Першину уточняющие вопросы, но следователь почти все их снял.

21 ноября к Мистрюкову приехал адвокат из Хабаровска Александр Лобода, после чего Мистрюков написал ходатайство, что готов давать показания.

Мистрюков дал признательные показания по одному из эпизодов: якобы он пожаловался Карепову на Смольского, а тот попросил небольшую сумму денег; после того, как гранаты были взорваны, Карепов пришел к Мистрюкову и сказал, что «дело сделано» — и на этот раз попросил миллион рублей. Мистрюков говорит, что был «в шоковом состоянии» и спрашивал Карепова, «кто ж тебя просил взрывать». Фургал обо всем этом не знал, уточнял в тех показаниях Мистрюков.

В первую неделю после ареста Мистрюкова защищал нанятый его женой адвокат Эдуард Чургулия. 26 ноября 2019 года в дело вступил Алексей Ульянов — у него репутация адвоката, «плотно сотрудничавшего со следствием» (подробнее об Ульянове «Медуза» писала здесь ). В тот же день Мистрюков с Ульяновым подписали досудебное соглашение о сотрудничестве — и бывший партнер Фургала начал давать развернутые признательные показания, почти дословно повторяя свидетельства Першина. Тогда Мистрюков, в частности, впервые заявил, что Фургал был в курсе всего, а через полгода и вовсе приписал Фургалу «лидирующую роль» в убийствах.

Показания Мистрюкова (26.11)

Мистрюков говорит, что у него и Фургала был конфликт с Евгением Зорей из-за ангара и подъездных путей к нему. «Зоря пообещал нас обоих устранить. После этого конфликта мы побежали к нашему знакомому, милиционеру, Владимиру Николаевичу Першину. Он выслушал, сказал, что знает, кто нам поможет: „Лучше всего вам поможет Андрей. Пускай занимается“. Тогда мы и познакомились с Кареповым. Мы обратились к Карепову, он сказал, что „проблема решаема“. Сперва была проблема решаема, мы как-то не обговаривали, а потом он уже сказал, что надо устранять, по-другому уже не получится. Ну, и мы все согласились, устранили. А после того, как Зорю расстреляли, он пришел и сказал: „проблема решена“, вы должны вот столько-то денег».

Рассказывая об убийстве Булатова, Мистрюков говорит, что «Булатов каким-то образом узнал про эту ситуацию с Зорей. Узнал или догадывался и постоянно шантажировал нас — показывал, что знает о наших ролях с Сергеем Ивановичем. Его задерживали перед этим вместе с нами в милиции. Почему его задержали вместе с нами, мы сперва не поняли, а потом на следующей неделе он нам намекнул, что прекрасно понимает и знает, из-за чего нас задержали, мол, вы ребята не расслабляйтесь, как-то так. Мы предприняли такие действия: не ждать ситуации и заказать Булатова Олега. Он собирался открывать участки и заниматься своим личным бизнесом, мы этого тоже не хотели допустить».

По словам Мистрюкова, партнеры снова обратились к Карепову, заплатили ему миллион рублей, Булатова застрелили, еще несколько лет они оплачивали дочери Булатова обучение в университете.

К делу Мистрюкова подшито обращение адвоката Чургулии к главе Следственного комитета Александру Бастрыкину. В нем он пишет, что 27 ноября пришел к Мистрюкову в СИЗО и тот рассказал ему, « что 26 ноября с ним проводились следственные действия — допрос, на него было оказано психологическое давление, чтобы он подписал досудебное соглашение, намерения подписывать которое у него не имелось»: «Мистрюков сообщил мне, что на него психологически давят и требуют, чтобы он отказался от меня как от защитника, поскольку линия защиты не устраивает следствие. Пояснил, что в условиях изоляции в СИЗО Лефортово не может больше сопротивляться давлению и вынужден подписывать протоколы, которые ему предоставляет следователь, при этом настаивать на моем участии он опасается ввиду угроз и давления». Тогда же, вечером 27 ноября, Чургулия получил письмо о том, что Мистрюков отказывается от его услуг и просит оставить только адвоката Ульянова.

С помощью адвоката Ульянова Мистрюков, находясь под арестом, продал свою долю завода «Амурсталь», которой владел вместе с бывшей женой Фургала Ларисой Стародубовой, другому партнеру — Павлу Бальскому. «Он [Мистрюков] считал, что ему осталось [жить] лет пять максимум, а Наталья, его жена, всю жизнь была домохозяйкой, он хотел о ней позаботиться», — объясняет «Медузе» источник, общавшийся в то время с семьей Мистрюкова. Кроме того, у Мистрюкова трое несовершеннолетних детей.

В сентябре 2020 года Мистрюкова перевели из СИЗО под домашний арест, но адвокат Ульянов тогда объяснил изменение меры пресечения подзащитного состоянием его здоровья, а не сделкой со следствием. У Мистрюкова диагностирован рак органов малого таза; он ослеп на один глаз из-за отслоения сетчатки.

Сергей Фургал в своих показаниях по делу в августе 2020 года заявляет, что «ни прямо, ни косвенно не участвовал в лишении жизни людей, о которых говорится в материалах дела», что дело «инспирировано лицами, заинтересованными в [его] устранении с должности губернатора Хабаровского края, а Мистрюков оговаривает его». Фургал отмечает, что Мистрюков произвел на него «впечатление подавленного и сломленного человека с подорванным здоровьем».

Фургал говорит, что следствие оказывает на него «систематическое давление», то угрожая привлечь к ответственности бывшую жену Ларису Стародубову, то показывая ему якобы заключенное Кареповым досудебное соглашение со следствием, где он дает показания о причастности Фургала к убийствам.
