The ninth is accused of using violence against a representative of the authorities, dangerous to life and health (part 2 of article 318 of the Criminal Code). On June 8, the judge of the Oktyabrsky Court, Roman Kalitko, was supposed to pass sentence on the Ninth, but he was not taken to the hearing. The same situation occurred on June 23 and July 27. “It is forbidden to listen to the cases of the first instance via videoconferencing, therefore the Ninth is needed at the meeting in person,” the press service of the St. Petersburg courts emphasized.

In this regard, Kalitko, according to the publication, sent a request to the pre-trial detention center to find out where the accused is and why he is not being brought to court. Later, the judge received a response signed by the acting head of the tuberculosis hospital , Mishchenko: “Ninth has no illnesses, does not need treatment.”

In the same response, according to Fontanka, Mishchenko referred to the plan to combat coronavirus in the St. Petersburg institutions of the Federal Penitentiary Service, which prohibits the removal of the defendants for investigative actions.

On June 23, Judge Kalitko ruled that Devyaty be transferred to SIZO-1 Kresty in order to ensure his participation in the proceedings. An employee of the Gorelovo pre-trial detention center and an interlocutor of the publication at the Federal Penitentiary Service stated that the information about the impossibility of bringing the Ninth to the court, as well as about the illegal actions of his cellmates, is not true.

The press service of the courts told Fontanka that the Oktyabrsky Court “lost” the Ninth after the hearing on May 25: “The information about the defendant’s illness is not true. On March 18, he attended the meeting in person, and on June 8 he had no medical contraindications, which follows from the written response of the acting head of the SIZO-6 tuberculosis hospital.”

The next hearing in the case of the Ninth is scheduled for August 5.
