The nurse who died from Covid was left without money and after death

For more than a year now, Mary Tychko has not been alive: a 30-year-old nurse of the St. Petersburg hospital for war veterans died of Covid on April 15, 2020. And her parents still cannot achieve the posthumous payments promised by the president. This spring, the elderly had to go to court. But even six months later, he refused the Tumpki's spouses on absurd grounds (under the absurd pretext).

She talked about the tragedy of the Tyshko family. Masha was the only, late and painful, child with her parents. Since childhood, I did not get out of doctors from the offices and also began to dream of a doctor’s work. After school, she entered a medical school (she did not risk immediately at the university), after graduating she got a job in a hospital for war veterans, but was about to continue to study and receive a higher medical education.

Last spring, a hospital for war veterans became one of several St. Petersburg hospitals who took on the main (main) coronavirus blow. As a result, at least two -thirds of employees were ill with Covid. Maria Tyshko did not escape infection either. The weakened body of the girl did not resist long:

On March 31, she felt the first symptoms of the disease, and two weeks later she died in the intensive care of the same hospital where she worked.

Until September 2020, the father and mother of Maria could not receive any documents from the medical institution about the infection and death of her daughter, and, accordingly, cash payments due to relatives under the law. Having exhausted their own capabilities, they turned to lawyers and journalists for help. After publications in the media, the prosecutor's office of the Nevsky district of St. Petersburg conducted an audit and issued a representation of the city administration. When checking, it was confirmed that Maria Tleshko had direct contact with the patients sick with Covid and the hospital staff, and there was a direct threat of infection.

The act of recognition of Mary “the victim due to assistance to patients who had a new coronavirus infection” received the parents of the deceased on the same day as compensation from the city (1 million rubles) on October 23. If all the laws in our country were executed in a timely manner and strictly, then the spouses of Tyshko would also transfer federal compensation (2 million 752 thousand rubles), provided for by Presidential Decree No. 313 of May 6, 2020. But we have not yet survived this beautiful Russia, so the orphaned parents had to personally contact the Social Insurance Fund (FSS) for payment. However, this actions did not take it. Then Tyshko filed a lawsuit in the Petrograd District Court (at the place of registration of the defendant).

The case was considered for almost six months. According to the law, to receive payment, it is enough to prove that the health worker picked up a coronavirus infection in the performance of his labor (official) duties. Back in October, the commission admitted that Pumpkin was infected with coronavirus precisely at work, “when assisting patients who have Covid-19.” This conclusion was enough for the city authorities, but not for federal ones.

“The Social Insurance Fund“ improved ”the law and in court explained the reason for the failure of the Tyshko family in payment: it is supposedly necessary to prove the fact that Maria was infected by Covid directly from the patient,” Georgy Tyvosov, a lawyer representing the interests of Tyshko, commented on the “new”. -And this is almost impossible to establish and prove this: from whom specifically a person is infected with coronavirus in a situation when he is in contact with a large number of COVID-19 patients and health workers, among which there are also infected by him.

However, the judge of the Petrograd District Court, Julia Peshnina, took the position of the defendant and refused to the spouses of Tyshko in the lawsuit.

In the near future, they intend to appeal this decision.

According to lawyers, Tyshko found themselves in a difficult situation, since in St. Petersburg such things have not yet been considered:

“There are no precedents, so it is more difficult for the pioneers in the northern capital to prove their innocence,” Tyvosov says. - However, in other regions of Russia (in the Oryol, Tomsk, Tambov regions, in Khakassia, in the Altai Territory, etc.), similar trials have already passed and in all cases ended in favor of the plaintiffs.
