The court awarded compensation to a pensioner for illegal prosecution in the case of justifying terrorism

The Central District Court of Chelyabinsk recovered 60 thousand rubles in favor of pensioner Galina Gorina, who was illegally prosecuted under the article on justifying terrorism. This was reported by the “Network Freedoms” telegram channel.

In July 2019, a criminal case was opened against Gorina under Article 205.2 of the Criminal Code (public justification of terrorism). The reason was the repost of news on VKontakte about the suicide bombing of a teenager from Arkhangelsk, Mikhail Zhlobitsky, in the building of the local FSB, which was carried out by a pensioner. Gorina commented on her publication as follows: “What is it, our children are dying!”

In December of the same year, the case was closed due to the lack of evidence of a crime. “Network Freedoms” note: the investigation considered that Gorina “does not express her attitude to this event in the form of additional comments.”

The pensioner filed a claim for compensation for moral damages for unlawful criminal prosecution. Gorina demanded to recover 360 thousand rubles in her favor. The court reduced the amount of compensation six times.

• From July to December 2020, Gorina was in the status of a suspect; people came to search her. A psychological and linguistic examination conducted at the initiative of the Investigative Committee found signs of justification for a terrorist act. However, the investigation was unable to establish the presence of criminal intent on Gorina’s part and dropped the case.
• On the morning of October 31, 2018, in the FSB building in Arkhangelsk, 17-year-old local resident Mikhail Zhlobitsky detonated a bomb. Three employees were injured, the young man himself died. A few minutes before the explosion, a message about the attack appeared in the telegram open chat of People's Self-Defense. A criminal case has been opened regarding a terrorist attack.
• Also, more than 30 criminal cases have already been opened to justify terrorism due to comments about Zhlobitsky’s act. At least eight people were sentenced to real terms.
