In Kazan, the court upheld the fine under the article on fakes to the former head of Navalny’s headquarters

The Privolzhsky District Court of Kazan upheld the fine imposed on the former head of Navalny's local headquarters, Oleg Yemelyanov, because of a video in which he discusses the legality of holding actions without the sanction of the authorities. This is reported by the telegram channel "Network freedoms".

In July, the justice of the peace found Emelyanov guilty under the article on the dissemination of false information that poses a threat to the lives of citizens (part 9 of article 13.15 of the Code of Administrative Offenses), and fined him 30 thousand rubles.

According to the protocol, Yemelyanov, commenting on the rallies on January 23 and 31, “reported that the actions were a peaceful protest, and the concept of unauthorized rallies does not exist.” The court considered this information "fake".

In the video, because of which an administrative case was opened, the oppositionist reflected that holding public events is in accordance with the Constitution, regardless of the approval of the action by the authorities. “When we go to the executive committee, we submit a notification about the event. This is precisely a notification, that is, we tell the city authorities that the action will take place there, we ask you to ensure safety. This is not a request to let us go, this is information. Officials cannot forbid anything, they can only suggest a different place or time,” the activist said.

The police considered that the video contributed to "creating the belief that citizens can freely conduct public events, not based on federal laws and restrictions." “Emelyanov’s statements that he expressed his opinion and believes that the information provided is reliable does not constitute grounds for terminating the proceedings,” the court of first instance noted.

The Network Freedoms project, which defends the interests of Yemelyanov in the framework of the case, emphasized that their lawyers will appeal the court's decision to the ECtHR.
