“We just stand here, observe,” one of the bailiffs joked before the meeting.
However, more from employees were not required. Neither the supporters of the “male state” or its opponents came to court. The founder of the movement Vladislav Pozdnyakov did not appear at the meeting either: he left Russia after he received a conditional term for “exciting hatred for women” at the end of 2018 (in 2019, the verdict was canceled due to partial decriminalization of the article on extremism).
Pozdnyakova in court was represented by lawyer Dzambolat Gabaraev, who had not previously participated in high -profile processes.
- Where is Pozdnyakov now? - said Judge Anna Belova.
“I can't call you this, your honor.”
- Reason?
- I myself do not know where he is.
The other two defendants in the case - the former Nizhny Novgorod activists MG Dmitry Gubanov and Igor Nosov - did not appear in court either. However, Nosov sent a letter to the court in which he announced that he was heavily ill with coronavirus, but would like to speak at the meeting - and asked to transfer him. Pozdnyakov, on his telegram channel, specified that he was not familiar with the nasal, and suggested that this was just his “random subscriber”.
The lawyer Gabaraev also asked to postpone the meeting. He noted that he did not have time to get acquainted with the case file from 600 pages. He also asked to organize a video conferences with Pozdnyakov in court. Despite these objections, to which the prosecutor Roman Yashin joined, Judge Belova decided to consider the case without the participation of the organizers of the MG.
Then the prosecutor said that the “male state” “arose in 2015 as a group of“ VKontakte ”, which conducted massive information attacks on women. Yashin added that at that time Pozdnyakov himself “recruited supporters” in different regions via the Internet.
After that, the prosecutor reminded of some “shares” of the “male state”. Yashin emphasized that activists not only promoted “ideas of superiority on the sexual basis”, but “excited enmity and hatred by racial principle”. He also recalled that four supporters of MG have already received real terms for the creation of an extremist community (separate from Pozdnyakov).
In response to this, lawyer Dzambolat Gabaraev pointed out that, according to his assessment, MG supporters did not “promote racial hatred,” but only “opposed the propaganda of non -traditional sexual relations among minors”.
-In general, it is impossible to consider [MG] a public organization, since it is, in fact, a telegram channel with information to which Vladislav Pozdnyakov has nothing to do with June 2020. In real life, no harm came from these messages. They [supporters of MG] advocate traditional values, for a healthy family, children. They are adherents of a sound lifestyle, ”the lawyer said.
Separately, the lawyer added that the women whom MG participants criticized on social networks “themselves discredited the population of Russia” with their behavior.
After that, Gabaraev went deep into his own understanding of biology and anthropology. From his words followed: a) there are more and more homosexuals; b) there are more of them because of the "propaganda of non-traditional relationships." MG members did not like this, the lawyer convinced the court.
Judge Belova, in turn, studied as evidence the appeal of the former State Duma deputy Oksana Pushkina in the name of the Prosecutor General Igor Krasnov, in which she asked to check the “male state” for extremism. Also in the case were appeals from women who suffered from bullying from the associates of Pozdnyakov. The operatives of the EC center, in turn, described the ideology of MG as a “radical patriarchy” in their certificate. They called the goal of the organization "Changing the Constitutional system of the country."
While in court they read certificates from the Ministry of Internal Affairs, Vladislav Pozdnyakov himself gave comments to reporters and said that he was not going to return to Russia until the FSIN was recognized as an extremist community.
In the debate, the prosecutor briefly retold his position. And the lawyer Gabaraev quoted Vladimir Putin: “There was not, there is and will not be anything related to the restrictions on the rights on the racial basis, by sexual orientation, by nationality, and religious by some signs.”
After that, Judge Belova retired to the deliberation room. And she spent only five minutes there. Returning to the meeting room, Belova completely satisfied the claim of the prosecutor. “The court decision is subject to immediate execution,” the judge summed up.
Despite such an outcome of the meeting, Pozdnyakov publicly urged his supporters to support Gabaraev, since opponents of the MG activity brought down a lawyer’s rating on one of the customers reviews. Separately, Pozdnyakov emphasized that Gabaraev defended MG for free.
And the lawyer himself promised to appeal the decision - and stated that no one heard his requests for the justice of the trial.
