The ex-official said to his lawyers: “At lunchtime, six employees ran in the 13th camera of Shizo, twisted my hands, damaging the tendon of the right shoulder. The head of the pre-trial detention center-1 Lebedev inflicted three blows to me in the face, after the third blow I lost consciousness for a short time. ”
In the FSIN, the information about the beating, of course, was called "inappropriate reality." But, more interestingly, even earlier, the beating “refuted” the chairman of the Tver Public Supervisory Commission (PMC) Vladimir Palamarchuk. Without even seeing Shestun personally, he said that physical strength was not applied to him.
With rare exceptions, the regional PMCs now work on the principle of "I do not see, I do not hear." The security forces who ousted human rights defenders from observation commissions sometimes perceive direct violence as a norm.
Tverskaya PMC translates in the press extremely positive information about the work of the FSIN. If the prisoner or his relatives report the beating, violation of rights, mockery, the PMC reports that there was an error.

They began to understand the statement that there were no complaints to the colony administration. He simply, according to his customs, cannot remove him, sweep, wash the camera, toilet. But the refusal of this is a gross violation of the regime, and it will be expelled for this in the penalty area.

There was a complaint from the Rzhev colony. More recently, the leadership changed there, and some of the convicts tried to compromise it. When they began to understand, they realized that there was no ground for complaints. And another vivid example of the proceedings.
More recently, an employee of the region’s administration, whose son was in the Bezhetskaya colony, and supposedly to his son, the biased attitude of the head of the colony, and we carefully examined her. They invited the head of the IR, prosecutor to the conversation, invited members of the commission, parents - they listened to everyone. And ultimately they convinced his father that he only harms his offspring with such protection. ”
Activist Artem Vyzhenkov ( the Ministry of Justice included him in the list of individuals-enactents ) says that he did not succeed in getting into the PMC. Officially - there was no organization that would agree to nominate it. Once after the winter shares in support of Alexei Navalny in a special -reception, he actively fixed the living conditions.
- All the facts of terrible conditions gave publicity, wrote statements, told through the media. But the PMC did not notice this. I managed to fix the conditions in the special receiver, not even being part of the PMC. There were many years, but the PMC did not notice them, says Vyzhenkov.

Chelyabinsk PMC is one of those who "sees nothing." In June 2019, two prisoners of correctional colony No. 2 recorded video features in which they talked about threats by the colony employees, etc. thieves. They said that they were not allowed to see their relatives, take money, beat, they are unjustly sent to a schizo. In September 2020, three days after the visit of Katan to the SIZO-3, the nationalist Maxim Martsinkevich was found dead in the isolator chamber. Traces of violent death were discovered on his body. “When we were in the insulator, everything was fine, no one made us complaints,” Katane said on the day of the death of Martsinkevich.
According to human rights activist Denis Ibragimov, to the present moment from the Chelyabinsk PMC “squeezed out all independent members”, only people remained convenient for the authorities and security forces remained.
According to information from the website of the Public Chamber of the Chelyabinsk Region, three of the eleven members of the observation commission - former security forces, there are also a Cossack, pop, forensic expert, representatives of the blind companies injured from radiation, and experts in the field of HIV prevention. There are no human rights activists.

Sergey Ukhov was five years as chairman of the public control group under the Public Chamber of the Perm Territory and a member of the PMC, but did not get into the current composition of the commission because he was the coordinator of the Perm Navalnovites at the time of selection.
“The PMC was turned into an open structure that exists only to go to meetings of the GUFSIN and the Ministry of Internal Affairs and say that everything is fine in the colonies and special receivers.
We learn about the real situation from federal news. In the Solikamsk IK-9 (where last fall, two prisoners committed suicide against the backdrop of bullying) the commission went when it was no longer possible to shut up the situation, and even after the trip, the chairman of the Sitnikov commission tries to justify the colony administration and write off the conflict for the “criminal culture”. And according to the last incident in IK-10 , where the just arrived prisoner had cut off his head in production, there is no official information from the PMC. This case is engaged in the same member of the PMC Oksana Asaulenko, ”Ukhov is indignant.
For the editor of the newspaper Perm, Oksana Asaulenko, this is the first convocation in the PMC. “Therefore, they took that my surname is new, there are many new ones in this commission,” the journalist explains. She is one of the most active members of the PMC: attends institutions, comments a lot and talks about colonies, pre -trial detention centers, and problems of specific prisoners. “As a journalist, I can raise a public resonance - sometimes they react to this, but the work of the PMC - conclusions, appeals, correspondence with the prosecutor's office for supervision, GU FSIN - brings little result. Appeals and complaints of convicts - shaft. For each violation of rights - illegal disciplinary sanction, non -ordering of medical care - to any (!) You need to apply to the court. The prosecutor's office for supervision issues its instructions on the living conditions. But when the basic human rights are not respected - the right to life and health - is it so important that, for example, the window was insulated? The main thing, after all, that a person is alive and healthy from prison. The PMC can carry out different work, can help in equipment. But when there are few people, you do not even have time to work out even cases of death. In two years, we have not visited all institutions yet. The PMC has a very large functionality, and only a few people work. ”
The basis of the Samara PMC is former security forces and members of veteran organizations, among them - the chairman of the commission Dmitry Shtokov.
The main activity of the commission, judging by the news feed of the local FSIN, boils down to the same trips on correctional institutions, meetings with relatives of convicts and joint meetings with security forces. Each of the events most often ends with a dry phrase: "Citizens were given legally verified answers." Social activists have had no complaints about the work of security forces over the past two years.
According to the Samara human rights activist and lawyer Andrei Sokolov, the local PMC was never interested in the conditions of maintaining convicts in correctional institutions. The real activity of the commission, in his opinion, is possible only with the admission of independent human rights activists and lawyers to it.
“For my 22-year work experience, I can say that the criminal-penal system has never felt the influence of the PMC.
The commission itself, as a rule, includes former security forces who do not quite understand their work and always act in the interests of former colleagues. In fact, they simulate activities, limited to unsubscribes and appeals into power structures, ”Andrei Sokolov told Novye.
Also this year, the Samara PMC fell into a scandal associated with the conditions of the content of the Krasnodar Alexander Ishin. At the end of April 2020, to him and eight families of Jehovah's Witnesses ( the organization was recognized by the Supreme Court of Extremist and is banned in Russia ) from the villages of Pavlovskaya and Kholmskaya came with the searches of the FSB. Already in February of this year, the Abinsky District Court of the Krasnodar Territory found a 63-year-old man guilty of organizing the activities of an extremist organization (part 1 of article 282.2 of the Criminal Code) and sentenced him to seven and a half years of the colony. According to investigators, Ivshin organized in Abinsk worships on video communications with joint singing of biblical songs.

The man spent the beginning of March in the investigative insulators of Novorossiysk, Krasnodar and Volgograd, and on March 18 he was transported to the Samara region. The first stop is the Syzran SIZO-2, but already in April it was transferred to the pre-trial detention center-4 to Togliatti, where he spent a month, and on May 25 he was returned back to Syzran. Ivshin spent almost a thousand kilometers from the house all spring. This outraged human rights activists and relatives of the convict who sent an appeal to the Samara PMC. The deputy chairman of the commission Nikolai Gerasimov answered. Referring to Part 1 of Art. 73 of the Criminal Code, he stated that “persons convicted of crimes under Part 1 of Art. 282.2 of the Criminal Code, are sent to serving sentences to correctional institutions determined by the federal body of the penal system. ” At the end of the letter, Gerasimov did not exclude the possibility of transferring Ivshin into correctional institutions close to relatives, but with this issue he proposed contacting the Moscow Department of the Federal Penitentiary Service. On May 30, Ishin was transported to Ryazan. And from June 9, it is contained in the Rostov-on-on-Don SIZO-5.
Also in 2014, the Samara PMC did not allow the chief editor of Echo of Moscow in Samara Sergey Kurta-Ajiev and his colleague Sergei Lebgrad. They were invited to the commission of the commission, which in those years, the post of regional Commissioner for Human Rights, Irina Skupova, but subsequently occupied the places of “proven personnel”.

At the end of September, lawyer Emil Kurbedinov appealed to the Rostov PMC, the Main Directorate of the FSIN and the Rostov Prosecutor's Office with complaints of unsanitary conditions, rats, insects and coercion to voting, which were encountered by the Crimean Tatar prisoners in the Novocherkassk Diloen-3. Kurbedinov told Novye that this is not the first appeal to the PMC on his part: “We regularly turn, they visit, give a conclusion. As a rule, this, of course, affects. ” According to the situation in the SIZO-3, the answer has yet come from the FSIN: they stated that they did not find violations.

«Поступило обращение, например, о неоказании медицинской помощи. Мы созвонились с ней <Кузьменко>, выяснили в течение пары часов, что с этим человеком. И если эта помощь нужна в условиях конкретного учреждения, выходит врач, делает все, что нужно. Если нет лекарств, мы связываемся с родственниками, они приносят. Если нет родственников, мы сами передаем — у нас есть, грубо говоря, свой фонд», — рассказывает председатель пятого созыва областной ОНК Игорь Омельченко.
Несмотря на такой формат взаимодействия, по словам правозащитника, сейчас вопросы прессинга заключенных из-за обращений возникают редко и быстро решаются: «Недавно было обращение по одному товарищу, вроде как конфликт с администрацией урегулировали, но она начала его прессовать через подконтрольных <заключенных>. Позвонила родственница, рассказала об этом, и мы урегулировали ситуацию другим способом, и сейчас все хорошо, никаких откосов нет».
Председатель считает, что все дело в правильно выстроенной цели ОНК: не наказать сотрудника, который что-то не досмотрел, а помочь тем, кто нуждается в помощи.
Из-за этого и появилась налаженная коммуникация с новым руководством. К слову, именно таким форматом взаимодействия гордилась ОНК прошлых созывов, когда ростовская комиссия считалась чуть ли не самой эффективной по сотрудничеству правозащитников и тюремщиков.
17 августа Омельченко выложил пост о проверке ростовского отдела полиции № 4: «Были в легком шоке от увиденного. В камерах такая грязь, что лучше выйти на улицу и лечь на землю за углом, а вместо того, чтоб вывести задержанного в туалет, ему дали просто бутылку». По словам Омельченко, после этого поста полицейские открыли туалет, который находится рядом с камерами, и провели уборку.
Отношения ОНК с тюремщиками улучшились после смены руководства ГУ ФСИН в сентябре прошлого года. По словам Омельченко, при прошлом руководстве их и не пускали в отряды, и игнорировали заявления: «Мы доносили до управления, но прошлый начальник это не воспринимал, ничего не делал, чтобы что-то изменить». Члены ОНК сталкивались и с ситуациями, когда на осужденных давили, и они не обращались в комиссию или же отзывали жалобы. С новым же руководителем Дмитрием Безруких проводятся регулярные рабочие встречи, на которых обсуждаются проблемные вопросы: «Мы видим, что управление нас слышит, прислушивается к нам и устраняет нарушения, на которые мы указываем».

Самое громкое дело последних лет в Ростове, связанное с обличением комиссией действий тюремщиков, это пытки в межобластной туберкулезной больнице ГУ ФСИН по Ростовской области. Осенью 2020 года благодаря огласке со стороны ОНК стало известно о том, что пациентов привязывали к кроватям, подолгу не кормили и не отвязывали, из-за чего у них появлялись пролежни. Более того, известно и о смертях в этой больнице . По мнению членов ОНК, эти незаконные действия не пресекались по вине предыдущего руководства ГУ ФСИН.
Сейчас, говорит председатель ОНК, обращений о пытках нет, появляются жалобы лишь о неоказании или плохом оказании медицинской помощи и о неподобающих бытовых условиях.
В состав пятого созыва ОНК Ростовской области входит 32 человека. Среди них — ни одного бывшего сотрудника ФСИН. Есть бывший полицейский в возрасте, который не выезжает на встречи. Остальные — гражданские: врачи, юристы и т.д. Однако несмотря на расширенный состав комиссии, работает и принимает участие в выездах пять человек, которые стараются охватить область и все учреждения. Два человека из предыдущих составов комиссии также относятся к неактивному большинству. «Заинтересованности не видим», — говорит Омельченко.

«До 2019 года, будучи членами ОНК, мы были как кость в горле у ФСИН, полиции, психиатрических клиник. Таких не любят. В следующий состав нас не включили. Честные не нужны. Нужны угодливые», — так ответил на вопрос «Новой» правозащитник Алексей Полищук. «В ОНК больше десятка человек, но реально по колониям ходят всего два-три», — отмечал в 2018 году юрист и бывший член комиссии Юрий Рябцев.
В 2019 году ОНК продолжила работу без Рябцева и Полищука, которые за время работы в комиссии обошли едва ли не все спецприемники, ИК, СИЗО, психиатрические клиники и отделы полиции в окрестностях Тюмени.
В колонии, в том числе за 300 километров, ездили за свой счет, потому что у тюменских правозащитников никогда не было ни президентских грантов, ни сторонней финансовой поддержки.
У меня был и личный опыт работы с той ОНК. В 2018 году меня обвинили в том, что я якобы поцарапала руки двоим сотрудникам полиции. Находясь в СИЗО, я написала жалобу в ОНК, в которой указала, что в камере холодно и нет горячей воды, весь день играет радио, еда выглядит как отходы. Говорила и о применении силы, и о неоказании медицинской помощи. Скорую не вызывали ни при каких обстоятельствах — даже беременным.
Рябцев не только отреагировал на нарушения в условиях содержания, но и нашел мне дотошного адвоката, который по моему делу составил три тома ходатайств.
У нынешнего состава ОНК есть свой сайт. На нем есть имена 15 членов комиссии. Но нет ни их телефонов, ни информации о выявленных нарушениях.
«В Кургане ОНК нет как таковой», — меланхолично вздыхает экс-координатор курганских сторонников Навального Алексей Шварц, отсидевший 102 дня за организацию зимних и весенних митингов.
Упоминание об ОНК пятого созыва размещено на сайте Общественной палаты Курганской области. Председателем комиссии является Александр Сорокин, всего в ее составе семь человек. Но чем они заняты — вопрос без ответа.
«Пока я сидел за зимние митинги, мой защитник Никита Ильин написал в ОНК про нарушения условий моего пребывания. Я сидел вместе с разлагающимся человеком, у него ноги были черными выше бедер», — продолжает Шварц. Мужчина бредил и кричал от боли, но медсестра долгое время не видела «ничего экстраординарного». По словам Алексея, когда мужчину все же решили отвезли на ампутацию, в больнице для него не нашлось мест. Привезли обратно досиживать срок, объяснив это тем, что его должны оперировать в больнице по прописке.

«Примерно через месяц ко мне приехал уполномоченный по правам человека, который сообщил мне, что он направлял в ОНК запрос на проведение проверки», — продолжает Алексей. Омбудсмен Борис Шалютин ответил ему, что ОНК приезжала два раза. Алексей Шварц удивляется: с ним никто не беседовал.
Перед весенними митингами Шварца также поместили на два месяца в спецприемник, установив российский рекорд по длительности ареста. Борис Шалютин вновь сообщил ему, что члены ОНК его посещали и собрали жалобы. Уполномоченный по правам человека заверил его, что он потребует посещения ОНК на следующей неделе, и они пообщаются.
«Я подумал, это эшники. Какие-то люди ходят, с ментами общаются на «ты», матерятся. Оказалось, что это ОНК.
Они приезжают в спецприемник и не доходят дальше поста, просто жмут руки, братаются с ментами, с надсмотрщиками, даже не идут заключенных опрашивать. Зафиксировали въезд-выезд и ушли».
Помощница Алексея Софья Лопатина объявляла голодовку в спецприемнике, протестуя против длительного срока заключения — 40 суток ареста. Уполномоченный приехал к ней в этот же день, пообещав, что ее навестят и члены ОНК. Но с Софьей представители комиссии также не встретились.
За прошлый год члены курганской ОНК всего девять раз посетили зауральские колонии, объяснив это коронавирусными ограничениями. Члены ОНК отметили, что работу с обращениями граждан они все равно проводят. Относительно условий содержания к ним поступило 23 жалобы по вопросам организации питания, медицинской помощи и материально-бытового обеспечения. Жаловались заключенные и на дисциплинарные взыскания.
По мнению председателя ОНК Александра Сорокина, сотрудники колоний вовремя предоставляют все бумаги и документы, работе членов комиссии не препятствуют. С начальником УФСИН Михаилом Мачушкиным они встречаются за одним круглым столом.
«Безмятежной» работа ОНК в регионе была не всегда. В 2017 году правозащитник Александр Андрюков и члены ОНК пытались попасть в ИК № 1, получив сообщение об избиении заключенного бойцом спецназа ФСИН. Не сумев добиться от руководства колонии встречи с заключенными, правозащитники предали ситуацию огласке.
Сейчас о случаях смерти и изнасилованиях заключенных в курганских колониях можно узнать только по факту возбужденных уголовных дел. Такие новости, увы, появляются каждый год.
