Viktor Filinkova is tightened by the conditions of punishment in the colony for ordinary human actions. In response, he announced an indefinite hunger strike. What can you do for him?

On October 30, Viktor Filinkov announced a hunger strike demanding freedom to all the country's political prisoners.

(Such one -day actions have been held in camps since 1974, when on this day the prisoners of Mordovian and Perm camps held a hunger strike with the demands to recognize the status of political prisoners, make the regime of maintenance more humane and open places of imprisonment for inspection to international organizations.)

He demands: translate it from a single camera, as well as give him books, newspapers, written supplies and documents in his criminal case. The court sentenced Filinkov to the 7 years of the general regime, but the leadership of the colony actually arbitrarily changed it to strict: from August 12, when Victor arrived in IK-1 of Orenburg, he spent only three days in the detachment.

And the rest of the time - in strict conditions, a penalty isolate or PCT (chamber type), and the whole first month is in a single conclusion.

Although such a penalty as a room in a single camera is provided only in the camps of a special regime and prisons - there is no such punishment on general or strict mode.

A single conclusion is considered as the most stringent penalty of not only Russian, but also by international law. According to paragraph 60.5 of European penitentiary rules (EPP), a single conclusion should be used as a punishment only in exceptional cases and for a specific period, which should be as short as possible. And in accordance with paragraph 57.1 of the EPP, "only behavior can be considered a disciplinary violation that can pose a threat to internal routine, regime or security."

But what is the threat to the regime in “violations” attributed by Filinkov, such as: “expressed a jargon words”, “slept lying on a bench”, “violated the shape of clothing” or “refused to clean the walking yard”?

One thing is indisputable: the conditions that Viktor Filinkov contains almost three months, in the practice of the ECHR are unambiguously assessed as torture.

On October 28, Filinkova was placed in a schizo for the ninth time, again alone, this time for five days. The term of this punishment is summarized with the previously assigned monthly content in the PCT (until November 14). Then it should be transferred to the detachment of strict conditions for serving the punishment (ISUON or SUS), unless, of course, they come up with a new occasion to extend the PCT or not transferred to the EPT (a single chamber -type premises) to another institution of the region.

Trying to put the limit to the constant psychological pressure and violation of his legal rights, Viktor Filinkov filed several statements and complaints to the IK-1 administration, the prosecutor's office and the court. But, as the defender Filinkov Evgeny Kulakov reports, it was not possible to find any traces of his appeals outside the colony, as well as the registration of complaints and statements by Filinkov to the heads of IK-1 itself.

“Victor was not presented with receipts on the administration of the colony by his complaints to the court and the prosecutor’s office, he was not familiarized with the records of their registration in a special journal. There are no appeals in the case of convicted Filinkov, ”says Kulakova. - In the office of the Central District Court of Orenburg, which Victor was addressed to one of the complaints, we were officially confirmed that she did not enter them. Or another example: on August 18, Victor personally handed over to the head of the colony Alexander Nikolayevich Grebennikov a statement about the need to ensure the confidentiality of communication with his defenders (while it occurs through the glass, by telephone, which may listen to employees). On September 29, Victor on evening verification re -submitted such an application addressed to the head of the colony. But there was no reaction. And in a letter of November 3, in response to my appeal, the head of the colony Grebennikov reports: and did not receive such a statement from Filinkov. At all".

The request of the "new", which we sent to Mr. Grebennikov, was also simply ignored. True, it will not be difficult for us to document the fact of its sending - which we are ready to do when we are considering our complaint by the prosecutor's office.

Evgenia Kulakova sent complaints to the prosecutor's office and the Office of the Federal Penitentiary Service in the Orenburg region. She asks to conduct a verification on the facts of violation of Viktor Filinkov guaranteed by law to submit appeals, take the necessary measures to restore him in these rights, and be held responsible in their violation. Evgenia considers it necessary to request when checking the record of video surveillance cameras and Vedios register to confirm the facts of Filinkov’s application.

On November 2, he was visited by the Orenburg lawyer Eldar Sharafutdinov. He said that Victor drinks only water, he feels normally.
