The Ministry of Justice proposed not to provide the administratively detained free lawyer

The Ministry of Justice of Russia proposed not to include the norm on the provision of free legal assistance to people who drew up an administrative protocol under an arrest article in the final draft of the Procedure Code of Administrative Offenses. This was reported by the publication "Lawyer Street".

The Ministry of Justice is developing new codes on administrative offenses for about two years - the first projects were submitted back in January 2020. Then human rights activists drew attention to the fact that the versions of the new Code of Administrative Offenses and PRKOP do not contain the right to free legal assistance in cases where a person threatens administrative arrest.

Human rights activists indicated to the Ministry of Justice that in the new codes there is no guarantee for the provision of a free lawyer. The department replied that "they are working on a question."

In June 2020, the department published a modified version of the Prokoap - the promised norm appeared in the project. It said that "in the case when an administrative offense may be sentenced to administrative arrest, the person in respect of whom the proceedings are being carried out in such an administrative offense case has the right to use legal assistance for free." But these projects were sent for revision.

At the disposal of "Lawyer Street" were the third versions of the new codes - and they have no norms about a free lawyer again. The Ministry of Justice has not yet answered the questions of the publication about this.
